Abstract

Penelitian ini bertujuan untuk mendapatkan gambaran yang utuh mengenai kebijakan pemerintah Kabupaten Sambas dalam membangun daerah perbatasan dan hasil dari pembangunan tersebut. Pendekatan penelitian yang digunakan adalah pendekatan yuridis normatif. Hasil penelitian ini menujukkan bahwa Benang merah pembangunan perbatasan adalah jalan dan jembatan. Oleh karena itu sejak tahun 2002 pemerintah Kabupaten Sambas mengalokasikan dana APBD Kabupaten Sambas untuk membangun jalan dan jembatan. Pembangunan badan jalan sepanjang lebih kurang 50 km dapat dibangun dalam waktu 3 tahun. Meskipun badan jalan tersebut belum layak sebagai jalan untuk angkutan barang dan orang, namun melalui jalan tersebut wilayah perbatasan yang semula ditempuh antara 12 jam sampai 14 jam kini dapat ditempuh antara 2 jam sampai 3 jam dengan menggunakan mobil atau sepeda motor. Saat ini jalan tersebut telah ditetapkan sebagai jalan nasional berdasarkan Keputusan Menteri Pekerjaan Umum Nomor 631/KPTS/2009 tanggal 31 Desember 2009. Karena telah ditetapkan sebagai jalan nasional, maka kewenangan pembangunannya menjadi kewenangan pemerintah pusat. Mulai tahun 2011 ini pekerjaan jalan nasional dimulai dan dengan dana dari bantuan Asean Development Bank (ADB) sebesar lebih kurang Rp 300 milyar, diperkirakan pekerjaan jalan selesai pada tahun 2013. Selain itu kebijakan pembangunan perbatasan di Kabupaten Sambas tanpa petunjuk atau pedoman yang jelas, bahkan hingga saat ini seperti apa konsep pembangunan perbatasan masih diperdebatkan. This study aims to gain a full picture of the Sambas district government policy in developing border areas and the results of such development. The research approach used is a normative juridical approach. The results of this study showed that the border is a common thread in the construction of roads and bridges. Therefore, since 2002 the government district of Sambas Sambas district budgets allocate funds to build roads and bridges. Development along the road about 50 km can be built within 3 years. Although the road is not feasible as a way to transport goods and people, but through the way the border region that was originally taken between 12 hours to 14 hours can now be taken between 2 hours to 3 hours by car or motorbike. Currently the road has been designated as national roads by Public Works Ministerial Decree No. 631/KPTS/2009 dated December 31, 2009. Since it has been designated as national roads, the construction authority to the central government. Beginning in the 2011 national road work begins, and with the help of funding from Asean Development Bank (ADB) amounting to approximately USD 300 billion, is expected road works completed in 2013. In addition the development policy in the border district of Sambas without instructions or guidelines are clear, even to this day as to what the concept of development is disputed.

Abstract

The purpose of this study, among others, first, is to analyze the laws and regulations concerning the right to choose illiterates in the 2019 simultaneous elections in the City of Singkawang. Second, for the evaluation of the legal aspects of the Election, specifically talking about the substance of the contents of the laws and regulations concerning providing assistance to illiterate voters. Third, to remind us together that the issue of the right to choose illiterates is an important issue that must be regulated in the election laws and regulations. The focus of the study in this paper is related to how to provide assistance to illiterate voters in the implementation of the 2019 simultaneous elections in Singkawang City. This research is a field research using descriptive qualitative method, meaning that the writer is directly involved with the resource person to reveal the social reality in the community. To obtain data the authors conducted observations and interviews. The findings can be concluded that illiterate voters cannot be provided with assistance when voting on the 2019 simultaneous elections in Singkawang City because there is no legal basis governing the provision of assistance to illiterate voters. So that the impact of the lack of legal basis, illiterate voters who come to polling stations and enter the voting booths, do not vote because of the confusion of the voters themselves.Keywords: Right to Choose, Illiteracy.

Abstract

Zakat as an Islamic financial instrument not only functions as worship, but also has a strategic role to embody social justice. The purpose of this research is to analyze the zakat management by BAZNAS Singkawang city based on the principle of distributive justice in the perspective of maqashid sharia. This research is an empirical research uses a descriptive qualitative approach with data collection techniques through interviews, observations, and documentation. The results indicate that the management of zakat by BAZNAS Singkawang has attempted to fulfill the principle of distributive justice through equal distribution to all ashnaf groups by direct assistance programs based on the needs and potential of mustahik. However, the management of zakat by BAZNAS Singkawang based on the principle of distributive justice in maqashid sharia  still faces obstacles and challenges in terms of equalizing the needs of mustahik so that comprehensive mapping is required in the distribution of zakat. Long term zakat management planning by prioritizing the maqashid sharia approach is also needed to create economic transformation and empowerment of mustahik.
