Abstract

This research aimed to explain the effectiveness of legal protection for medical personnel, specifically in implementing Occupational Health and Safety (OHS) during COVID-19 period. The number of cases in Indonesia certainly affected the implementation of OHS for medical personnel. The initial year of the pandemic experienced various challenges concerning the availability of medical personnel, instruments, and components crucial for supporting the implementation of OHS protocols, as well as the overall condition of COVID-19. OHS accommodation for medical personnel was listed in various laws and regulations in Indonesia. Socio-legal research methods were used to deliver a detailed investigation into the legal landscape of the laws and regulations governing the implementation of OHS. The results showed that the efficacy of the implementation and adherence to 'das Sollen' and 'das Sein' legal stipulations was considered regarding the integration of OHS in conformity with legal regulations. Therefore, there is a need for synergy among the government, hospitals, healthcare workers, and relevant parties to ensure the implementation of OHS protection for medical personnel and the potential new mutated viruses in Indonesia.

Abstract

Jurnal yang berjudul “Pemenuhan hak dan kesempatan kerja pada pekerja yang mengalami disabilitas fisik akibat kecelakaan kerja” ini menguraikan mengenai permasalahan tidak terpenuhinya perlindungan dan hak pekerja yang mengalami disabilitas fisik yang diakibatkan karena kecelakaan kerja yang dialami dilingkungan kerja. Hal ini dibuktikan dengan adanya pemutusan hubungan kerja sepihak yang dilakukan oleh suatu perusahaan diakibatkan karena adanya cacat fisik atau penyakit yang memiliki efek berkepanjangan, dimana atas adanya hal ini seorang pekerja dianggap tidak lagi akan bekerja secara baik dan mengganggu produktivitas perusahaan. Dewasa ini dengan adanya perkembangan kebutuhan kerja dan perkembangan perusahaan menyebabkan pekerja dihadapkan dengan adanya berbagai tuntutan kerja yang sangat tinggi, sehingga para pekerja diharuskan berhadapan langsung dengan berbagai resiko kerja yang besar serta tuntutan produktivitas dan efektivitas yang tinggi. Sebagai konsekuensinya perlindungan pada pekerja menjadi hal yang dikesampingkan oleh perusahaan, diantaranya yaitu kesempatan kerja bagi para pekerja yang memiliki disabilitas fisik yang tidak terpenuhi. Hal ini tentu menjadi perhatian masyarakat berkaitan dengan kesejahteraan kehidupan pekerja yang mengalami cacat fisik akibat kecelakaan kerja. Dalam penelitian ini penulis menggunakan metode penelitian hukum sosio-legal. Hasil akhir dari penelitian ini yaitu kajian mengenai regulasi perlindungan pekerja yang terkena pemutusan hubungan kerja akibat disabilitas fisik karena kecelakaan kerja, pelaksanaan kebijakan pemerintah yang didasarkan seperti dalam Pasal 150 sampai Pasal 172 Undang-Undang Nomor 13 tahun 2003 dan rekomendasi bagi pemerintah serta evaluasi pada pelaksanaan pemberian ganti rugi, pelatihan kerja dan kesempatan kerja atas pemutusan hubungan kerja tersebut.

Abstract

Public participation in Indonesia has increasingly shifted toward digital models following the COVID-19 pandemic, yet substantive engagement remains limited despite 221.56 million internet users and persistent urban–rural digital disparities. Using a socio-legal approach, this study examines the alignment between regulatory frameworks and digital participation practices in the Indonesian House of Representatives (DPR RI), focusing on initiatives such as DPR Now! and the Public Aspiration Agency. The findings show that participation mechanisms remain at the tokenistic consultation level on Arnstein’s Ladder, reflected in a low response rate of 3 percent, weak feedback loops, fragmented platforms, and the absence of a legal mandate to integrate public input into legislative decision-making. Comparative analysis with international models, including Decide Madrid and Taiwan, demonstrates the potential to significantly enhance participation through co-creation mechanisms supported by blockchain and AI-based sentiment analysis. Accordingly, this study proposes the establishment of Digital Deliberation Councils, regulatory harmonization, and constitutional amendments to guarantee digital participation rights, providing a foundation for a more inclusive and deliberative digital democracy in Indonesia.

Abstract

The problem relies on the suboptimal fulfillment of incentives and allowances for Indonesian health professionals. It becomes urgency that health professionals are the front liner in the treatment and countermeasures of COVID-19, especially with the high work risk burden that is faced, thus, making the government strive to fulfill at its best. The problem always repeats due to an unsynchronized implementation by the central and the local government until now, so it also worsens the unfulfilled rights of health professionals. The method used in this research was the socio-legal method. The data were collected from the existing laws and regulations and the result from sociological observation. The results indicated that there is a study on rights fulfillment for health professionals based on the laws of the rights of health professionals in Indonesia. The study elaborates on the problem that is currently happening with COVID-19 cases in Indonesia and the reality of the rights fulfillment of health professionals. This article also discusses legal reality in the making of laws and regulations das sollen and das sein.
