Abstract

AbstrakTransaksi jual beli online sudah menjadi bagian dari perkembangan teknologi dan transaksi bisnis di Indonesia, apalagi di tengah pandemic covid 19, transaksi online menjadi sebuah kebutuhan, karena anjuran di rumah dan menghindari kerumunan. Transaksi jual beli yang salah satunya berbentuk marketplace memudahkan orang berbelanja kebutuhannya tanpa harus keluar rumah. Maeketplace tempat dimana orang dapat melakukan transaksi jual beli online meski membantu memudahkan konsumen, namun ada juga yang merasa di rugikan dengan layanan jual beli online ini oleh karena itu penelitian ini bertujuan untuk menghasilkan pembahasan mengenai hak hak konsumen e Comerce marketplace dan bagaimana penyelesaiannya ketika ada sengketa. Adapun metode penelitian yang digunakan menggunakan pendekatan Yuridis Normatif. Hasil dan pembahasan penelitian ini Pertama Perlindungan Hak konsumen dijamin oleh UUPK pasal 4, Perlindungan konsumen berasaskan manfaat, keadilan,keseimbangan, keamanan dan keselamatan konsumen, serta kepastian hukum, kedua, penyelesaian sengketa dapat dilakukan dengan dua cara yaitu di Pengadilan dan di Luar pengadilan berdasarkan pasal 47 UUPK

Abstract

This research analyses the implementation of judges' decisions on law enforcement of taxation crimes in Indonesia and identifies ideal criminal law policies to achieve legal certainty. The method used is normative juridical with analytical descriptive approach, which is supported by the theory of judicial power, theory of legal certainty, and theory of law enforcement. The results show that the ultimum remedium principle has not been fully applied consistently, with some serious tax offences going directly to the criminal realm even though administrative mechanisms are still possible. Conversely, some other offences are resolved administratively, even though the criminal elements have been fulfilled. This inconsistency suggests the need for uniform technical guidelines to reduce differences in legal interpretation. This research is an integration of restorative justice principles in Indonesian tax law, which allows offenders to settle tax liabilities along with penalties before being subject to criminal sanctions. This approach balances the recovery of state losses and the deterrent effect for offenders, while supporting sustainable taxpayer compliance. This research recommends the preparation of pretrial guidelines and harmonization of regulations to improve legal certainty in tax cases in Indonesia.

Abstract

One of the aspects that play an important and crucial role in the process of national development that is carried out quickly is infrastructure development. In addition, infrastructure also plays an important role in economic growth. To be able to realize this, the performance of employees has an important role. One component of improving employee performance in both government and private institutions is competence. So that it is necessary to develop human resources in order to improve employee performance, one of which is the PUPR Office in Cimahi City. This study aims to find out the effect of competence on performance in the PUPR Office of Cimahi City. In this study, the explanatory research method was used with a sample of 43 people. The analysis technique used is statistical analysis by means of regression, determination, correlation and hypothesis testing. The results of the study show that the competency variable has a positive and significant influence on employee performance with a determination value of 85.7%. The significance of the hypothesis test is 0.000 <0.05..

Abstract

Public services, especially the quality or level of service provided by government employees to the community, is often one of the problems that often arise in public relations with local governments. Service standards that must be offered by the government as a provider of public goods and services have increased. The Cimahi City Population and Civil Registry Office is a local government organization that has the responsibility of making residence documents for various kinds of goods needed by the community. The research objective is to find out the effect of online services by Disdukcapil on community satisfaction. The method used is quantitative with a total of 31 respondents. The analysis technique used statistical analysis through regression, correlation, determination, and hypothesis testing. The results show that online services (X) have a simultaneous effect on community satisfaction (Y). The remaining 14.3% is influenced by other factors that are not present in this study. This shows that the better the online services provided by officials at the Population and Civil Registration Service, the more people's satisfaction will increase.
