Abstract

The research aimed to analyze the alignment between the judge's decision in cases of domestic violence against children and the provisions of Law Number 23 of 2004 on the Elimination of Domestic Violence and Qonun Number 9 of 2019 on the Implementation of Handling Violence Against Women and Children. The study also considered moral considerations and the overall benefits. The research methodology employs a case law study, which involves examining court decisions to get insight into the application of the law in specific circumstances. Specifically, the study focuses on the Decision of the Tapak Tuan District Court Judge Number 37/Pid.Sus/2020/PN. Case law is utilized to examine court rulings to comprehend how the law is implemented in specific instances. The library research method is employed in conjunction with a sociological juridical perspective. The data for the research is sourced from the Law and various pertinent articles addressing the research difficulties. Furthermore, to bolster the ideas of the study, the paper also incorporates the findings of several empirical studies. According to the findings, it appears that the judge primarily focuses on formal factors and gives little weight to material considerations in their decision-making process. This aligns with the viewpoint expressed by Member Judge II and the concurring opinion within the panel of judges. However, the author acknowledges and values the decision made by the panel of judges. The author recognizes the challenging nature of the judges' task, as they must not only consider the legal interests involved in the case, but also consider the community's sense of justice in order to achieve legal certainty.

Abstract

Central Bureau of Statistics data about the number of children out of school by level of education for the last 3 years showed that there are many children who do not go to school in Indonesia is still apprehensive. The number of children who are not in school From 2019 to 2021 for Elementary and the equivalent  is (0.85), (0.62), (0.65). Whereas Junior High School and the equivalent  in the same year are (6.92), (7.29), (6.77) and Senior High School and the equivalent  in the same year are (23.75), (22.32), ( 21,47). Meanwhile, Islamic teachings place great emphasis on protecting children because children are the next generation of the nation who can disseminate Islamic teachings based on the Quran and Hadith. This study used a qualitative approach which described and analyzed how Islamic law views child protection, especially regarding the fulfillment of children's educational rights. It resulted that the implementation of children's right to education are an important pillar for efforts to increase the degree of humanity and the advancement of human civilization which in Islam is known as hifz al-'aql (maintenance of reason). Islam teaches that education for every human being is very important. Everyone is required to study science until the end of his life. Allah SWT said in the Al-Mujadilah verse 11 which means "Allah will raise up to suitable ranks and degrees those of you who believe and who have been granted knowledge".

Abstract

One of the important aspects of a judge's decision in judicial power is the judge's consideration in giving the severity of a criminal sentence. The judge's consideration can be interpreted as an opinion about the good or bad of a matter in order to provide a decision or decision that is sentenced by a judge at the supreme court and judges at the lower judicial bodies as outlined by the judge in his decision. The judge's considerations are the thoughts or opinions of the judge in making a decision by looking at things that can lighten or burden the offender. Every judge is obliged to submit written considerations or opinions on the case being examined and becomes an integral part of the decision. The type of research used in this dissertation is normative research. The essence of the judge's own decision is the crown, and the peak of the criminal case so that the judge in giving a criminal decision must pay attention to all aspects. In the judge's consideration, there are 3 (three) aspects that the judge considers, namely juridical, philosophical and sociological aspects.

Abstract

Corruption comes from the Latin coruptio and corruptus which means to bribe and corrumpere which means to destroy. Corruption is included in jarîmah. Jarîmah is: "Prohibitions of syara', namely; Threats with 'uqūbat had or ta'zir". Ta'zir is: "'uqūbat determined by the authorities in order to refuse thinning and prevent crime". Corruption in Indonesian law is: "Unlawfully committing acts of enriching oneself or another person or a corporation that can harm state finances or the state economy". While the terms that are close to corruption in Islamic studies are: "ghulūl, ikhtilâs, risywah and al-fasad and". Corruption according to fiqh is: "It is a jarîmah or a modern and extraordinary crime for which there is no agreement on the terms and definitions. While the 'uqūbat is ta'zîr which is returned to waliyul amri".

