Abstract

Perselisihan karena ketidakpatuhan terhadap hak konsumen untuk memperbaiki informasi produk dapat diselesaikan dengan dua cara juga sengketa yang melibatkan produsen yang melanggar UUPK dengan tidak menyampaikan keterangan yang benar perihal produk/jasa yang diproduksi dan dijual. Tujuan penelitian ini adalah untuk mengetahui hak konsumen yang tidak terpenuhi berdasarkan Undang-Undang Perlindungan Konsumen dan bagaimana penyelesaian apabila tidak terpenuhinya hak konsumen. Berdasarkan Undang-Undang Perlindungan Konsumen (UUPK), konsumen berhak mendapat informasi mengenai barang yang diterimanya. Jenis penelitian ini adalah penelitian hukum normatif, yaitu penelitian yang mendeskripsikan, menyelidiki, menjelaskan dan melakukan analisis suatu masalah. Hasil penelitian menunjukkan bahwa apabila suatu sengketa timbul karena pengusaha tidak menyampaikan keterangan yang benar perihal barang yang diproduksi dan dijualnya, konsumen atau kelompok konsumen yang bersangkutan bertanggung jawab atas penyelesaian sengketa antara konsumen dan produsen dapat dituntut melalui lembaga yang ditugaskan untuk menyelesaikannya.

Abstract

Protection of cultural heritage in Indonesia is regulated in Law no. 11 of 2010 concerning Cultural Heritage. Violations in the form of destroying cultural heritage can be subject to serious criminal sanctions. One example of a protected cultural heritage is Fort Putri Hijau, with various protection efforts by the government such as restoration, monitoring and outreach, in order to preserve this historic site as the nation's cultural heritage.

Abstract

One sector that helps a country's economic growth is banking. The types of guarantee institutions as they are known in the Indonesian legal system, can be classified according to the way they occur, according to their nature, according to their objects, according to the authority to control them. Initially, Indonesian banks preferred the conventional banking system to a banking system based on Islamic sharia. With the establishment of Bank Muamalat Indonesia in 1991, which was the first bank based on Islamic sharia. In addition, the enactment of Law Number 21 of 2008 concerning Sharia Banking shows a strong commitment to the development of Islamic banking. Article 19 paragraph (1) of the Law regulates business activities carried out by Islamic banks, including sharia contracts such as mudharabah, murabahah, ijarah, kafalah, and others. In sharia bank guarantee products, kafalah is a contract, if there is a default, execution will be carried out on the object of the guarantee, execution is an attempt by a party won in a decision to obtain what is rightfully entitled to him with the help of legal force.  Therefore, this study uses a statute approach and conceptual approach where there are rules regarding kafalah in Islamic banks which will then be seen as appropriate or not with what has been applied in Islamic banks in Indonesia.

Abstract

The aim of this research is to provide protection to children who become child labourers. Child protection is all activities to ensure and protect children and their rights so that they can live, grow and develop. In fact, many children are found in various countries as workers or laborers. Therefore the United Nations (UNICEF) and ILO (International Labor Organization) organizations on child labor issued policies on child labour. The ILO has issued legal instruments in the form of conventions which are then ratified in every country to become regulations. The ILO convention aims to completely eliminate all forms of child labour, although this is very difficult to do given the current conditions. Islamic law does not explicitly explain the employment of minors, but Islam provides special protection for children so that they do not lose their rights. Based on the background above, the problem arises how international law efforts to protect child labor and what is the view of Islamic law on child labour. The research method used is normative juridical, namely conducting library research by examining library materials or secondary data as a basis for research by conducting a search of regulations or conventions and literature related to the problem under study.

Abstract

Setiap perjanjian termasuk perjanjian pinjam uang harus dilaksanakan dengan itikad baik sebagaimna yang ditetapkan dalam Pasal 1338 ayat (3) KUHPerdata. Itikad baik memiliki kedudukan dan peran penting dalam suatu perjanjian. Hal ini berdasarkan atas pemikiran bahwa apabila suatu perjanjian dilandasi oleh Itikad baik, maka dapat dipastikan perjanjian yang telah disepakati tidak menimbulkan permasalahan hukum seperti terjadinya wanprestasi. Abstract

