Abstract

Abstract: Polygamy is one of the problem in the marriage of the most discussed widely and controversial. One side of polygamy is rejected with a variety of arguments between normative, psychological, even always associated with gender injustice-as revealed by gender activists or activists of women. In fact, Western writers often claim that polygamy is evidence that the teaching of Islam in the areas of marriage is very discriminatory against women. On the other side, polygamy campaigned as it is considered as one alternative to resolve the phenomenon of cheating and prostitution. Whatever the reasons said, clearly polygamy is a religion shari'ah presence clearly in the Qur'an, regardless of how this verse applied. The issue is under what conditions and by whom this polygamy shari'ah can be implemented. This paper attempts to examines polygamy on one side of the impact on social solution, on the other side can be regarded as sexual tourism which is conducted the husband, and could also both reasons join simultaneously. Furthermore, the authors discuss polygamy with analysis knife of Islamic Law, Law No. 1 of 1974, and KHI (Positive Law). Not only that, the authors also attempt to align polygamy study it with a knife of analysis the theory of phenomenology in sociology. Keywords: polygamy, Islamic Law, Positive Law, Phenomenology.

Abstract

Artikel ini menganalisis tentang pemikiran al-Ghazālī, terkhusus pada pembahasan pemilahan ulama dan pengelompokan ilmu yang dia tawarkan dalam kitab Ihyā’ Ulūm al-Dīn. Sebagai ilmuwan muslim, al-Ghazālī mampu menyajikan pembahasan ini secara menarik dan mendalam. Dia menyatakan dalam karyanya, bahwaulama terbagi menjadi dua. Pertama, ulama bertopeng (al-sū’) dan yang kedua, adalah ulama yang benarbenar ulama (akhirat). Begitu juga dengan ilmu, al-Ghazālī membagi ilmu secara global pada dua hal, yakni ilmu yang fardu ‘ain dan fardu kifāyah. Sebagai ulama yang ahli dalam segala bidang keilmuan yang padaakhirnya menekuni bidang ilmu tasawwuf, terlihat sekali betapa dia menyajikan kitab Ihyā’ Ulūm al-Dīn dengan nuansa khas sufistik, tidak terkesan menggurui dan selalu menarik dibaca, terutama bagi pecinta dunia tasawwuf. Kitab Ihyā’ Ulūm al-Dīn terbagi dalam empat bagian. Pertama, Seperempat tentang Ibadah. Kedua, Seperempat tentang kebiasaan. Ketiga, Seperempat tentang kebinasaan. Keempat, Seperempat tentang rahasia/perasaan. Meskipun demikian, tidak menutup kemungkinan dalam karya tersebut,bagi kalangan insider maupun outsider untuk melakukan elaborasi lebih lanjut maupun beragam kegiatan intelektual yanglain, demi penyajian karya yang lebih menarik lagi di masa kini dan mendatang.Kata Kunci: al-Ghazālī , Ulama, Ilmu, Ihyā’ Ulūm al-Dīn

