Abstract

Indonesia is very rich in fishery potential. The potential that exists makes fish farming propagate in urban and rural areas which in fact are far from the waters (sea). However, the performance problem of fish farming in the terrestrial environment is one of the inhibiting factors for the development of fish production in Indonesia. PT. Pertamina (PERSERO) Fuel Terminal Rewulu is one of the agents who embrace the community to open up opportunities for environmentally friendly innovations in fish farming in the terrestrial environment. This opportunity was used by the community to create an empowerment program with the name NOT MAIN. The background of these problems and ideas has attracted researchers to describe the implementation of CSR through community empowerment based on innovative and environmentally friendly independent fish farming. This study uses a qualitative method which is presented descriptively. The object of this research is the NOT MAIN program. The subjects in this study were the CDO and the administrators of the NOT MAIN program. Informants were determined by purposive sampling technique. In terms of data collection techniques, it is done by interview, observation, and documentation. The data analysis technique used the Miles and Hubermen model. Next is a test of the validity of the data which is done by using triangulation of sources and methods. The results obtained from this research are that the program is implemented with a bottom-up approach which is then carried out within the scope of community empowerment. This program also produces environmentally friendly technological innovations, namely MBG technology based on IoT (banoo sensor), the use of solar cells (DC systems), and modified RAS (Recirculating Aquaculture System).

Abstract

The 2024 Regional Election are the first time simultaneous national Regional Election have been held. As a result, 271 regional head positions are vacant due to the expiration of their term of office. Acting Regional Heads were appointed to fill in temporarily. One of the polemics is that an active Indonesian National Armed Force’s member was appointed as Acting Regent of West Seram. This research is a normative juridical research with statutory, conceptual, and historical approaches. The results showed that the Good Governance Principles has been regulated in Law Number 28 of 1999 concerning Clean and Free State Administration from Corruption, Collusion and Nepotism and Law Number 30 of 2014 concerning Government Administration, which when juxtaposed, there is 1 principle in common, namely the principle of legal certainty. The appointment of active Indonesian National Armed Force as Acting Regional Heads is not by the principle of legal certainty. The appointment contrary to Article 47 paragraph (1) of the Law Number 34 of 2004 concerning the Indonesian National Armed Force as the “lex specialis”. The appointment is also not by the Good Governance Principles construction in Article 10 of the Law 30/2014 because it violates the principle of legal certainty, accuracy, not abusing authority, openness, and good service. It is recommended that the Government in making the appointment of Acting Regional Heads should be guided by the Good Governance Principles and provide opportunities for the people to be involved so becomes more transparent and by democratic values.

Abstract

Pemilihan Kepala Daerah (Pilkada) yang diatur dalam Pasal 18 ayat (4) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dimungkinkan terselenggara dengan calon tunggal. Kewenangan memutus permohonan perselisihan hasil Pilkada diemban oleh Mahkamah Konstitusi (MK) yang mana salah satu syarat formil permohonan adalah mengenai kedudukan hukum (legal standing) Pemohon. Penelitian ini bertujuan untuk memotret keterkaitan antara penyelenggaraan Pilkada calon tunggal dengan kualitas demokrasi di Indonesia sekaligus menganalisis kekuatan legal standing Pemantau Pemilihan sebagai Pemohon perselisihan hasil Pilkada. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual untuk meneliti bahan-bahan hukum dan selanjutnya dianalisis secara kualitatif. Hasil penelitian menyimpulkan bahwa meningkatnya jumlah penyelenggaraan Pilkada calon tunggal menandakan turunnya kualitas demokrasi. Kemudian berdasarkan Peraturan MK Nomor 6 Tahun 2020, Pemantau Pemilihan memiliki legal standing untuk menjadi Pemohon dalam permohonan perselisihan hasil Pilkada calon tunggal, sedangkan dalam Undang-Undang MK tidak mengatur demikian. Hal ini menyebabkan lemahnya kekuatan legal standing Pemantau Pemilihan sebagai Pemohon perselisihan hasil Pilkada calon tunggal sebab secara hierarkis kedudukan UU lebih tinggi dari Peraturan MK. Oleh karenanya perlu dilakukan revisi terhadap UU MK guna memasukkan Pemantau Pemilihan sebagai pemohon perkara perselisihan hasil Pilkada.
