Abstract

The criminal act of corruption is an extraordinary crime, which can cause widespread damage to society, as stated in the preamble of the United Nations Convention Against Corruption (UNCAC). Corruption is a type of economic crime, where the losses suffered from this crime are related to the economy. This research is a doctrinal research using normative juridical method, as well as analytical descriptive. This study has two formulations of the problem, namely: first, what are the implications of corruption crimes on people's welfare?; Second, what is the role of the community in eradicating corruption? This research shows that: first, corruption crimes can greatly reduce the quality of people's lives, so that the eradication of corruption needs to be more enforced; secondly, much of the corruption that occurs in Indonesia is caused by a lack of social control, so that the role of society in eradicating corruption needs to be maximized as a means of controlling power.

Abstract

Pengujian formil dan materiil terhadap Undang-Undang Nomor 19 tahun 2019 tentang perubahan kedua atas Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi (UU KPK 2019), merupakan babak baru bagi kelembagaan KPK. Pengujian formil atas undang-undang KPK, juga merupakan tantangan tersendiri bagi Mahkamah Konstitusi untuk dapat mewujudkan keadilan substantif, dan kemajuan hukum progresif. Tujuan Penelitian ini adalah untuk meninjau ulang paradigma pengujian formil dalam Mahkamah Konstitusi, serta mengukur pengaruh keberlakuan UU KPK 2019, terhadap inefektifitas pemberantasan korupsi di masa depan. Dalam penelitian ini, akan menggunakan metode pendekatan yuridis normatif, dengan menghadirkandan analisa terhadap putusan Mahkamah Konstitusi, melakukan pendekatan secara konseptual perundang-undangan, serta aspek aspek non-hukum berupa asas-asas hukum, dan teori-teori pembentukan peraturan perundang-undangan, ataupun berkenaan dengan paradigma penerapan hukum oleh Mahkamah Konstitusi dalam pengujian formil. Bahan hukum yang digunakan dalam penelitian ini, adalah bahan hukum primer , berupa undang-undang, peraturan Mahkamah Konstitusi, serta peraturan terkait lainnya, dan bahan hukum sekunder berupa karya tulis ilmiah (jurnal, artikel dsb), dan thesis. Penelitian ini menunjukkan, bahwa pengujian formil di Mahkamah Konstitusi perlu mempertimbangkan keseluruhan asas-asas dalam pembentukan peraturan perundang-undangan. Selain itu, pasca putusan pengujian formil terhadap undang-undang KPK, kelembagaan KPK masuk dalam rumpun eksekutif, walaupun dalam pelaksanaan tugas dan kewenangannya, KPK tetap tidak dapat diintervensi oleh cabang kekuasaan manapun. Namun, Konsepsi Independen tersebut, perlu ditinjau ulang, karena KPK memiliki sifat costitutionale importance, sehingga tidak layak dimasukkan dalam cabang kekuasaan eksekutif.Kata Kunci: Mahkamah Konstitusi; Pengujian Formil; Komisi Pemberantasan Korupsi.The formal and material review of Law Number 19 of 2019 regarding the second amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission (KPK Law 2019), is a new chapter for the KPK institution. The formal review of the KPK law is also a challenge for the Constitutional Court to be able to realize substantive justice and progressive legal progress. The purpose of this study is to review the paradigm of formal review in the Constitutional Court, as well as to measure the effect of the 2019 KPK Law enforcement on the ineffectiveness of eradicating corruption in the future. In this study, will use a normative juridical approach, by presenting and analyzing the decisions of the Constitutional Court, taking a conceptual approach to legislation, as well as non-legal aspects in the form of legal principles, and theories for the formation of laws and regulations, or regarding the paradigm of the application of law by the Constitutional Court in the formal review. The legal materials used in this study are primary legal materials, in the form of laws, regulations of the Constitutional Court, and other related regulations, and secondary legal materials in the form of scientific papers (journals, articles, etc.), and theses. This study shows that the formal examination in the Constitutional Court needs to consider all the principles in the formation of legislation. In addition, after the decision on the formal review of the KPK law, the KPK institution is included in the executive family, although in carrying out its duties and authorities, the KPK cannot be intervened by any branch of power. However, the Independent Conception needs to be reviewed, because the KPK has constitutional importance, so it is not worthy to be included in the executive branch of power.Keywords: Constitutional Court; Formal Review; Corruption Eradication Commission.

Abstract

The dismissal of Constitutional Court Justice Aswanto and the appointment of Guntur Hamzah as his replacement by the DPR, ratified by the President, have sparked public outcry over alleged violations of the Constitutional Court’s (MK) independence. This study aims to analyze the phenomenon of democratic regression and the erosion of MK’s independence resulting from the replacement of Constitutional Court Justices in violation of the Constitutional Court Law. The study addresses two main research questions: First, how does the non-procedural replacement of Constitutional Court Justices contribute to democratic regression? Second, what are the implications of such non-procedural actions by the DPR on the independence of the Constitutional Court? This research employs a doctrinal legal method, analyzing relevant regulations and literature. The findings reveal that, first, the non-procedural replacement of Constitutional Court Justices constitutes a symptom of constitutional backsliding that poses significant risks to democratic governance. Second, the independence of the MK’s judicial authority has been increasingly marginalized due to the non-procedural dismissal and appointment of Constitutional Court Justices, ultimately distorting the principle of checks and balances.

Abstract

Permasalahan obesitas regulasi, merupakan permasalahan kompleks dalam kondisi perundang-undangan di Indonesia, yang tidak hanya dapat mengganggu iklim investasi, namun berimbas pula pada efektivitas regulasi, serta ketidak sinkronan hingga tumpang tindih aturan di dalamnya. Banyaknya regulasi yang tumpang tindih, saling bertentangan satu sama lainnya dalam relasi hirarki vertikal maupun horizontal, hingga rendahnya kualitas regulasi yang ada, merupakan permasalahan yang masih belum menemukan titik penyelesaian. Gagasan pembentukan badan regulasi nasional diharapkan dapat mampu menjawab tantangan penataan regulasi tersebut. Dari beberapa permasalahan tersebut, penelitian ini setidaknya memiliki dua rumusan masalah, yaitu: (1) Bagaimanakah desain ideal dari kelembagaan khusus bidang legislasi? (2) Bagaimanakah mekanisme peninjauan dan pemantauan peraturan perundang-undangan yang memenuhi unsur partisipatif, akuntabel, dan progresif? Metodologi yang digunakan dalam penelitian ini, akan menggunakan metode analisa yuridis normatif, dengan pendekatan konseptual, serta menghadirkan analisa dengan kajian doktrinal. Penelitian ini menunjukkan bahwa Lahirnya Undang-Undang 15 tahun 2019, yang mengamanatkan pembentukan badan regulasi nasional merupakan peluang untuk menjawab tantangan penataan regulasi agar dapat lebih tersinkronisasi dan harmonisasi, serta mendukung efektivitas dari kegiatan legislasi yang dilakukan oleh pemerintah di bawah komando presiden.