This study examines the implementation of the Pacta Sunt Servanda principle in online buying and selling, specifically focusing on transactions using the Cash on Delivery (COD) system. The study emphasizes the importance of adhering to this principle to ensure that neither party is harmed in the transaction. However, it highlights that many sellers face disadvantages when buyers unilaterally terminate the agreement by refusing payment in COD transactions. The principle of pacta sunt servanda, which is binding and requires parties to comply with the agreed-upon terms, serves as the basis for the sale and purchase agreement and aims to minimize losses for buyers. The study concludes that Indonesian positive law regulates online transactions using the COD system and outlines legal consequences for buyers who do not follow the procedures, such as account blocking and reimbursement of costs and losses. Additionally, sellers are encouraged to seek legal protection and demand fulfillment of the buyer's obligations through legal action such as compensation claims.   Penelitian ini mengkaji implementasi asas Pacta Sunt Servanda dalam jual beli online, secara khusus berfokus pada transaksi yang menggunakan sistem Cash on Delivery (COD). Studi ini menekankan pentingnya mematuhi prinsip ini untuk memastikan bahwa tidak ada pihak yang dirugikan dalam transaksi. Namun, studi ini menyoroti bahwa banyak penjual yang dirugikan ketika pembeli secara sepihak mengakhiri perjanjian dengan menolak pembayaran dalam transaksi COD. Asas pacta sunt servanda, yang mengikat dan mengharuskan para pihak untuk mematuhi persyaratan yang telah disepakati, menjadi dasar perjanjian jual beli dan bertujuan untuk meminimalkan kerugian bagi pembeli. Studi ini menyimpulkan bahwa hukum positif Indonesia mengatur transaksi online dengan sistem COD dan menguraikan konsekuensi hukum bagi pembeli yang tidak mengikuti prosedur, seperti pemblokiran akun dan penggantian biaya dan kerugian. Selain itu, penjual didorong untuk mencari perlindungan hukum dan menuntut pemenuhan kewajiban pembeli melalui upaya hukum seperti tuntutan ganti rugi.

Abstract

The role of notaries in the legal system in Indonesia is very significant, especially in supporting legal certainty in the Islamic banking sector through the Murabahah financing contract. This contract is based on the principle of buying and selling with agreed profits, so it requires a notary to prepare documents that comply with positive law and sharia principles. Notaries are authorized to make authentic deeds, provide legal counseling, and ensure the validity of each element of the agreement, including payment clauses, profits, and fines. In this case, notaries act as legal guardians who guarantee transparency and justice, prevent potential violations of law such as usury practices, and reduce the risk of future disputes. This study uses a normative legal approach by examining related legislation, such as Law No. 2 of 2014 concerning the Position of Notaries and Islamic Banking Law. The study results show that notaries have a dual role: as legal enforcers who ensure that documents meet legal requirements and as law enforcers who maintain the integrity of the transaction process. With the increasing need for Sharia financing, the existence of notaries is becoming increasingly relevant to support equitable Sharia-based economic development. In conclusion, notaries are a key element in Murabahah transactions that not only function administratively but also substantively, helping to create a transparent and trusted financial system in Indonesia. This strengthens the position of notaries as an important pillar in ensuring the sustainability of Sharia-based law and economy.

Abstract

The purpose of this writing is to discuss social inequalities that often occur in the health sphere, where the presence of the BPJS Kesehatan program is expected to provide good health services regardless of economic and social status, but in its implementation there are still often non-fulfillment of the rights of people who use BPJS Kesehatan. , even though Health BPJS is issued by the government to obtain health insurance as stipulated and contained in the Law of the Republic of Indonesia No. 40 of 2004 concerning the National Social Security System, it is organized nationally based on social insurance principles and equity principles with the aim of ensuring that participants or patients receive health care benefits and protection in meeting health needs. In principle, legal protection for BPJS Health participants is in accordance with the laws and regulations related to the BPJS Health program, but the implementation of legal protection is still ineffective. Analyzing the service problems in BPJS Health is still not providing good service to participants as BPJS Health patients. Keywords: legal protection, BPJS patients, services

Abstract

Issues regarding compensation for flight cancellations during a pandemic must be resolved is a concern of the government as a policy maker and airlines as a responsible party according to laws and international conventions concerning air transportation, one of which is the Aviation Law and the Consumer Protection Law. Covid-19 are causing problems regarding the form of cash compensation which was replaced with a voucher and the return procedure which was considered to be many times longer and even threatened that no compensation would be given. Therefore, the author analyzes to find out the factors that cause these problems and how airline responsibility and consumer protection should be in terms of laws and regulations. In addition, there was a significant spike at one time in requests for cancellation and the following Government Regulation No. 25 of 2020, which abolished the cash refund policy, turned out to be one of the factors in the increasing number of consumer complaints about compensation issues and has clearly contrary to the laws and regulations.

Abstract

Salah satu bagian dari transformasi digital dalam layanan kepemilikan tanah adalah penerapan sertifikat tanah elektronik, yang bertujuan untuk mengurangi kesalahan manusia, perselisihan, dan tumpang tindih data. Meskipun sistem ini mudah diakses, aman, dan efisien dalam pengelolaan tanah, implementasi sistem ini menghadapi masalah dengan akses teknologi. Ini menjadi masalah terutama bagi orang-orang yang tinggal di daerah dengan akses internet yang terbatas. Selain itu, masalah teknis dan ketidaksesuaian data saat ini memperlambat proses verifikasi. Perspektif Notaris/PPAT menunjukkan bahwa meskipun sistem ini dapat mempercepat transaksi, pembenahan dan pelatihan diperlukan karena masalah teknis dan kurangnya pemahaman pihak terkait. Metode yang dipakai dalam penelitian ini dengan cara mengkaji ketentuan umum yang berlaku dan melihat apa yang terjadi di lapangan. Dalam Penerapan Sertifikat Tanah Elektronik di Kabupaten Langkat, peningkatan sistem teknologi dan pembaruan undang-undang sebaiknya lebih komprehensif hal ini merupakan langkah penting untuk menjamin bahwa penerapan sertifikat tanah elektronik di Indonesia akan berjalan dengan baik dan aman.
