Abstract

The responsibility to handle the Covid-19 Pandemic is not only carried out by the President as the highest leader of the government, but also the House of Representatives which holds the legislative branch of power, so far the public has questioned the seriousness of Parliament in handle the Pandemic, through its functions should be able to assist and especially to monitoring policy government to work together to handle this pandemic and as an effort to prevent potential abuse of power. The writing of this article uses the Juridical Normative method which will produce recommendations on how the House of Representatives should optimize its function during the Covid-19 Pandemic.

Abstract

Recently, omnibus law has become a critical discourse in Indonesia, both academically and practically. This discourse emerges from the relatively fast drafting and ratification of the Job Creation Law. This law's formation uses the omnibus law method because it contains many laws' substance into one law. One of Indonesia's fundamental issues is the absence of rules, methods, and techniques for forming the omnibus law. On the other hand, the techniques and methods of forming these omnibus laws have been practiced in various countries to accelerate the legislative process and organize regulations. However, public participation becomes one of the fundamental shortcomings to draft the legislation under omnibus law. This article aims to review and compare the omnibus law concept applied in selected countries, referencing the United States and Ireland as the model. This article also analyzes how to form the ideal omnibus law by learning from the omnibus law application in other countries that have successfully implemented it first. This study finds that omnibus laws in the United States and Ireland contribute to ushering hyper-regulation symptoms that are vulnerable and hamper economic development. The above comparison needs to be adjusted to the Indonesian context to enact the omnibus law. KEYWORDS: Omnibus Law, Indonesian Law, Comparative Omnibus Law.

Abstract

AbstrakPandemi Covid-19 telah melanda lebih dari 200 negara sehingga mengancam perekonomian global dan nasional tak terkecuali Indonesia. Sebagai negara hukum formil (rechtstaat), Indonesia memerlukan peraturan perundang-undangan sebagai dasar bertindak untuk mengatasinya. Pada bulan Maret 2020, presiden mengeluarkan Perppu No. 1 Tahun 2020 tentang Kebijakan Keuangan Negara dan Stabilitas Sistem Keuangan Untuk Penanganan Pandemi COVID-19 yang kemudian disahkan oleh DPR menjadi undang-undang, banyak pihak mengkritik Perppu tersebut karena dianggap memberikan absolutisme penguasa, namun sesungguhnya Perppu tersebut memberikan kepastian hukum guna mencapai tujuan dan kemanfaatan yang lebih luas yakni pemulihan dari krisis ekonomi akibat Covid-19. Permasalahan yang dibahas dalam tulisan ini adalah, bagaimana penggunaan serta pengawasan diskresi yang dikeluarkan untuk penanganan pandemi Covid-19 dan bagaimana perlindungan terhadap diskresi yang dilaksanakan Pemerintah berdasarkan Perppu No. 1 Tahun 2020 dalam rangka penanganan Covid-19. Metode pendekatan yang digunakan dalam tulisan ini adalah pendekatan konseptual, berdasarkan pada asas kepastian dan kemanfaatan hukum, serta menjelaskan penggunaan diskresi berdasarkan Undang-Undang No. 30 Tahun 2014.Kata Kunci: Peraturan Perundang-undangan, Kepastian Hukum, Covid-19AbstractCovid-19 pandemic has affect more than 200 countries so that it is threatening global and national economic, including Indonesia. As a formal legal state (rechtstaat), Indonesia need laws and regulation as a basis for handle it. In March 2020, the president issued Perppu No. 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling the COVID-19 Pandemic which was then passed by the House of Representative into law, many parties criticized the Law providing leadership absolutism, but in fact this Law provides legal certainty to recovery from the economic crisis caused by Covid-19. The problem discussed in this paper is about how to protect the implementation of the release of discretion issued for handling the Covid-19 pandemic and protection against discretion by the Government based on Perppu No. 1 of 2020 in the context of handling Covid-19 and. The method used in this paper is about conceptual, based on the legal certainty and utilities, and explains the use of discretion based on Law No. 30 of 2014 concerning Government Administration.Keywords: Laws and Regulations, Legal Certainty, COVID-19

