Abstract

Abstract: Riddah (apostasy), in the classical literatures of Islamic Jurisprudence, is categorized as a jarimah al-hudud (criminal act) with death penalty as the punishment. The fundamental issue is that the threat of the death penalty is only based on a single prophetic tradition, while it should be determined by the absolute and valid texts. It means that the death penalty is rooted to an absolute legal argumentation (qat’i al-dalalah), while, there is none of the verses of al-Qur’an which discusses about punishment for the perpetrator of apostasy. Otherwise, al-Qur’an absolutely guaranteesthe freedom of religion and belief. This research uses maqasid al-shari’ah (purposes of Islamic law)as an approach to see the purpose, spirit, and essential valueof the text to be a foundation and method in Islamic legal reasoning. The results of the research are: first, adopting what has been stipulated in al-Qur’an textually and formally without appreciating its purpose and wisdom is not wise; second, apostasy, which is a kind of a private matter between a servant and his God, should not be categorized as a jarimah al-hudud but as a jarimah ta’zir (undefined crime). In certain condition, however, apostasy could be charged by a maximum penalty (death penalty) if it is accompanied by other crimes and is worthyto be sentenced based on a judge’s argumentation. Keywords: Apostasy, sanctions, maqasid al-shari’ah  Abstrak: Riddah dalam literatur fiqih klasik dikategorikan sebagai jarimah hudud, dan diancam dengan hukuman mati. Persoalan yang mendasar adalah ancaman hukuman mati tersebut hanya berdasarkan hadis ahad, padahal hudud dikonsepsikan sebagai jarimah dan hukuman yang telah ditentukan secara pasti oleh nass. Berarti hudud meniscayakan dalil yang qat’i al-dalalah, sedangkan dalam al-Qur’an tidak ada satu ayat pun yang membahas hukuman duniawi untuk pelaku riddah, sebaliknya al-Qur’an justru memberikan jaminan kebebasan beragama dan berkeyakinan secara mutlak. Maqasid al-shari’ah dipilih sebagai pendekatan untuk melihat bagaimana tujuan, ruh, dan nilai-nilai esensial shari’at dijadikan landasan dan patokan utama dalam penentuan hukum Islam. Dengan pendekatan maqasid al-shari’ah, diperoleh kesimpulan bahwa bukanlah sikap yang bijak ketika mengadopsi apa yang ditetapkan dalam nass secara literal dan formal legalistik tanpa mengapresiasi tujuan serta hikmah terdalam dari hukum tersebut. Riddah yang merupakan persoalan pribadi antara hamba dengan Tuhan-Nya, tidak selayaknya dikategorikan sebagai jarimah hudud. Namun sebagai jarimah ta’zir, riddah bisa dikenakan hukuman maksimal (mati) jika disertai dengan kejahatan lain yang menurut hakim harus dijatuhi hukuman tersebut.

Abstract

Peran perempuan cukup besar utamanya bagi ketahanan ekonomi baik secara nasional maupun domestik. Kemandirian perempuan secara ekonomi merupakan sebuah upaya menaikkan derajat dan harga dirinya demi menyelamatkan perempuan dari kemiskinan, ketertindasan, juga keterbelakangan. Penelitian ini berjudul “Analisis Maqaṣid Al-Shari’ah Terhadap Pemberdayaan Perempuan Dalam Home Industry Kopyah Di Desa Bungah Kecamatan Bungah Kabupaten Gresik”. Rumusan masalah yang dikaji ialah (a) bagaimana pemberdayaan perempuan dalam home industry kopyah Desa Bungah, dan (b) bagaimana analisis maqaṣid al-shari’ah terhadap pemberdayaan perempuan dalam home industry kopyah Desa Bungah Kecamatan Bungah Kabupaten Gresik. Tujuannya ialah untuk mengetahui pemberdayaan perempuan dalam home industry kopyah Desa Bungah Kecamatan Bungah Kabupaten Gresik serta untuk mengetahui pandangan dari maqaṣid al-shari’ah-nya. Dengan menggunakan metode deskriptif kualitatif peneliti berusaha mengamati fenomena yang terjadi di lapangan menyangkut home industry kopyah terkait upaya pemberdayaan perempuan. Lokasi penelitian ini ialah di Desa Bungah Kecamatan Bungah Kabupaten Gresik Provinsi Jawa Timur. Hasil dari penelitian ini menunjukkan bahwa home industry kopyah di Desa Bungah dalam hal pemberdayaan perempuan dilakukan melalui beberapa tahapan yaitu: tahap penyadaran, tahap pengkapasitasan dan tahap pendayaan. Tahap penyadaran dilakukan dengan sosialisasi oleh pemilik usaha kopyah kepada para pekerja perempuan di Desa Bungah; tahap pengkapasitasan dilakukan dengan memberikan pelatihan kepada para pekerja perempuan; dan tahap pendayaan dilakukan dengan memberdayakan perempuan dengan menjadikan sebagai pekerja kopyah dengan tetap dalam pantauan dan pengawasan pengusaha kopyah. Proses pemberdayaan perempuan yang dilakukan oleh home industry kopyah di Desa Bungah Kecamatan Bungah Kabupaten Gresik telah memenuhi lima unsur pokok dalam maqaṣid al-shari’ah. Kelima unsur pokok tersebut yakni pemeliharaan agama (ḥifẓ al-dīn), jiwa (ḥifẓ al-nafs), akal (ḥifẓ al-aql), keturunan (ḥifẓ al-nasl), dan harta (ḥifẓ al-māl).

