Abstract

Penulisan artikel ini bertujuan untuk mendeskripsikan tipologi hukum Islam Perspektif Wael B Hallaq dan memetakan konstruksi kontekstualisasi hukum Islam dalam realitas sosial-Budaya perspektif Wael B Hallaq. Metode penelitian yang digunakan dalam penulisan artikel ini adalah deskripsif-kualitatif dengan kajian pustaka (library research) dengan sumber data berupa buku, jurnal, dan media online, serta bahan rujukan lainnya yang relevan dengan permasalahan yang dikaji. Hasil penelitian menunjukan bahwa kontekstualisasi hukum Islam dengan perspektif Wael B. Hallaq dalam mengkaji hukum Islam yang bersumber pada Al-Qur’an dan Al-Hadits sebagai sumber primer sangat tergantung pada konteks sosio-budaya suatu masyarakat dan bangsa. Hukum-hukum di dalam Al-Qur ’an dan Al-Hadits menurutnya bersifat elastis yang bisa ditarik dan disesuaikan dengan konteks tempat dan zaman. Oleh sebab itu, maka kemurnian hukum Islam bagi sebagian besar kelompok Muslim sebagai warisan sejarahnya dan hasil karya intelektual yang dibangun lebih dari seabad yang lalu, harus dilihat secara proporsional, sehingga akan dilindungi dari pemahaman statis tentang pola, eksklusif, beku dan kaku.

Abstract

This article attempts to explain that marriage is defined as a spiritual and physical bond between a man and a woman to achieve happiness. However, in reality, many marriages are forced, resulting in unhappiness. This goes against the purpose of marriage stated in the law. The inclusion of the phrase "Belief in the Almighty God" in the definition of marriage in Article 1 of Law no. 1 of 1974 shows that marriage is not only a personal matter, but also a legal relationship that contains religious values based on Pancasila as the Indonesian philosophy of life. The marriage law explains that marriage is a spiritual and physical bond between a man and a woman, but this explanation is different from that regulated in the Civil Code, especially book III. This difference is the background for this research. The purpose of this research is to find out and explain that there should be no substantive differences between the 1974 Marriage Law and the Civil Code, especially book III. This is necessary so that the public gets legal certainty, both in terms of the Marriage Law and the Civil Law. This research uses qualitative methods, with a type of library research that is based on library data or documentation that is relevant to the title of this research. The research results show that there is legal uncertainty in the field of marriage law, which is caused by the provisions in Article 66 of Law no. 1 of 1974 which states that colonial product legal provisions do not apply, even though the Civil Code is also a colonial product. Therefore, there needs to be legal certainty to avoid confusion in society

Abstract

This research is driven by the urgent need to formulate religion- and culture-based moderation strategies as preventive and counter-radicalization efforts, particularly in light of the rising threat of intolerance and extremism in Indonesia. The primary aim of this study is to identify the contributing factors of radicalism in multicultural societies and to formulate effective and applicable moderation strategies within the framework of the disruptive era. This study employs a qualitative method using a moderative, religious, and cross-cultural approach, guided by Creswell’s framework. Data sources include scholarly literature, government policy documents (e.g., from Kemenag and BNPT), and digital religious-cultural content from social media and online platforms. Data collection was conducted through document analysis and digital observation using purposive sampling to ensure relevance to issues of radicalism and moderation in Indonesia. The data were analyzed thematically, following Creswell’s steps: organizing data, reading for general meaning, coding, developing themes, interpreting findings, and presenting results. The findings reveal that radicalism arises from weak religious literacy, cultural exclusivism, and social inequality, all of which are exacerbated by digital disinformation. Effective moderation strategies must include strengthening multicultural education, promoting interfaith dialogue, involving local religious and cultural leaders, and utilizing digital media for tolerance and inclusivity campaigns. Academically, this study holds strong urgency in enriching scientific discourse on religion and cross-cultural understanding and radicalism and in developing a contextual interdisciplinary approach for fostering a peaceful society amid the challenges of globalization.

Abstract

Kehidupan masyarakat multikultural di Indonesia, khususnya di Kota Tangerang, menuntut adanya penguatan nilai-nilai toleransi beragama, terutama di kalangan generasi muda. Pengabdian kepada masyarakat ini bertujuan untuk meningkatkan literasi Islam wasathiyah (moderat) di kalangan Gen-Z Muslim melalui pendekatan pendidikan toleransi beragama. Kegiatan ini dilaksanakan dalam bentuk workshop, diskusi interaktif, dan pembuatan konten edukatif yang melibatkan pelajar SMA dan mahasiswa sebagai sasaran utama. Metode yang digunakan mencakup penyuluhan partisipatif, pemanfaatan media digital, serta evaluasi pra dan pasca kegiatan untuk mengukur efektivitas program. Hasil kegiatan menunjukkan peningkatan pemahaman peserta terhadap prinsip-prinsip Islam wasathiyah, seperti keseimbangan, keadilan, dan penghargaan terhadap keberagaman. Selain itu, program ini juga berhasil membentuk sikap positif peserta terhadap pentingnya toleransi antarumat beragama. Dengan demikian, penguatan literasi Islam wasathiyah melalui pendidikan toleransi beragama dinilai efektif sebagai strategi pembentukan karakter moderat di kalangan Gen-Z Muslim di wilayah urban seperti Kota Tangerang.