Abstract

Constitutional Court Decision No. 91/PUU-XVIII/2020 affects Law no. 11 of 2020 concerning Job Creation. More than that, the Constitutional Court’s decision seems to portray the fundamental problems of the law-making process that must be corrected immediately. These problems are, first, the Omnibus method in Law no. 12 of 2011 concerning the Establishment of Legislation. Second, procedural error and a change in the text after the mutual agreement. Third, ignoring meaningful public participation in the formation of laws. This research will focus on correcting the Constitutional Court to the process of law formation to prioritize meaningful participation, not just a mere formality. The legislators then followed up the Constitutional Court’s notes by revising Law no. 12 of 2011 concerning the Establishment of Legislation for the second time become Law no. 13 of 2022, one of the substances of which is to change the provisions of Article 96, which contains the regulation of public participation in the formation of laws. The formulations of the problem raised in this study are: what is the meaning of meaningful public participation in the construction of rules based on the Constitutional Court Decision No. 91/PUU-XVIII/2020, and what is the ideal arrangement in Law no. 12 of 2011 concerning the Formation of Legislations to accommodate meaningful participation in the formation of laws. This study found that Law no. 13 of 2022 cannot accommodate meaningful participation because it is still a right and not an obligation. Then legislators must create information technology-based tools that help increase meaningful participation in law-making.

Abstract

Pemilihan umum (pemilu) adalah proses yang dilakukan oleh negara untuk menerapkan sistem demokrasi. Pemilu diadakan setiap 5 (lima) tahun sekali. Menurut Undang-Undang Dasar Negara Republik Indonesia (UUD NRI) Tahun 1945, pemilu harus dilakukan secara langsung, umum, bebas, rahasia, jujur, dan adil. Dalam negara demokratis, pemilu sangat penting untuk dipertahankan. Di sisi yang lain, warga negara berhak (dapat pula menjadi wajib) terlibat secara langsung dalam proses penegakan kedaulatan. Artinya, apabila terdapat penundaan pemilu, maka terhambat juga partisipasi rakyat untuk menegakkan kedaulatan itu sendiri.

Abstract

Public participation is the heart of the legislative process. Participation is crucial to ensure that the laws produced genuinely reflect the needs and aspirations of society, as well as to embody democracy and strengthen legitimacy. Through a normative juridical approach, the research aims to compare public participation in law-making in five democratic countries, namely Indonesia, the United States, the Philippines, South Africa, and South Korea, by analyzing their Constitutions and laws and regulations. The findings can then be used as best practices that can be adopted by Indonesia. The results of the study show that the Constitutions of the United States, the Philippines, South Africa, and South Korea guarantee public participation in the legislative process. In contrast, the Indonesian Constitution only affirms People’s Sovereignty. However, normatively, Indonesia regulates the role of the public more comprehensively and technically in the law-making process at every stage, further reinforced by the Constitutional Court Decision No. 91/PUU-XVIII/2020, which mandates that the role of the public be more meaningful in law-making, as participation is a constitutional right held by citizens.

Abstract

It's been almost a year since WHO declared Covid-19 to be a pandemic, this outbreak has infected almost all countries in the world and has affected various sectors. As a rule of law, Indonesia issued various legal products to deal with the impact of the Covid-19 Pandemic, especially from the health and economic sectors. This article will explain what legal products the government has formed to deal with pandemics and discuss the problems of legal products that apply in dealing with pandemics. The research method used in this study is Normative Juridical with a conceptual approach, statutory approach and comparative approach. This research will evaluate the legal products formed by the government because there are problems such as disharmony, in addition to another problem, namely the formation of laws formed by the House of Representatives together with the government which have no connection with the acceleration of the handling of the Covid-19 pandemic and are considered to be negligent. to the sense of crisis. One of the recommendations that can be implemented by the Government is to focus on establishing laws and regulations related to the handling of the Pandemic and evaluating the laws and regulations made in the context of handling the Pandemic in the past year.

