Abstract

Banjarmasin City, as the city center in South Kalimantan Province, faces a serious threat from fire risk. Its geographical and climatic conditions make it vulnerable to catastrophic fires, especially during the dry season. In an effort to overcome this challenge, the city government has taken strategic steps in the form of Banjarmasin City Regional Regulation No. 13 of 2008 concerning Fire Hazard Prevention and Control, and established the Fire and Rescue Service (Damkar) in 2022. This research uses socio-legal research methods that combine normative and sociological approaches. Qualitative analysis methods are used to explore deep insights into normative aspects related to fire disaster prevention and management. This interdisciplinary approach allows for a more holistic understanding of the issue, involving both legal and social aspects. Fire disasters not only threaten residential areas, but also vacant land. Therefore, fire prevention and suppression must be carried out effectively and efficiently. Protection against fire hazards includes the use of extinguishing equipment such as sprinklers, fire hydrants, and detectors, as well as building design planning that minimizes fire risk. However, more important are prevention efforts that include education, evacuation, and early handling when a fire occurs. The importance of legal protection for the community in dealing with fire risk is the main focus. This is reflected in the local regulations formed and the improvement efforts made. The role of Damkar in fire disaster management became central, and the meeting between the Regional Government and the Self-Help Fire Brigade Front (BPK) became a strategic step in coordinating these efforts. The revision of Banjarmasin City Regional Regulation No. 13 of 2008 and Banjarmasin Regional Regulation No. 23 of 2012 are concrete efforts in perfecting the legal framework governing fire disaster prevention and management. Thus, the city government strives to protect its people through effective and efficient measures, and encourages active participation from various parties in maintaining mutual safety and welfare

Abstract

This article explores the resolution of the criminal act of vandalism through a restorative justice approach. Under Indonesian criminal law, vandalism is regulated in Article 406 of the Criminal Code with a maximum prison sentence of two years and eight months. However, the retributive approach is considered less effective in achieving substantive justice as it focuses solely on punishing the offender. This study employs a normative legal method with statutory, conceptual, and comparative approaches to examine the urgency of implementing restorative justice in resolving vandalism cases. The findings indicate that restorative justice offers a more humane approach by prioritizing the restoration of relationships between offenders and victims through mediation and mutual agreement. This approach aligns with local cultural values such as deliberation and contributes to reducing the burden on judicial and correctional institutions. Moreover, restorative justice provides a fairer and more efficient resolution, strengthening community involvement in legal enforcement. Therefore, this approach is relevant for application in vandalism cases that meet the established criteria, as a means to achieve balanced justice and restore the condition of all parties involved. Abstract

Violence in healthcare is a serious and increasing phenomenon, occurring in physical, verbal, and psychological forms, perpetrated by patients, their families, and others. This violence not only negatively impacts healthcare workers in the form of trauma, stress, decreased work motivation, and psychological disorders, but also impacts the quality of care and patient safety. This study uses a normative juridical method with a legislative approach through a literature review to examine the forms of violence, causal factors, impacts, and the effectiveness of legal protection for healthcare workers. The results show that although regulations related to the protection of healthcare workers are available, such as Law Number 36 of 2014 concerning Healthcare Workers and Law Number 17 of 2023 concerning Health, implementation in the field still faces obstacles, including weak law enforcement, minimal outreach, and limited security systems in healthcare facilities. Therefore, legal protection does not stop at providing regulations but must be realized through concrete actions, such as strengthening security, providing complaint channels, legal assistance, and educating the public about patient rights and obligations. With these steps, legal protection for healthcare workers can be implemented more effectively, creating a safe and conducive work environment that supports improved healthcare quality.
