Abstract

Munculnya Corona Virus Disease 2019 membuat pemerintah mengeluarkan kebijakan untuk melakukan social distancing maupun physical distancing di tengah-tengah masyarakat termasuk di dalam Lapas maupun di dalam Rutan yang ada di seluruh Indonesia. Dikarenakan keadaan rutan maupun lapas kita yang over kapasitas tentunya tidak bisa menerapkan social distancing maupun physical distancing maka muncullah Kebijakan Menteri Hukum dan HAM RI Nomor: 10 tahun 2020 tentang pengeluaran dan pembebasan narapidana melalui proses asimilasi dan integrasi dalam menanggulangi pandemic Covid-19. Ternyata kebijakan ini menuai beberapa kontroversi, dari meningkatnya jumlah kriminalitas dan terjadinya residivis. Jenis penelitian yang dilakukan adalah penelitian hukum empiris, dengan jenis pendekatan yang dilakukan adalah pendekatan fakta, pendekatan sosiologis hukum, dan pendekatan kasus. Sumber data yang digunakan adalah data primer, data sekunder, dan data tersier. Pengumpulan data dilakukan dengan cara observasi dan wawancara. Teknik pengolahan dan analisis data dilakukan dengan cara deskriptif kualitatif lalu penyajian data pada penelitian ini menggunakan metode deskriptif analisis kualitatif. Hasil penelitian tentang Implementasi Asimilasi Terhadap Narapidana Untuk Pencegahan Dan Penanggulangan penyebaran Covid-19 di Lembaga Pemasyarakatan Narkotika Kelas IIA Bangli Kebijakan ini secara cepat telah berhasil mengeluarkan 142 orang dari Lapas Narkotika Bangli, sehingga sedikit memberikan kontribusi untuk melonggarkan tingkat overcrowded meskipun masih jauh saat ini masih terjadi overcrowded, dari 1.200 napi sebelum kebijakan diterapkan menjadi 1.068 Napi setelah kebijakan di implementasikan.

Abstract

Penyalahgunaan narkoba merupakan masalah serius yang dihadapi oleh banyak negara, termasuk Indonesia. Untuk mengatasi masalah ini, pemerintah Indonesia memberikan sanksi rehabilitasi bagi pengguna narkoba, termasuk bagi warga negara asing yang tinggal di Indonesia. Tujuan dari penelitian ini adalah untuk menganalisis syarat-syarat pemberian sanksi rehabilitasi bagi pengguna narkoba, khususnya bagi warga negara asing di Indonesia. Selain itu, penelitian ini juga menyoroti pentingnya metode Self Management and Recovery Training (SMART) sebagai solusi efektif dalam rehabilitasi warga negara asing yang terjerat dalam penyalahgunaan narkoba di Indonesia. Metode penelitian yang digunakan penelitian hukum empiris dengan pendekatan kualitaif kritis yaitu penelitian yang sasarannya tidak saja menggali makna etik tetapi juga menciptakan makna etik. Teknik pengumpulan data dilakukan dengan wawancara dimana informan dipilih secara purposive. Teknik pengolahan dan analisis data dilakukan secara deskriftif kualitatif. Hasil penelitian menunjukan pemberian sanksi rehabilitasi bagi pengguna narkotika dilakukan oleh Tim Asesmen Terpadu yang terdiri dari tim dokter dan tim hukum. Tim Asesmen Terpadu bertugas melakukan asesmen dan analisis terhadap pengguna narkotika untuk menentukan apakah yang bersangkutan memenuhi syarat untuk direhabilitasi atau tidak dan metode SMART merupakan metode rehabilitasi yang efektif untuk warga negara asing karena program ini dapat disesuaikan dengan kebutuhan individu, bahasa, dan budaya yang berbeda. Program ini juga menekankan pada tanggung jawab individu dalam proses pemulihan, sehingga dapat membantu individu untuk membangun rasa percaya diri dan kontrol diri yang lebih baik.

Abstract

Religion, previously regarded as a shared source of values and social norms, is now increasingly understood as a personal reconstruction process reflecting individual freedom in interpreting religious teachings. In Bali, this phenomenon is evident in the evolving practices of Balinese Hinduism, influenced by modernization and globalization. Nevertheless, the Balinese Hindu identity remains preserved by most of the community as an integral part of their culture. Balinese Hinduism plays a crucial role in maintaining social and cultural harmony through the implementation of panca yadnya rituals and the Tri Hita Karana principles, which emphasize balance in relationships between humans, God, and nature. This study aims to examine the dynamics of changes in Balinese Hindu practices and explore their role in maintaining social and cultural harmony amidst the challenges of globalization. The method employed is a literature review, analyzing relevant academic sources to develop theoretical contributions toward the preservation of Balinese Hindu culture and religion. The findings reveal that despite the increasing influence of modernization, local religious practices such as panca yadnya remain central to Balinese life. The tri hita karana principles continue to serve as a foundational framework supporting cultural sustainability and social harmony in the face of changing times. In conclusion, the Balinese Hindu identity demonstrates significant resilience through the integration of local traditions with modern challenges. This study highlights the importance of preserving Balinese Hindu religion and culture as a means of safeguarding social harmony and local wisdom in the era of globalization.

Abstract

Drug abuse is a serious problem faced by many countries, including Indonesia. To overcome this problem, the Indonesian government provides rehabilitation sanctions for drug users, including foreign citizens living in Indonesia. This research aims to analyze the regulation of drug rehabilitation for foreign nationals in criminal acts of drug abuse in Denpasar City and this research also highlights the importance of the Self Management and Recovery Training (SMART) method as an effective solution in the rehabilitation of foreign nationals caught in drug abuse in Indonesia. The research method used is empirical legal research with a critical qualitative approach. The data collection technique was carried out by interviews where informants were selected purposively. Data processing analysis techniques are carried out in a qualitative descriptive manner. The research results show that foreign citizens involved in drug abuse crimes in Denpasar City can undergo the same rehabilitation program as Indonesian citizens. This process begins with applying to local authorities, such as the police or authorized agencies. However, rehabilitation policies for foreign nationals depend on various factors, including the severity of the offense and whether they are willing to cooperate with authorities, and drug rehabilitation for foreign nationals is important. The SMART method is an effective rehabilitation method for foreign nationals because this program can be adapted to different individual needs, languages, and cultures. This program also emphasizes individual responsibility in the recovery process, so that it can help individuals to build a better sense of self-confidence and self-control.

Abstract

Indonesia’s COVlD-19 first cinfirmed case was found in March 2020 and continued to increase until September 2020. As the number of cases increased, the government applied a Large-Scale Social Restrictions Policy (PSBB) to help minimize additional cases. With the implementation of the UN policy by the government, many have lost income from various sectors whose livelihoods depend on their daily income. The disruption of economic activity due to the lockdown policy to contain the spread of the virus has led to the closure and bankruptcy among many companies, resulting in a massive reduction in the number of workers and layoffs, especially in the sectors most affected by the pandemic. Many workers who are laid off make people lose their source of livelihood, forcing them to be more creative in order to struggle. One of them is the improvised street merchants, where the car is used as a selling space, which helps people in terms of economic turnover. However, selling on the roadside without a permit is an offence. The municipal police (Satpol PP) need to discipline the street merchants since they violate the Regional Regulation No. 1/2015 concerning Public Order. This regulation has been violated by many merchants and thus, it needs to be brought back into order. Keywords:  Fostering, street merchants