Abstract

Waqf is a concept in Islam that refers to the gift of property that is eternally useful for benevolent purposes. The history of waqf dates back to the time of Prophet Muhammad SAW, where he and his companions practised waqf as a means to fulfil the social and religious needs of the community. Initially, waqf was used to build mosques, madrasas, and provide public facilities such as wells and roads. The development of waqf continued during the Islamic Caliphate, with the establishment of various waqf institutions that supported education, health, and public infrastructure. In the modern era, the concept of waqf underwent a transformation with applications in broader economic and social fields, including the professional management of waqf assets to ensure the sustainability of its benefits. The history of waqf demonstrates its important role in the development of Islamic civilisation and its contribution to the welfare of society as a whole.

Abstract

Dalam kehidupan seorang muslim, kiranya perlu mengambil nilai-nilai pendidikan dari akhlak dalam kisah Rasulullah Muhammad SAW dan dijadikan contoh serta landasan kita agar terciptanya hubungan baik antara hamba dan Allah SWT (hablumminallah) dan antar sesama (hahlumminannas). Dari uraian ini penulis mengajukan suatu permasalahan yaitu bagaimana nilai-nilai pendidikan akhlak Rasululah SAW yang terdapat dalam kitab Syamail Muhammdiyah? dan bagaimana kehidupan sehari-hari Rasululah SAW menurut kitab Syamail Muhammdiyah? Metode yang digunakan dalam penelitian ini adalah penelitian kepustakaan (library research), metode pengumpulan datanya yakni dengan teknik dokumentasi. Sumber data primer yaitu kitab Syamail Muhammdiyah karya Imam Tirmizi. Diantara sumber sekunder adalah kitab Shohih Muslim dan Syarah Shohih Muslim karya Imam Nawawi serta kitab-kitab hadis beserta syarah nya, kitab-kitab yang relevan dan buku-buku Sirah Nabawi. Hasil penelitan ini menunjukkan bahwa nilai-nilai pendidikan akhlak dalam kehidupan sehari-hari Rasulullah SAW berdasarkan analisis yang dilakukan maka terungkap temanya adalah “kehidupan Rasulullah SAW”. Adapun keteladanan yang dapat diambil dalam kitab tersebut di antaranya jauhkan diri dari perbuatan keji, berbicaralah dengan jelas dan tegas, jadilah pemaaf serta mudah memaafkan kesalahan orang lain, tebarkanlah senyum sesama muslim, bacalah Al-Qur'an dengan fasih, dan janganlah berbuat sombong

Abstract

Penelitian ini bertujuan untuk menganalisis pandangan masyarakat Desa Gresikan Krian terhadap kondisi keamanan lingkungan, efektivitas penerapan kebijakan hukum dalam menanggulangi tindak pidana pencurian, serta hubungannya dengan prinsip-prinsip dalam hukum pidana Islam. Metode yang digunakan ialah kualitatif deskriptif dengan pendekatan sosio-yuridis melalui wawancara mendalam dan dokumentasi di lapangan. Hasil penelitian menunjukkan bahwa masyarakat masih merasakan rendahnya tingkat keamanan akibat tingginya angka pencurian, minimnya sarana pengamanan, serta lambatnya respons aparat penegak hukum. Sanksi pidana yang diatur dalam Pasal 362 KUHP dinilai belum memberikan efek jera yang signifikan, sehingga masyarakat lebih cenderung menerapkan sanksi sosial seperti pengembalian barang hasil curian, kegiatan kerja bakti, dan penguatan ronda malam. Dalam pandangan hukum Islam, langkah-langkah tersebut sejalan dengan konsep taʿzīr yang bersifat mendidik, fleksibel, dan berorientasi pada kemaslahatan umum. Upaya pencegahan seperti pemasangan kamera pengawas (CCTV), pengoptimalan kegiatan siskamling, dan mediasi kasus ringan mencerminkan prinsip sadd al-dhari‘ah, islah, serta maqāṣid al-sharī‘ah, khususnya ḥifẓ al-māl (perlindungan terhadap harta) dan ḥifẓ al-nafs (perlindungan terhadap jiwa). Penelitian ini menegaskan bahwa kolaborasi antara masyarakat, aparat penegak hukum, dan kebijakan yang berlandaskan nilai-nilai Islam dapat menjadi strategi yang efektif dan berkelanjutan dalam mengatasi tindak pencurian di tingkat lokal.

