Abstract

This article will discuss the position and application of Islamic family law in countries with Muslim minority populations, particularly in Singapore. In every Muslim community in the world, no one denies the existence of Islamic law with its universal character of application. The universality of the application of Islamic law requires the submission of all Muslims to the teachings of Islam, will not see the time and place not to implement its provisions, and also requires the existence of universal values contained in branch laws that may differ from one place to another. That is why Muslims in Islamic countries and countries where the majority of the population is Muslim have relatively no problems with the application of Islamic law in everyday life because Islam upholds religious tolerance. The above reality will undoubtedly be different if Islamic law develops among Muslims, who are a minority in secular countries, namely countries with a government system that separates religion as a private matter.

Abstract

Contemporary ijtihad is required in the formulation of new formulas, such as legal protection of the rights of children outside marriage whose biological father is known. Reformulation of Jurisprudence as an analysis of Islamic law must be able to answer socio-cultural problems in the modern era, such as proof of the use of DNA as genealogy. An adaptive formulation of Jurisprudence on contemporary cases by combining science and Maqaṣid al-Shari'ah is analyzed in this article. The resolution of Islamic law by referring to the opinions of the Four Madhhabs of Jurisprudence needs to be approached or juxtaposed with science. A correct understanding of the values contained in the sharia and the application of Maqaṣid al-Shari'ah are indispensable in contemporary ijtihad so that the face of Jurisprudence can dialect with the times. So that the determination of lineage by DNA can be used as a legal reference that is adaptive to science and in accordance with the great objectives of Maqaṣid al-Shari'ah.

Abstract

This thesis aims to discuss some of the public's responses or views regarding BSI Syariah Indralaya Branch. In collecting data in the community, researchers chose Indralaya Mulya Village, Indralaya District, Ogan Ilir Regency as the place for research. The results of this research conclude that the presence of Bank Syariah Indonesia (BSI Syariah Indralaya branch) has an important meaning in developing society from an economic aspect to implement Islamic law. The public in various perceptions stated that Sharia Banks must maximize the socialization process in overcoming the lack of public understanding of Sharia Banks. Apart from that, we can also find out the causes of the public's tendency towards conventional banks and the underlying reasons why people do not choose Sharia Banks. Therefore, the presence of BSI Syariah Indralaya Branch is believed to have increased the tight competition in the world of banking, accompanied by the hope of creating new breakthroughs in in order to improve the standard of living of the community while also providing choices for the community regarding views and beliefs regarding bank interest which according to some Ulama is included in the practice of usury which is not in accordance with Islamic Sharia. The method used is a qualitative research method which seeks to describe the phenomena that occur when conducting research on public perceptions of BSI Syariah Indralaya branch. For this reason the author carries out data collection through observation, interviews, documentation, or direct data collection by hand to collect it. data or documents that can provide an overview of locations and objects.

Abstract

Parents are the people who play the most important role in the growth and development of children, especially in the world of education. In the world of education, there are three things that support the achievement of educational goals. The education in question is formal, non-formal and informal education. Of the three supports for children's education, the most influential is informal education, where parents and families are the factors that will determine the character of a child so that they can become a quality generation. The discussion in this study is the role of parents in fostering children's interest and motivation to learn fiqh at TPA Hasan Al-Hanafiyah Bakung Hamlet, Suwari Village. With a discussion that focuses on 1). How do parents support their children in learning fiqh at TPA Hasan AL-Hanafiyah Bakung Hamlet, Suwari Village. 2). How do parents foster children's interest in learning fiqh at TPA Hasan Al-Hanafiyah Bakung Hamlet Suwari Village. 3). How do parents motivate children to learn fiqh at TPA Hasan Al-Hanafiyah Bakung Hamlet, Suwari Village. The research method used is qualitative research method, and for the data collection process using observation, interview and documentation techniques. While for data analysis using triangulation techniques. The results of the study showed that: a) the role of parents in supporting children to learn fiqh is very important considering that parents play a role as educators, protectors, mentors and discipline enforcers; b) the way parents foster children's interest is by encouraging them to learn fiqh. The way parents foster children's interests by providing encouragement, supervision and control so that children's interests can be directed clearly; c) the way parents motivate children is to provide encouragement, direction and help children to be enthusiastic in studying fiqh.
