Abstract

Profesi Ahli Tenaga Laboratorium Medik (ATLM) memiliki profil resiko infeksi biologis tinggi akibat paparan langsung dari spesimen infeksius. Meskipun kerangka hukum positif terkait perlindungan K3 dan kesejahteraan tenaga kesehatan telah tersedia, terdapat kekosongan klausul spesifik yang mengikat untuk profesi ATLM, terutama pada fasilitas kesehatan berorientasi korporat. Penelitian ini bertujuan menganalisis urgensi regulasi hukum spesifik untuk menetapkan standar upah berbasis resiko dan penjaminan biaya penuh program K3 preventif maupun responsif. Subjek penelitian terdiri dari informan kunci yang merupakan praktisi ATLM aktif pada jaringan klinik GSM di tiga lokasi berbeda. Penelitian ini menggunakan metode pendekatan hukum normatif-empiris dengan desain studi kasus kualitatif tunggal. Instrumen pengumpulan data meliputi studi dokumentasi terhadap peraturan perundang-undangan (data sekunder) serta diskusi kualitatif mendalam dan pengalaman observasi lapangan (data primer). Data kemudian dianalisis menggunakan teknik analisis kesenjangan hukum (gap analysis) dengan membandingkan norma hukum positif terhadap fakta implementasi lapangan. Temuan menunjukkan adanya celah hukum pada skema kerja Perjanjian Kerja Waktu Tertentu (PKWT)/Mitra yang digunakan instansi berbasis korporat ini untuk memberikan upah yang hanya mengacu pada UMK setempat tanpa kompensasi resiko. Selain itu, ditemukan kegagalan implementasi K3 preventif berupa pelaksanaan dan pembebanan biaya vaksin Hepatitis B serta Medical Check-Up non-fungsional dan K3 responsif dimana unit K3/PPI hanya bersifat administratif  dan non-fungsional, sehingga alur pasca paparan tidak berfungsi  aktif. Fakta-fakta tersebut menegaskan bahwa regulasi yang bersifat umum gagal menciptakan perlindungan komprehensif di fasilitas kesehatan berorientasi korporat seperti klinik GSM. Dari hasil penelitian ini merekomendasikan urgensi regulasi hukum spesifik yang mengikat untuk menetapkan standar upah berbasis resiko dengan mengadopsi acuan dari organisasi profesi (PATELKI) serta penjaminan biaya penuh K3 preventif dan responsif.

Abstract

The implementation of zakat fund governance at the Dewan Kemakmuran Masjid (DKM) or Mosque Prosperity Council of the Al-Hidayah Mosque in Citeras, Lebak Banten, still operated within a traditional and poorly structured framework. This study aimed to analyze sharia compliance in the zakat distribution practices carried out by the Al-Hidayah Mosque Council (DKM) to zakat recipients (mustahik). This study combines field observations with doctrinal legal analysis using a qualitative normative-empirical methodology, with legal normativity analysis. The governance of zakat funds at the Al-Hidayah Mosque’s DKM remains largely traditional and has not fully aligned with sharia compliance principles, particularly in ensuring accurate targeting of zakat recipients (asnaf). Nevertheless, efforts have been made to adopt PSAK No. 109, which emphasizes accountability and transparency in zakat management. The mosque’s management also seeks to fulfill the mandate of Law No. 23 of 2011, Article 1, which defines zakat management as the planning, implementation, and coordination of zakat collection, distribution, and utilization. In practice, zakat distribution at Al-Hidayah Mosque has been directed to eligible asnaf groups, consistent with Article 27 of the same law, which allows zakat to be used productively to alleviate poverty and improve community welfare. However, zakat governance at the mosque still requires improvement, particularly through coordination with provincial and district/city BAZNAS, as mandated by Article 31 of Law No. 23 of 2011, which authorizes these institutions to collect and distribute zakat. The DKM of Al-Hidayah Citeras Lebak Mosque must also implement the Zakat Core Principles and strengthen zakat governance aspects.

Abstract

Cases of children as drug users are victims of drug abuse who are vulnerable to being part of the drug trafficking circle, even becoming an opportunity for dealers and suppliers to use children as couriers. The main problem of this research is about the legal protection of the rights of children who use drugs and criminal responsibility for children as perpetrators of criminal acts of drug users according to positive law in Indonesia. The research carried out for this thesis is normative legal research with a law and comparative approach. Data collected through primary, secondary and tertiary legal materials which were then analyzed qualitatively to obtain research results regarding the legal protection of the rights of children who use drugs to obtain legal assistance at the stage of investigation, prosecution and court based on the provisions of Law Number 3 of 1997 concerning Juvenile Court and criminal responsibility for children as perpetrators of criminal acts of drug users by undergoing action in the form of rehabilitation as drug abuse based on Law Number 3 of 1997 concerning Juvenile Court.
