Abstract

Perkembangan teknologi dan informasi dari waktu kewaktu banyak membawa kemudahan diberbagai aspek kehidupan bermasyarakat. Kemudahan tersebut dapat kita rasakan dengan hilangnya batas teritorial antar individu bahkan antar negara dalam melakukan interaksi. Jika dahulu untuk dapat  berkomunikasi diperlukan sebuah pertemuan, maka saat ini untuk berkomunikasi dengan siapapun hanya diperlukan satu alat telepon genggam sehingga segalanya terlihat semakin mudah dan dekat. Akan tetapi kemudahan yang ditawarkan tersebut pada faktanya tidak lepas dari akses negatif seperti misalnya potensi tindak pidana penipuan melalui panggilan seluler. Perubahan yang bersifat disrupsi ini pada akhirnya pasti memaksa hukum agar dapat terus mengikuti dan menyesuaikan dengan perkembangan zaman agar tetap dapat memberikan pengayoman serta perlindungan terhadap masyarakat. Akan tetapi hingga saat ini hukum belum sepenuhnya memberikan perlindungan kepada masyarakat. Dari permasalahan tersebut penulis kemudian mengambil rumusan masalah yakni bagaimana pengaturan tindak pidana penipuan melalui sarana panggilan suara dari telepon seluler?, Bagaimana penegakan hukum tindak pidana penipuan melalui sarana panggilan suara dari telepon seluler? Penelitian ini menggunakan metode penelitian Normatif yakni dengan pendekatan masalah dengan melihat, menelaah dan menginterpretasikan hal-hal yang bersifat teoritis yang menyangkut asas-asas hukum yang berupa konsepsi, peraturan perundang-undangan, dan doktrin hukum. Hasil dari penelitian ini ditemukan bahwa tindak pidana penipuan melalui siber atau telefon seluler  secara khusus memang telah diatur dalam Undang-undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Akan tetapi perlindungan tersebut hanya diberikan kepada seseorang yang berposisi sebagai konsumen. Sedangkan terhadap seseorang yang berposisi sebagai pelaku usaha atau mitra usaha, atau seorang lain yang menjadi korban penipuan melalui telepon seluler belum dijamin hak perlindungan hukumnya karena ganjalan frasa Konsumen.

Abstract

The practice of prostitution, which grew rapidly and massively through electronic means of information dissemination, impacted various groups. The worst impact of the massive practice of prostitution was the spread of sexually transmitted diseases, which adversely affect the health of both individuals directly involved in prostitution and those whose partners engage in such activities. This study aims to find out the regulation of prostitution within the current Indonesian criminal law and to provide an overview for legislators in the formation of prostitution regulations in the future. Furthermore, it needs to elucidate the reasons behind the necessity of regulating prostitution in Indonesia. The research method employed was legal research of a normative type. This research using secondary data obtained through library research and studies of laws and regulations. The analytical method used in this study was a prescriptive analytical technique. The results of this study revealed that currently there were no regulations governing the practice of prostitution in Indonesia rigidly and clearly. Therefore, it is necessary to criminalize and reformulate the offense of prostitution in Indonesian Criminal Law to avoid the effects arising from the act of prostitution that cause potential victims due to the spread of sexually transmitted diseases.

Abstract

This research is used to answer two problem formulations. First, what is the human rights approach to overcoming the dangers of mining in Indonesia. Second, how is law enforcement against the negative impacts of mining in Indonesia. The research method used in normative juridical research. The data used is secondary data by examining primary legal materials in the form of statutory regulations related to this issue and secondary legal materials in the form of articles or scientific papers, as well as tertiary legal materials. This research was analyzed using qualitative descriptive analysis after the data was obtained. The results of this research focus on two conclusions. The state is primarily obligated to protect and respect human rights as the fundamental rights of every individual. International legal instruments such as the ICCPR, UDHR, and CAT regulate state obligations regarding human rights, while at the national level, they are regulated in statutory regulations. As a legal state, Indonesia is also obliged to protect human rights, including the right to live in prosperity, a good and healthy environment, and health services. Mining is an activity that has a direct impact on the environment. Although the mining sector contributes to state income and employment, it is often associated with problems of environmental degradation. Administrative sanctions that can be imposed for violations in mining include written warnings, fines, temporary suspension of activities, and revocation of permits. The Minerba Law also regulates criminal sanctions, including imprisonment and fines.