Abstract

This research investigates Indonesia’s legal framework for addressing human smuggling, focusing on the integration of penal policies targeting its root causes and evaluating the impact of international collaborations in law enforcement. Despite existing literature on human smuggling, critical gaps remain, particularly in understanding the role of criminal policy as part of social policy and the practical effects of international cooperation. The study aims to answer two primary questions: the role of criminal policy in addressing human smuggling crimes in Indonesia and the non-penal policies Indonesia has implemented to combat human smuggling. This research adopts a normative legal methodology, analyzing Indonesia’s Criminal Code, the Eradication of Trafficking in Persons Law, the Suppression of Migrant Smuggling Law, and relevant international frameworks like the Bali Process. The study reveals that an effective approach to combating human smuggling requires a balance of penal and non-penal measures, strong adherence to territorial sovereignty, and enhanced international cooperation. It finds that while penal policies act as deterrents, non-penal strategies, such as victim protection and public awareness campaigns, are equally crucial. Additionally, the study highlights the importance of regional and international collaborations in strengthening law enforcement, emphasizing the need for specialized legal framework to address human smuggling.

Abstract

This study addresses the main legal issue concerning the management of underground space in major cities in Indonesia amid rapid urbanization. The current regulations, such as the Basic Agrarian Law, do not provide clear provisions regarding the right to use underground space, leading to legal uncertainty and potential conflicts of interest. The position of this research is to analyze existing regulations through a normative juridical approach and propose legal solutions that are more adaptive to the needs of urban modernization. This paper examines the limitations of current regulations and suggests the need for more comprehensive, specific legislation governing underground space rights. The main findings of this study reveal the inadequacy of the existing legal framework in accommodating the management of underground space fairly and sustainably, and the urgency for regulatory reforms that are more responsive to Indonesia’s urbanization developments.

Abstract

This article examines the potential of Cyber Notary in facilitating international transactions and the legal challenges involved. With increasing demand for swift and secure cross-border transactions, technologies like digital signatures and blockchain offer innovative solutions for faster document validation. Successful implementations of Remote Online Notarization (RON) in the United States and the eIDAS standard in Europe highlight their effectiveness in enhancing efficiency. In Indonesia, challenges such as regulatory inconsistencies, limited public trust in digital documents, and cybersecurity issues hinder adoption. While the Electronic Information and Transactions Law provides a legal basis for electronic documents, achieving international recognition remains a significant hurdle. This research uses a normative legal methodology with a comparative approach, analyzing Cyber Notary practices in different jurisdictions to uncover opportunities and obstacles. Strengthening regulations, improving digital infrastructure, and increasing public awareness are critical steps to realize Cyber Notary’s potential. If successfully implemented, Cyber Notary can facilitate efficient, secure, and legally recognized international transactions, advancing Indonesia’s role in the global digital economy.

