Abstract

The problem in this study is that it starts with the execution of coffee beans which are fiduciary collateral objects that belong to PT. Cideng Makmur Pratama held by Deutsche Bank by Bank Rakyat Indonesia. Deutsche Bank filed a resistance to the execution because it felt the seed was his property, Deutsche Bank also filed a PMH lawsuit against BRI through a Jakarta district court and was won by Deutsche Bank, then BRI filed an appeal and won so that Deutsche Bank filed a Cassation and produced a decision No. 2654 K / PDT / 2011. This study aims to analyze whether the judge's legal considerations regarding fiduciary collateral holders of inventory items in decision No. 2654 K / PDT / 2011 is in accordance with the laws and regulations and also to know the legal protection of Deutsche Bank as a creditor against the transfer of collateral objects for fiduciary supplies.This study uses normative juridical research methods, so that in this study the authors analyzed using secondary data sources. From the analysis carried out, it was found that the judge's legal considerations regarding the fiduciary collateral holder in the Decision Number 2654 K/PDT/2011 had not been in accordance with Law Number 42 of 1999 concerning Fiduciary Guarantees and Law No. 9 of 2006 concerning the Warehouse Receipt System and not in accordance with the petitum submitted by the applicant. Legal protection for Deutsche Bank is in the form of replacement of items that have been sold with the same or equivalent object and if the debtor does not replace the item with an equivalent value, Deutsche Bank has the right to pay from the sale of the collateral. This is based on the provisions of Article 21 paragraph (3) and (4) of Law Number 42 of 1999 concerning Fiduciary Guarantees. If the money from the sale is no longer available and there are still inventory items left, the creditor can execute in three ways, namely the executorial title, execution parate, and underhand execution.

Abstract

Program Pengabdian kepada Masyarakat bermitra dengan Kelompok PKK Perumahan Wirabaru 1, Kelurahan Pekuncen Kecamatan Wiradesa . Mitra merupakan komunitas yang memiliki anggota Ibu –ibu sebagai konsumen jual beli online. Dalam melakukan kegiatan juala beli online anggotanya terdiri dari ibu –ibu belum memahami hak dan kewajiban mereka sebagai konsumen dan upaya hukum yang harus mereka lakukan apabila ada kasus hukum dalam jual beli online tersebut.. Berdasarkan analisa situasi tersebut diatas, permasalahan yang dihadapi oleh mitra yaitu pertama, belum tahu hak dan kewajiban konsumen dan upaya hukum apabila dirugikan. Dengan demikian, solusi yang ditawarkan untuk menyelesaikan permasalahan mitra yaitu dilakukan sosialisasi & diskusi e-commerce beserta aspek hukumnya. Adapun metode kegiatan diawali dengan tahap persiapan, kemudian tahap pelaksanaan dan terakhir tahap pelaporan yang direncanakan selesai dalam jangka waktu 3 bulan. Hasil dan luaran kegiatan setelah dilaksanakan program telah tercapai yaitu, konsumen dalam hal ini mitra yaitu kelompok PKK mengalami peningkatan pemahaman mengenai pentingnya e-commerce khususnya pemasaran online beserta aspek hukumnya.

Abstract

The role of the internet in information technology has been used to develop the financial industry through modification and efficiency of financial services, known as Financial Technology or Fintech.  Fintech has many types, including payment startups, lending, personal finance, retail investment, crowdfunding, remittances, financial research and others. Fintech, a type of technology-based lending and borrowing money or peer to peer lending (P2P-lending), is a type of Fintech that is growing rapidly in Indonesia, problems that must be resolved regarding the Implementation of Justice Value For Consumer Protection (Study of The Financial Services Authority Regulation Number: 1/POJK.07/2013 concerning Consumer Protection in the Financial Services Sector). This research used normative juridical research method, which is focused on studying the implementation of the rules or norms in positive law, the conclusion of the Financial Services Authority Regulation Number 1/POJK.07/2013 concerning Consumer Protection of the Financial Services Sector in terms of its objective to provide protection to consumers is still not optimal, because the Financial Services Authority does not regulate the time frame for responding to complaints that have been submitted by the Consumers in the regulation

Abstract

Tourist villages in Batang Regency, Central Java, have great potential for development through pentahelix collaboration. Although collaborative efforts have been made, challenges such as inter-party coordination and marketing strategies still need improvement. The purpose of this research is to analyze the form of pentahelix collaboration in the management of tourist villages in Batang Regency and to identify supporting and hindering factors that affect this collaboration. This study uses empirical legal methods to analyze pentahelix collaboration in the management of tourist villages in Batang Regency through in-depth interviews, direct observation, and qualitative analysis. The results show that pentahelix collaboration in the management of tourist villages in Batang Regency involves the integration of five main components: government as facilitator and regulator, local communities as the main drivers, academics contributing through research, the business sector providing capital and expertise, and media playing a role in promotion. The implementation of this collaboration is evident in various tourist village development programs. The main supporting factors include local government commitment, active community participation, academic contributions, business sector investment, and the media's role in promotion. However, there are several obstacles such as lack of coordination between elements, limited human resource capacity, limited access to funding, overlapping regulations, environmental sustainability challenges, and resistance to change.

Abstract

The development of technology in the era of industrial revolution 4.0 is very rapid. These developments triggered developments in all sectors, one of the most affected by the industrial revolution 4.0 was the trade sector. In the current era of 4.0, trade has begun to develop from conventional trading that is trading through physical markets or more often we are familiar with supermarkets, malls, mini markets, and so forth to trade through online markets or more commonly known as E-Commerce. This is a fresh wind for consumers because with the switch of trade through E-commerce, a myriad of conveniences offered by the E-commerce. The conveniences include that consumer do not need to leave the house to buy an item, or in other words a trade transaction can be done anywhere without having to spend special time to travel to a store or shopping center. Not only positive things and conveniences caused by this development, but a myriad of problems that nowadays often occur in online buying and selling activities. Starting from goods that do not match the description or information provided by businesses to the delay of goods that have been promised by businesses, to other problems that essentially harm the consumer.

Abstract

Standard agreements or standard agreements aim to provide convenience or practicality for the parties in conducting transactions, especially in the business sector. Problems will arise when consumers in electronic business transactions face standard agreement formulas in which many standard clauses require consumers to agree. In practice, currently, no e-commerce platform does not use standard agreement formats and clauses in transactions with consumers. This form of the agreement positions the consumer as a party that has no bargaining power, so whatever the contents of the standard agreement are, inevitably must be agreed upon, even though basically the consumer knows that the contents of the agreement are burdensome to him. The problem under study is how is the legal protection of consumers involved in standard agreements with the exoneration clause in a business transaction through electronic media (e-commerce). The research method used is a normative legal research method with a statute approach, a conceptual approach, and the views of experts related to the problem. The results of the study show that standard contracts containing exoneration clauses have legal consequences for consumers, namely the responsibility that should be borne by business actors becomes the responsibility of consumers. The Consumer Protection Law requires business actors to immediately adjust the standard contracts used with the provisions of the law, but in practice, this is difficult to do.
