Abstract

This study describes a discussion about the existence of khiyar's position in the development of buying and selling transactions. By using a descriptive method that is literature in nature, this study found the fact that the position of the existence of the khiyar concept was inseparable from the position of the existence of buying and selling transactions that had developed as the main contract. Its position is relative. That is, it is still enforced by some economic actors and is also eliminated because it creates uncertainty. As for what needs to be considered is the concept of khiyar as a complementary requirement. So that without the concept of khiyar in a transaction it will not damage the validity of the transaction. However, its existence is the best way to make the contract more legitimate and ideal along with achieving a level of benefit for the parties who carry it out.

Abstract

This study aims to examine and formulate a development model for the Merah Putih Cooperative based on sharia economics that is effective in improving the welfare of rural communities. In the context of increasing economic inequality and weak access for rural communities to fair and inclusive financial institutions, cooperatives based on sharia values ​​are a strategic alternative in realizing economic justice and empowering local communities. The research method used is library research with a qualitative approach. Data analysis techniques include data reduction, data presentation, and drawing conclusions. The results of the study indicate that the development of the Merah Putih Cooperative needs to be directed at sharia principles such as justice, deliberation, profit sharing, and the prohibition of usury, and strengthened by member education, collaboration between communities, and support from state policies. This model is not only able to strengthen the resilience of the village economy through the real sector and MSMEs, but also form a more independent, inclusive, and sustainable local economic order in accordance with Islamic values.

Abstract

This research is motivated by the concept of wages originating from ijarah contracts more widely used in Islamic Economic Institutions than wages derived from ju'alah contracts. While the two contracts are contracts that cause the provision of wages. Therefore, this study will describe the application of the concept of wages to ijarah and ju'alah contracts at the Islamic Economic Institution. This research is a secondary research with a literature study method whose data comes from various literatures through a normative juridical approach. This research is a type of qualitative research with technical data analysis through three stages, namely reducing data, presenting data and drawing conclusions. The results of this study reveal the fact that the concept of wages that is widely used in Islamic economic institutions is wages derived from ijarah contracts. This is because the legal consequences that have the concept of justice are that wages are based on the amount and results that have been completed, rather than wages derived from the ju'alah contract which will be given when a job can be completed perfectly. Therefore, the concept of wages is more identical to the ijarah contract for service benefits, so that there is a development of the meaning of ujrah in the form of wages and rental prices in accordance with the object of the contract exchanged in the ijarah contract.