Abstract

Masalah pengelolaan pertanahan di Indonesia sering kali diwarnai oleh birokrasi yang kompleks, sengketa tanah, dan ketimpangan akses layanan, yang membutuhkan reformasi mendalam. Penelitian ini menganalisis implementasi Peraturan Presiden Nomor 177 Tahun 2024 sebagai upaya memperbaiki tata kelola pertanahan melalui restrukturisasi organisasi, digitalisasi layanan, dan peningkatan kapasitas sumber daya manusia (SDM). Tujuan utama penelitian adalah mengevaluasi dampak kebijakan ini terhadap efisiensi pengelolaan tanah, koordinasi antar lembaga, serta penyelesaian sengketa tanah yang adil. Metodologi yang digunakan adalah penelitian normatif dengan pendekatan bahan hukum sekunder, termasuk analisis dokumen peraturan, literatur akademik, dan data empiris yang relevan.Hasil penelitian menunjukkan bahwa implementasi Perpres ini memberikan perubahan signifikan pada struktur organisasi Badan Pertanahan Nasional (BPN), termasuk pembagian wewenang yang lebih jelas dan koordinasi yang lebih efektif dengan Kementerian Agraria dan Tata Ruang (ATR). Digitalisasi layanan pertanahan terbukti meningkatkan efisiensi administrasi, mengurangi potensi manipulasi data, dan mempercepat penyelesaian sengketa tanah melalui verifikasi informasi yang lebih akurat. Selain itu, peningkatan kapasitas SDM melalui pelatihan teknis dan non-teknis mendorong profesionalisme dalam pelayanan dan mediasi konflik tanah. Namun, penelitian juga menemukan tantangan dalam implementasi kebijakan, seperti resistensi internal, kesenjangan teknologi di daerah terpencil, dan kurangnya infrastruktur pendukung.Sebagai kesimpulan, digitalisasi dan penguatan SDM merupakan pilar utama reformasi pertanahan yang mampu mendukung penyelesaian sengketa tanah secara adil dan memastikan akses yang merata terhadap layanan. Untuk keberlanjutan kebijakan, rekomendasi mencakup penguatan infrastruktur teknologi, evaluasi berkala, dan pelibatan masyarakat dalam proses pengelolaan tanah. Hasil penelitian ini diharapkan dapat menjadi kontribusi penting bagi pengembangan tata kelola pertanahan yang lebih inklusif di Indonesia

Abstract

Profesi notaris telah mengalami transformasi sejak era Mesir Kuno hingga era modern, di mana digitalisasi dan globalisasi menambah kompleksitas tugas yang dijalankan. Penelitian ini bertujuan untuk menganalisis evolusi profesi notaris, pengaruh konsep hukum Romawi seperti tabelliones dan tabularii terhadap sistem hukum Indonesia, serta strategi profesi ini dalam menghadapi tantangan digitalisasi tanpa mengabaikan prinsip hukum tradisional. Penelitian menggunakan metode yuridis normatif dengan bahan hukum primer dan sekunder, termasuk Undang-Undang Jabatan Notaris, Kitab Undang-Undang Hukum Perdata, dan Undang-Undang Informasi dan Transaksi Elektronik. Data dianalisis secara deskriptif kualitatif untuk mengevaluasi relevansi prinsip Tabellionis Officium Fideliter Exercebo dalam konteks modern. Hasil penelitian menunjukkan bahwa profesi notaris di Indonesia sangat dipengaruhi oleh tradisi hukum Romawi dan Eropa Kontinental, yang menekankan otentisitas dokumen dan kehadiran fisik. Digitalisasi memberikan peluang melalui konsep cyber notary, tetapi tetap memerlukan regulasi yang menjaga keabsahan dokumen hukum. Tantangan globalisasi menuntut kompetensi notaris dalam transaksi lintas negara. Kesimpulannya, profesi notaris harus mempertahankan prinsip tradisional sambil beradaptasi dengan inovasi teknologi dan kebutuhan masyarakat modern. Rekomendasi penelitian mencakup revisi regulasi, peningkatan pelatihan teknologi hukum, dan penguatan kerja sama internasional untuk menjaga relevansi dan kepercayaan terhadap profesi notaris.

Abstract

This study explores the integration of local values, particularly the Tumbaga Holing customary law, into Indonesia's national legal framework. Tumbaga Holing, as the customary legal system of the Mandailing community, plays a crucial role in regulating social life and maintaining communal harmony. However, the process of integrating it into positive law faces various challenges, ranging from differences in legal paradigms to the marginalization of communal rights (ulayat). This research adopts a normative juridical approach, analyzing specific articles within the Basic Agrarian Law (UUPA) and regulations related to indigenous communities. The results show that Tumbaga Holing has the potential to contribute to the national legal system, particularly in the areas of natural resource management and dispute resolution. However, challenges such as lack of formal recognition, legal bureaucracy, and political-economic power imbalances hinder this integration. Proposed solutions include strengthening indigenous institutions, promoting customary law awareness, and revising regulations to be more inclusive of indigenous communities. These efforts are expected to ensure that local values ??are fairly accommodated within the national legal framework.