Abstract

Kalimantan is renowned for its exceptionally high biodiversity, making it one of Indonesia’s most ecologically significant regions. However, this rich natural environment faces serious threats from human activities such as deforestation, plantation expansion, mining, and land conversion. These actions not only endanger endemic species but also disrupt ecological balance and negatively affect the livelihoods and welfare of local communities who depend on natural resources for their daily needs. This study employs a qualitative-descriptive approach based on literature review to examine these environmental threats and to analyze how Pancasila values particularly principles 3 (unity), 4 (deliberation), and 5 (social justice) can guide conservation efforts. Findings indicate that short-term economic exploitation often neglects ecological concerns and exacerbates social inequalities. The principle of unity is crucial for reconciling the sometimes conflicting interests of government, private sectors, and local communities. Deliberation ensures that conservation policies are developed inclusively, while social justice protects the rights and welfare of local residents, particularly indigenous and marginalized groups. Moreover, the concept of ecological justice emphasizes the responsibility of the current generation to safeguard environmental resources for future generations. Effective conservation in Kalimantan, therefore, requires adherence to Pancasila values and collaborative efforts across sectors, combining ecological preservation with social equity. Such an approach promotes sustainable development that balances human needs with the protection of biodiversity and ecosystem integrity.

Abstract

This abstract aims to analyze the integration of Islamic economic principles with law enforcement through a review of the Compilation of Islamic Economic Law (KHES) and Islamic Criminal Law. The main study lies in how Islamic jurisprudence (fiqh) principles function as a philosophical and operational basis in mitigating economic disputes. Using normative legal research methods, this article examines various contracts in KHES that often intersect with aspects of legal violations. The research findings show that Islamic jurisprudence principles such as "al-ashlu fi al-'uqud alibahah" (the original law of the contract is permissible) and "al-dhararu yuzal" (harm must be eliminated) provide flexibility as well as ethical boundaries in modern transactions. However, when a breach of contract occurs that contains elements of fraud (tadlis) or embezzlement, Islamic economic law does not only stop at civil settlement, but also intersects with the realm of Islamic criminal law through the ta'zir sanction mechanism. This analysis confirms that the enforcement of the Islamic Law (KHES) requires synergy with the principles of criminal law to create a deterrent effect against economic behavior that harms the public.

Abstract

Exclusive breastfeeding is essential for infant growth and development; however, many mothers experience difficulties in maintaining adequate milk production during the early postpartum period. Natural galactagogues such as date palm extract (Phoenix dactylifera) and almond milk (Prunus dulcis) are traditionally believed to enhance breast milk volume, but evidence from comparative multicenter studies remains limited. This study aimed to compare the effectiveness of date palm extract and almond milk on breast milk production among lactating mothers. A multicenter quasi-experimental pre–post design was conducted in five health centers in Indonesia between 2025. A total of 100 postpartum mothers who met inclusion criteria were divided equally into two intervention groups: date palm extract (n = 50) and almond milk (n = 50). Participants consumed the assigned intervention twice daily for 14 consecutive days. Breast milk volume was measured using the test-weighing method before and after the intervention. Data were analyzed using paired and independent t-tests with a significance level of 0.05. Both interventions significantly increased breast milk volume (p < 0.05). The mean increase was greater in the date palm extract group (mean ± SD: 6.25 ± 4.10 ml) than in the almond milk group (3.90 ± 4.60 ml), with a mean difference of 2.35 ml (95% CI: 0.42–4.28; p = 0.018). No adverse effects were reported among participants. Date palm extract and almond milk were both effective in enhancing breast milk production, but date palm extract showed a more consistent and higher effect across study sites. Further randomized controlled trials with larger sample sizes are recommended to confirm these findings and to explore biochemical mechanisms underlying the lactogenic effects