Abstract

Pernikahan merupakan salah satu perintah agama bagi yang memenuhi syarat untuk melakukannya, akan tetapi di Desa Kramat Kecamatan Bungah Kabupaten Gresik terdapat suatu tradisi yang harus dilakukan sebelum akad pernikahan yaitu tradisi kirab pendopo, di mana sebelum akad pernikahan harus mengelilingi pendopo sebanyak tiga kali dengan membawa makanan tradisional seperti, tetel, jadah, pisang, dan lain-lain. Adapun hasil penelitian ini ialah: pertama, tradisi kirab pendopo pranikah sudah lama dilakukan sejak zaman leluhur. Leluhur zaman dahulu jika hendak melakukan sesuatu yang sifatnya sakral seperti pernikahan harus meminta izin terlebih dahulu ke pendopo dengan melakukan kirab pendopo dan ini dirawat hingga saat ini. Kedua, hasil wawancara penulis dengan tokoh agama, tokoh adat, pelaku adat, dan beberapa masyarakat umum bahwa dalam hasil wawancara tidak ada perbedaan pendapat mengenai tradisi kirab pendopo pranikah yang ada di Desa Kramat, semua berpendapat bahwa masyarakat Desa Kramat mempercayai bahwa sebelum melaksanakan pernikahan harus melakukan kirab pendopo terlebih dahulu dan apabila tidak melakukan dapat mengakibatkan dampak buruk seperti keluarga tidak harmonis hingga menimbulkan perceraian. Apabila tradisi ini dihubungkan dengan teori fungsionalisme struktural, maka dapat dipahami terdapat aspek Adaption, yang bermakna penyesuaian dengan tradisi. Goal, bermakna memahami tujuan dari tradisi. Intregation, proses mendialogkan tradisi dan Latency, bermakna melakukan sosialisasi terhadap tradisi. Tradisi kirab pendopo tersebut dapat dipertahankan karena sesuai dengan ajaran Islam sebagaimana dikuatkan dalam kaidah fikih al-‘adah muhakkamah dan isti’mal al-nas hujjah yajibu al-‘amal biha.

Abstract

This paper analyzes al-Ghazālī’s thoughts, especially in the discussion of the categorization of scholars and the groupings of knowledge which he offers in the book Ihyā ‘Ulūm al-Dīn. As a scientist of Islamic Studies, alGhazālī was able to present this discussion in an interesting and profound way. He stated in his creation that scholars are divided into two. First is the counterfeit ulama called al-sū’. The second is the ulama who is true (hereafter). Likewise with science, al-Ghazālī divides knowledge globally into two things, namely knowledge that is fardu ‘ain and fardu kifayah. As an ulama who is an expert in all scientific fields who eventually pursues the field of Sufism, it can be seen how much he presents the book Ihyā ‘Ulūm al-Dīn with a distinctively Sufistic nuance. It does not seem patronizing and always interesting to read, especially for lovers of the world of Sufism. The Ihyā ‘Ulūm al-Dīn is divided into four parts. First, a quarter about Worship. Second, a quarter about habits. Third, a quarter about destruction. Fourth, a quarter about secrets/feelings. Even so, it does not rule out the possibility in this work, for insiders and outsiders to carry out further elaboration and various other intellectual activities, in order to present a more interesting work in the present and future.

Abstract

 Polygamy has been a problem with pros and cons until now. This also includes permission for polygamy carried out by the husband for reason of high sexual desire or hypersexuality, which causes the husband to take permission for polygamy to the Religious Court. This is what happened in the Kediri Regency Religious Court Number 3826/Pdt.G/2023/PA.Kab.Kdr. This article is library research, qualitative in nature, and uses a conceptual and statutory approach. The results of this research show that the practice of polygamy permit is in accordance with aspects of legal justice, legal certainty and legal benefit. As for maqasid al-shari'ah, if it is related to the case of polygamy permit, it can be understood that, First, legal texts and rules are not separate from their purpose. In Islam, there is a rule that polygamy is limited to four wives, the purpose of which is to worship Allah and form a harmonious family and must fulfill the positive legal aspects, namely permission from the first wife. Second, combine universal principles with arguments used for specific cases. In this case, even though there is a text about polygamy, it still requires permission from the first wife, and is connected to the principle of hifz al-usrah which contains hifz al-din, hifz al-al-'aql, hifz al-nasl, and hifz al-mal. All these principles emphasize the teachings of Islam rahmatan lil 'alamin. Third, achieving benefits and preventing harm. Therefore, polygamy must be accompanied by permission from the first wife to realize the benefits and the building of the family must prioritize the benefits aspect and avoid harm. Fourth, consider the final result. In this case, the implication of the husband's actions, if the impact is that the family structure is not harmonious, it is better for the husband to marry only one wife. So that the goals of marriage can be achieved. This is in accordance with the purposefulness feature conveyed by Jasser Auda.

