Abstract

This research aims at knowing sub system of law about the finance based on Syariah principle in Indonesia by method normative judicial approach not Islamic jurisprudence approach because the dispute finance have to solve by civil law of Indonesia. The research shows that finance based on Syariah principle have sub systems are profit sharing system, sale system and lease system.

Abstract

Keinginan masyarakat Indonesia menerapkan ekonomi syariah telah terpenuhi dengan lahirnya Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan Syariah, Peraturan Bank Indonesia dan Fatwa Dewan Syariah Nasional, namun faktanya sinkronisasi regulasi subyek dan obyek dalam pembiayaan jual beli murabahah di perbankan syariah adalah praktik jual beli murabahah yang regulasinya sebagian besar masih berpedoman KUH Perdata sehingga belum sinkron dengan prinsip syariah. Subyek perjanjian adalah bank juga nasabah dan obyeknya adalah barang yang tidak haram, namun belum ada regulasi yang memuat bahwa barang itu tidak melanggar undang-undang atau ketertiban umum. Regulasi hak dan kewajiban dalam undang-undang perbankan syariah, peraturan bank Indonesia dan fatwa Dewan Syariah Nasional tidak mengatur lebih rinci berkaitan dengan penyerahan barang yang dibeli oleh nasabah, baik itu barang bergerak ataupun barang tetap atau tidak bergerak. Hal yang belum diatur lainnya berkaitan dengan tanggung jawab adanya cacat yang tersembunyi yang tidak diketahui oleh pihak bank dan nasabah, termasuk perubahan harga setelah akad namun belum ada penyerahan kepada pembeli, misalnya masih dalam perjalanan.

Abstract

Conflicts have occurred in societies since early time in human civilization and continue up to the present time. Conflicts may happen between two individuals or two groups. But there also conflicts of class between creditors and debtors which has not been resolved. They often dispute over a particular issue but do not find an effective media to tackle it. Sharia banking, a new emerging Islamic system of bank, seems to offer a good answer to this problem. This article aims to explain this financial institution and its products and examines the ways in which its products operate and contribute to solve the problem. There are two products of Syari’ah Banking to solve such a classic problem between debtors and creditors; bay’ al-murabahah and  mudarabah. The first product helps mediate capital owners and debtors through a definite mechanism facilitated by Shari’a bank. Through the second product, debtors can enhance their life standard by purchasing stock and share the profits while creditors or capital owners can sell their stock to collect fund without making a bank loan. This is the solution that Islamic banking system contributes.

Abstract

Abstract: Bureaucratic reform is one of the government's efforts to achieve good governance, reform and fundamental changes to the system of government administration, especially regarding aspects of the institution (organization), management and human resources of the apparatus. Through bureaucratic reform, an effective and efficient government administration system is organized. Bureaucratic reform is the backbone in changing the life of the nation and state. Abstrak: Reformasi birokrasi merupakan salah satu upaya pemerintah untuk mencapai good governance, melakukan pembaharuan dan perubahan mendasar terhadap sistem penyelenggaraan pemerintahan terutama menyangkut aspek-aspek kelembagaan (organisasi), ketatalaksanaan dan sumber daya manusia aparatur. Melalui reformasi birokrasi, dilakukan penataan terhadap sistem penyelenggaraan pemerintah yang efektif dan efisien. Abstract

 Islamic bank is a financial institution that is essential for the people of Indonesia as an institution that is able to portray a welfare society with its products when it is implemented consistently. But the understanding of Islamic banks in the community is still in doubt because of Islamic bank same as conventional banks. Improper understanding of it can be explained by the philosophical, juridical and sociological.Islamic banking is a bank in its operations based on Islamic principles both in raising funds and mudaraba wadiah principles; in financing the purchase using the principles of Murabaha, salam and istishna; the issuing bank services products sharia apply the principle of al-wakalah,al-Hiwalah,al-qardh,al-kafalah, and al-Rahn. Three products when viewed legally has implemented of Constitution Number 21 concerning Islamic banking, and in a philosophical perspective in accordance with Pancasila, grand norm Constitution the 1945 and the Quran-Hadith, whereas in sociological perspective these principles have been entrenched in Indonesian society cooperation in agriculture "maro, mertelu" in livestock typically "mertelu", so it is said that the sociological principles of Sharia have been popular in Indonesia society.Keywords:philosophy,juridical,sociology.

Abstract

In the era of Dutch colonial, the majority of entrepreneurs in Central Java and Yogyakarta come from the students. But after Indonesian independence, the students did not show up in the business world because of political policy. Nowadays the entrepreneur students bounced back with Islamic banks that one of its products is a Musharakah finance. Musharakah finance deal with the birth of the free market, namely the ASEAN Economic Community so that the question arises how the prospect Musharakah finance in Indonesian Islamic banks of facing the ASEAN Economic Community (AEC). This paper aims to describe the prospect of Musharakah finance to face AEC. The results showed that the Musharakah finance has a lot of prospects such as financing products that can be performed well and have a competitive value because it has a solid legal basis. From the network side, Islamic banks have been supported by a network offices that much better at home and abroad with excellent quality customer service. In addition, the presence Bank Indonesia blueprint of the Islamic banking institution can strengthen the Musharakah finance products so that can be applied in the ASEAN Economic Community (AEC).
