Abstract

This paper aims to obtain information about the spiritual leadership efforts in developing a culture quality and its reality developed.  The method in this study is a qualitative descriptive method. This research is a single case study focusing on the private Islamic schools, Senior High School Plus under Motahhari foundation, Bandung. The main data were obtained from primary sources namely the headmaster, teachers, staff, students and parents. Then, the secondary sources are qualitative documents such as dissertations, journals, documents and other sources supporting data. The data were collecting indepth interviews, non-participant observation and documentation. The technique of data analysis use integrative analysis. Then the data were analyzed using three methods namely data organization, data reduction and data presentation. For checking the validity of the data, researcheruse: 1) the credibility of the data with triangulation techniques, dependability and confirmability. The findings of study showed: 1) an articulation and dissemination of the vision and mission of the school was implemented fairly intense, 2) Motahhari as a symbol of Ulul Albab development, 3) the rewards and sanctions formes are an extrinsic and an intrinsic, 4) the relationships that occur in school is a social, an emotional and a spiritual relationships. The reality of the quality culture developed are: 1), cultural empathy, 2) critical culture, 3) an innovative culture, and 4) an inclusive - pluralist culture

Abstract

This article discusses the doctrine of Sainthood (al-walāyah) which has a strong basis in the Qur’an and ḥadīth and it has been elaborated systematically through Ibn ‘Arabi’s vast and complex teachings. While in the study of Sufism in the archipelago, the term saint (walī)has been known along with the spread of Islam began in the archipelago, and it refers to two meanings; as the person who has the occulties as the implications of the sanctity and walī as the ruler of a particular region. Regardless the definition and scope, the true doctrine of sainthood can not be separated from the teaching of the prophetic and apostolic message which implies the human world is not only the physical realm, but there is a metaphysical world that has not been known to human and from which the physical world is controlled.

Abstract

Ibn Taymiyya, despite being well-kown as a figure of salafi-radicalists which are anti-reformism and oppose tasawuf, in fact is an inspiring figure for some modernist Muslims and is a sufi. How could it be possible for someone who criticizes tasawuf to be a sufi? How should Ibn Taymiyya be placed correctly in this regard? How could his contradictive attitude be explained? These questions will be discussed in paper through a careful study of his works and by investigating his life-experience from a psycho-sufistic perspective. This paper argues that his criticism to certain kind of tasawwuf, i.e., the naẓarī-falsafī, is often based on confusion in understanding terms and departs from different paradigm used by the object of his criticism. Finally this paper shows that the attitude he has, towards the end of his life—in an inwardly situated condition in such a manner so he is far from any discursive activities and totally drowning in the taqarruband having full attention to God and achieving the peak of mystical experience, the annihilation— however contradicts to his early standpoint, is nothing but the continuation and growth of his religious maturity.

Abstract

Indonesia and Malaysia are predominantly Muslim and belong to the Shafii school of thought. Both have similarities concerning the rights of the wife in divorce. This study examines the fulfilment of post-divorce rights for women based on the decisions of the Religious Courts in Indonesia and Malaysia. The period for this research object is limited to 2014-2016. The research used a qualitative method with comparative and case approaches. This study finds that, legally, a wife can receive post-divorce rights, including ‘iddah, mut‘ah and ḥaḍānah. However, the Indonesian and Malaysian courts’ decisions regarding women’s post-divorce rights differ depending on whether the women request the fulfilment of their rights in their petitions. In Indonesia, judges can use their ex-officio rights to grant women their rights even without their requests. In Malaysia, on the other hand, the wives must state their demands in their petitions.  Abstrak: Indonesia dan Malaysia adalah negara mayoritas berpenduduk muslim dan bermazhab Syafi’i. Keduanya memiliki persamaan berkaitan dengan hak- hak isteri dalam perceraian. Penelitian ini bertujuan untuk mengetahui hak-hak isteri dalam perceraian berdasarkan putusan-putusan Pengadilan Agama di Indonesia, dalam hal ini Pengadilan Agama Jakarta Selatan dan Mahkamah Syariah di Malaysia. Kurun waktu objek penelitian ini dibatasi tahun 2014- 2016. Metode penelitian yang digunakan adalah metode kualitatif dengan pendekatan komparatif dan pendekatan perundang-undangan. Hasil penelitian menyatakan bahwa hak-hak yang dapat diterima isteri dalam perceraian yaitu hak nafkah ‘iddah, mut‘ah dan ḥaḍānah. Namun dalam kenyataan, putusan pengadilan tentang hak-hak isteri dalam perceraian di Indonesia dan Malaysia terjadi perbedaan. Perbedaan putusan tersebut terjadi dalam hal isteri pada proses persidangan tidak memohon atau menuntut hak-haknya kepada majelis hakim. Di Indonesia, hakim memiliki hak ex officio. Hakim memberi hak- hak isteri, meskipun isteri tidak menuntut hak-haknya selama temohon selalu hadir dalam persidangan. Di Malaysia, hak-hak isteri harus diminta kepada majelis hakim oleh isteri, karena perceraian merupakan permohonan dan kesepakatan antara para pihak.