Abstract

Abstract: This article explains the role of tertiary education in Islamic banking in Indonesia with a review of maqa>s}id al-mu'a>mala>t. As known, the development of Islamic banking is still being pursued today. Accordingly, the public's need for an understanding of Islamic banking and the need for experts in the field of Islamic banking cannot be denied. Therefore, it requires experts who have graduated from the Islamic banking study program from universities, including the Kediri State Islamic Institute, to answer this challenge. The contribution of higher education in the Islamic banking study program to produce excellent graduates is an important thing that must be realized. Islamic banking education, when viewed by maqa>s}id al-mu'a>mala>t, it is known that real certainty is manifested, such as a comprehensive understanding of Islamic banking in terms of compliance with Islamic banking principles which includes compliance with the principles of Islamic banking. Sharia principles, prudential provisions, increased operational efficiency which will have an impact on high competitiveness and stability of the Islamic banking system as well as benefits to the economy. There is also a universal dimension, namely the general benefit between the government, Islamic financial institutions and the public. Keywords: Education, Islamic Bank, Maqa>s}id al-Mu'a>mala>t. Abstrak: Artikel ini menerangkan peran pendidikan perguruan tinggi dalam perbankan syariah di Indonesia dengan tinjaun maqa>s}id al-mu’a>mala>t. Seperti diketahui, pengembangan perbankan syariah masih diupayakan sampai saat ini. Sesuai dengan itu, kebutuhan masyarakat terhadap pemahaman perbankan syariah serta kebutuhan tenaga ahli di bidang perbankan syariah tidak dapat dipungkiri. Oleh sebab itu, butuh tenaga ahli lulusan program studi perbankan syariah dari perguruan tinggi, termasuk Institut Agama Islam Negeri Kediri, untuk menjawab tantangan ini. Kontribusi pendidikan tinggi program studi perbankan syariah untuk melahirkan sarjana-sarjana yang unggul, merupakan hal penting yang harus direalisasikan. Pendidikan perbankan syariah, apabila ditinjau dengan maqa>s}id al-mu’a>mala>t, maka diketahui, terwujud kepastian yang nyata, seperti pemahaman yang menyeluruh tentang perbankan syariah dalam hal kepatuhan pada prinsip perbankan syariah yang meliputi kepatuhan pada prinsip-prinsip syariah, ketentuan kehati-hatian, peningkatan efisiensi operasional yang berdampak pada daya saing yang tinggi dan stabilitas sistem perbankan syariah serta kemanfaatan bagi perekonomian. Terwujud juga dimensi universal, yakni kemaslahatan umum antara pemerintah, lembaga keuangan syariah dan masyarakat. Kata Kunci: Pendidikan, Bank Syariah, Maqa>s}id al-Mu’a>mala>t.

Abstract

This article aims to strengthen the ideology of Pancasila and to answer the fundamental problems of the state which are being debated between the secular state, the religious state, and the state of mutualist symbiosis with the ideology of Pancasila, which in this article is discussed with the Pancasila state. This article explains the Pancasila state by examining concepts, state philosophy, paradigm, existence, guidelines, and relevance to maqasid al-shari'ah Jamal al-Din 'Atiyyah. The type of research used is library research with qualitative analysis techniques and a conceptual approach. The research results state that the Pancasila state concept is a prismatic concept built between a religious and secular state, individualism and collectivism, and civil law and common law. Pancasila is a state philosophy that contains common interests and originates from political agreement. The Pancasila State is a legal paradigm and its development. In the realm of existence, Pancasila emphasizes the relationship between religion and the state. For this reason, there are four guiding principles of national law; firstly, all laws must guarantee the nation's integration. Secondly, laws must be created democratically and nomocratically based on the wisdom of wisdom; thirdly, laws must encourage the creation of social justice; and fourthly, there must not be public laws based on certain religious teachings. The Pancasila state was created to create a harmonious life in diversity because Pancasila is a way of life that promotes mutual harmony. Meanwhile, the relevance of Jamal al-Din 'Atiyyah's maqasid al-shari'ah is related because it contains maqasid personalmukallaf, maqasid al-ummah (national goals), and maqasid al-insanity (humanitarian goals).
