Abstract

This study addresses the main legal issue concerning the management of underground space in major cities in Indonesia amid rapid urbanization. The current regulations, such as the Basic Agrarian Law, do not provide clear provisions regarding the right to use underground space, leading to legal uncertainty and potential conflicts of interest. The position of this research is to analyze existing regulations through a normative juridical approach and propose legal solutions that are more adaptive to the needs of urban modernization. This paper examines the limitations of current regulations and suggests the need for more comprehensive, specific legislation governing underground space rights. The main findings of this study reveal the inadequacy of the existing legal framework in accommodating the management of underground space fairly and sustainably, and the urgency for regulatory reforms that are more responsive to Indonesia’s urbanization developments.

Abstract

This article examines the potential of Cyber Notary in facilitating international transactions and the legal challenges involved. With increasing demand for swift and secure cross-border transactions, technologies like digital signatures and blockchain offer innovative solutions for faster document validation. Successful implementations of Remote Online Notarization (RON) in the United States and the eIDAS standard in Europe highlight their effectiveness in enhancing efficiency. In Indonesia, challenges such as regulatory inconsistencies, limited public trust in digital documents, and cybersecurity issues hinder adoption. While the Electronic Information and Transactions Law provides a legal basis for electronic documents, achieving international recognition remains a significant hurdle. This research uses a normative legal methodology with a comparative approach, analyzing Cyber Notary practices in different jurisdictions to uncover opportunities and obstacles. Strengthening regulations, improving digital infrastructure, and increasing public awareness are critical steps to realize Cyber Notary’s potential. If successfully implemented, Cyber Notary can facilitate efficient, secure, and legally recognized international transactions, advancing Indonesia’s role in the global digital economy.

Abstract

Abstract

Abstract

This study explores the integration of local values, particularly the Tumbaga Holing customary law, into Indonesia's national legal framework. Tumbaga Holing, as the customary legal system of the Mandailing community, plays a crucial role in regulating social life and maintaining communal harmony. However, the process of integrating it into positive law faces various challenges, ranging from differences in legal paradigms to the marginalization of communal rights (ulayat). This research adopts a normative juridical approach, analyzing specific articles within the Basic Agrarian Law (UUPA) and regulations related to indigenous communities. The results show that Tumbaga Holing has the potential to contribute to the national legal system, particularly in the areas of natural resource management and dispute resolution. However, challenges such as lack of formal recognition, legal bureaucracy, and political-economic power imbalances hinder this integration. Proposed solutions include strengthening indigenous institutions, promoting customary law awareness, and revising regulations to be more inclusive of indigenous communities. These efforts are expected to ensure that local values ??are fairly accommodated within the national legal framework.

Abstract

Abstract

The recognition of indigenous community rights, particularly ulayat rights, within Indonesia’s national agrarian legal system faces significant regulatory and practical challenges. Although Article 18B(2) of the 1945 Constitution and the Basic Agrarian Law (UUPA) acknowledge ulayat rights, the lack of clear technical regulations creates legal uncertainty and frequently sparks agrarian conflicts between indigenous communities, the government, and private entities. This study aims to analyze the recognition of ulayat rights and the challenges of integrating customary law into the national agrarian legal framework. Utilizing a normative juridical method, this research examines relevant regulations and legal literature to identify regulatory gaps and propose ideal solutions for ulayat rights protection. The research results indicate that the absence of clear verification and registration mechanisms has hindered the protection of ulayat rights, caused legal uncertainty, and triggered agrarian conflicts, as seen in the case of Pulau Rempang. To deal with these problems, this research suggests creating a separate, open, and honest body to check ulayat rights along with a computerized system for registering these rights that takes into account local knowledge.

Abstract

This study delves into the integration of customary law values with modern mediation in resolving land disputes in Indonesia, often marked by tensions between individual and communal interests as well as between customary law and national law. Employing a normative legal research methodology, this investigation explores relevant regulations, including the Basic Agrarian Law (UUPA) and the Law on Arbitration and Alternative Dispute Resolution, to understand how to harmonize the principles of customary law and mediation without undermining the supremacy of law at the national level. The research identifies two core issues: how distributive and procedural justice can be realized through this integration. Findings indicate that formal recognition of customary mediation outcomes and a comprehensive regulatory framework are crucial for establishing a fair and effective dispute resolution mechanism. This study advocates for the development of regulations that celebrate legal diversity, positioning land dispute resolution as a process that interweaves human values with local wisdom while simultaneously reinforcing the legitimacy of customary law within the national legal framework.