Abstract

Kegiatan ini bertujuan untuk memanfaatkan limbah kulit kacang macadamia sebagai bahan baku pembuatan briket di Desa Sumberejo, Kecamatan Ijen. Limbah kulit kacang macadamia yang biasanya tidak dimanfaatkan secara optimal dapat diolah menjadi briket sebagai sumber energi alternatif yang ramah lingkungan.Proses pembuatan briket melibatkan tahapan pengeringan, penghancuran, pencampuran dengan bahan perekat, pencetakan, dan pemanasan. Hasil penelitian menunjukkan bahwa briket yang dihasilkan memiliki nilai kalor yang cukup tinggi dan mampu bersaing dengan bahan bakar alternatif lainnya. Selain itu, inovasi ini memberikan solusi untuk masalah limbah dan meningkatkan ekonomi masyarakat setempat. Penelitian ini diharapkan dapat menjadi model pengolahan limbah organik yang berkelanjutan di wilayah pedesaan.

Abstract

The 2024 Regional Election are the first time simultaneous national Regional Election have been held. As a result, 271 regional head positions are vacant due to the expiration of their term of office. Acting Regional Heads were appointed to fill in temporarily. One of the polemics is that an active Indonesian National Armed Force’s member was appointed as Acting Regent of West Seram. This research is a normative juridical research with statutory, conceptual, and historical approaches. The results showed that the Good Governance Principles has been regulated in Law Number 28 of 1999 concerning Clean and Free State Administration from Corruption, Collusion and Nepotism and Law Number 30 of 2014 concerning Government Administration, which when juxtaposed, there is 1 principle in common, namely the principle of legal certainty. The appointment of active Indonesian National Armed Force as Acting Regional Heads is not by the principle of legal certainty. The appointment contrary to Article 47 paragraph (1) of the Law Number 34 of 2004 concerning the Indonesian National Armed Force as the “lex specialis”. The appointment is also not by the Good Governance Principles construction in Article 10 of the Law 30/2014 because it violates the principle of legal certainty, accuracy, not abusing authority, openness, and good service. It is recommended that the Government in making the appointment of Acting Regional Heads should be guided by the Good Governance Principles and provide opportunities for the people to be involved so becomes more transparent and by democratic values.

Abstract

At the beginning of 2020, the world was faced with the COVID-19 Pandemic which had an impact on various fields, from health, economics, education to politics and law, especially in the Law-Making Process, the existence of Large-Scale Social Restriction policies to overcome the Pandemic on the other hand had an impact on limited space for participation. The public takes part in the Law-Making Process due to the policy to reduce meetings involving large crowds in one place, apart from that the issue of transparency worsens the practice of the Law-Making Process during the Covid-19 Pandemic, including the revision of the Mineral and Coal Law and the Law-Making Process of the Job Creation Law, even though the existence of the law is the basis for the government to act and carry out its functions is an essential thing in a civil law based state. A good law must fulfill 2 (two) aspects, including the material and the formal aspects. Several practices that deviate from formal aspects of the Law-Making Process during the Covid-19 Pandemic violate the principles of participation and transparency and threaten democracy. Through a normative juridical approach with conceptual, statutory and comparative approaches, this research aims to explain the symptoms of legislative practices that threaten democracy during the Covid-19 Pandemic. The research results show that participation in the Law-Making Process during the Pandemic was weak and not transparent. In the future, as an effort to maximize public participation in the Law-Making Process during the emergency period, it needs to be supported by the adoption of information technology to comprehensively support the public's role in the Law-Making Process at every stage, coupled with the Constitutional Court Decision No. 91/PUU-XVIII/2020 which orders meaningful public participation in Law-Making Process.
