Abstract

The article discusses the impact analysis of the PUU Procedural Law Guidance held by the Constitutional Court on Peradi Advocates throughout Indonesia. The purpose of the study, first is to find out how the impact of the PUU Procedural Law Guidance held by the Constitutional Court on the understanding of Peradi Advocates? Second, to find out the benefits for peradi advocates who follow Bimtek? This research method is normative law, with a statutory approach, a historical approach and a case approach. Primary, secondary and tertiary data sources. Data collection techniques by means of literature study, qualitative juridical data analysis. The results of the first study can increase the understanding and knowledge of lawyers peradi about the authority of the Constitutional Court. Secondly, they can construct a good and correct PUU application, can comprehensively control the PUU application material, get a conference overview of the PUU application flow starting from registration, document preparation and preliminary trial to the verdict trial. Suggestions for the future of the technical guidance are still carried out considering the magnitude of the impact and benefits of the technical guidance for advocates throughout Indonesia.

Abstract

This research examines the legal rules related to the term of office of the chairman of the Corruption Eradication Commission (KPK)? And what is the impact of the Constitutional Court decision Number: 112/PUU-XX/2022 on the term of office of the KPK leadership. This research method is normative legal research with an analytical case study approach. Normative juridical analysis. The results of this study are FIRST The legal regulations related to the tenure of the KPK chairman are regulated in Article 34 of Law Number 30 of 2002 concerning the Corruption Eradication Commission (State Gazette of the Republic of Indonesia of 2002 Number 137, Supplement to the State Gazette of the Republic of Indonesia Number 4250) which reads: "Corruption Eradication Commission leaders hold office for 4 (four) years and can be re-elected only for one term of office". SECOND With the decision of the MK RI No 112/puu-xx/2022, the term of office of the "Corruption Eradication Commission Leaders who previously served for 4 (four) years and can be re-elected only for one term of office". So with the Constitutional Court's decision the term of office "Corruption Eradication Commission leadership has increased to 5 (five) years and can be re-elected only for one term of office" means that there is an additional 1 (one) year term of office of the KPK leadership from 4 (four) years to 5 (five) years

Abstract

Tindak kriminalitas merupakan salah satu indikator kesejahteraan masyarakat akan rasa aman. Semakin tinggi pelaporan kasus tindak pidana kriminalitas oleh masyarakat menunjukkan bahwa tingkat keamanan di wilayah tersebut semakin buruk. Tindak kriminalitas di Kota Tangerang dapat dipengaruhi oleh beberapa faktor, yaitu faktor kemiskinan, faktor jumlah penduduk dan faktor laju pertumbuhan penduduk. Bila laju pertumbuhan penduduk mengalami pertumbuhan yang begitu pesat maka akan bertambahnya jumlah penduduk dan dapat dipungkiri akan bertambahnya kemiskinan di Kota Tangerang. Hal ini dapat memicu aksi Kriminalitas untuk memenuhi kebutuhan yang kurang tercukupi. Tujuan penelitian ini yaitu untuk menentukan variabel-variabel yang berpengaruh terhadap tindak pidana kriminalitas di Kota Tangerang dan mengatasi variabel yang terjadi multikolinearitas. Dapat disimpulkan seluruh variabel berpengaruh terhadap tindak pidana kriminalitas dan regresi LASSO (Least Absolute Shrinkage And Selection Operator) dapat menyederhanakan model dan secara tidak langsung dapat mengatasi masalah multikolinearitas dalam penelitian ini. Sehingga pemerintah dapat berusaha lebih untuk mengatasi jumlah penduduk dan masalah kemiskinan yang terjadi serta pihak kepolisisan lebih meningkatkan keamanan di Kota Tangerang demi menciptakan keamanan yang lebih baik lagi dan meminimalisirkan tindak kriminalitas.

Abstract

This study examines the impact of the Constitutional Court Decision Number 6/PUU-XXII/2024 concerning the Position of the Attorney General of the Republic of Indonesia Not from Political Party Management. This research method is normative legal research with a case study analysis approach. Normative legal analysis. The results of this study are 1. Constitutional Court Decision No. 6/PUU- XXII/2024 Grants the Applicant's request in part. 2. Declare Article 20 of Law Number 11 of 2021 concerning Amendments to Law Number 16 of 2004 concerning the Attorney General's Office of the Republic of Indonesia (State Gazette of the Republic of Indonesia 2021 Number 298, Supplement to the State Gazette of the Republic of Indonesia Number 6755) is contrary to the 1945 Constitution of the Republic of Indonesia and has no conditional binding legal force as long as it is not interpreted as "To be appointed as Attorney General, one must meet the requirements as referred to in Article 20 letters a to f including the requirement not to be an administrator of a political party unless one has resigned as an administrator of a political party at least 5 (five) years before being appointed as Attorney General". The legal impact of the Constitutional Court Decision of the Republic of Indonesia No. 6/PUU-XXII/2024 on the Attorney General's Office of the Republic of Indonesia is that in order to be appointed as Attorney General of the Republic of Indonesia, one must not be an administrator of a political party at least 5 years before being appointed as Attorney General.

Abstract

Legal implications of Joint Regulation of the Minister of Religious Affairs and the Minister of Home Affairs No. 9 of 2006 on freedom of religion in the perspective of Article 29 of the 1945 Constitution. This regulation, which should guarantee freedom of religion, often becomes a tool of discrimination against religions such as Catholicism, Christianity, Hinduism, Buddhism, and Confucianism. This discrimination is exacerbated by the anarchic actions of radical groups and the absence of the government in enforcing the law, which results in unrest and arbitrariness by certain individuals. This journal highlights the importance of wise solutions to achieve harmony between religious communities and implement the mandate of the 1945 Constitution. By analyzing cases of discrimination and anarchic actions, it offers policy recommendations that can strengthen the protection of religious freedom and encourage the active role of the government in maintaining harmony between religious communities.
