Abstract

Covid-19 di Indonesia membuat perekonomian nasional memburuk, sehingga angka pengangguran kian membludak, sebab buruh perusahaan terpaksa diberhentikan karena debitur tidak sanggup membiayai gaji mereka. Keadaan terpaksa ini disebut dengan force majeure, merupakan keadaan dimana perusahaan tidak lagi mampu membayar upah pekerja. Tujuan penelitian ini untuk menganalisis perlindungan hukum bagi tenaga kerja dari tindakan PHK perusahaan. Penulis tertarik mengkaji, Siapakah Pihak yang menanggung kerugian karena keadaan Force Majeure terhadap pekerja pada masa pandemic Covid-19?, Bagaimana Perlindungan Hukum Terhadap Pekerja Atas Perjanjian Kerja Waktu Tertentu pada masa Covid-19?. Dalam situasi ini, diperlukan kebijaksanaan perusahaan, kelegowoan pekerja agar jernih dalam menyikapi situasi ini.Kata kunci: Force majeure, buruh, dan perusahaan

Abstract

This study analyzes the verdict in the Ferdy Sambo case through the lens of Critical Theory and Habermas' deliberative democracy to understand how law operates within power structures. Using a qualitative, critical-legal approach based on Habermas' framework, it examines court decisions, media reports, and institutional dynamics. The findings reveal that law is influenced by political and institutional dynamics rather than being fully neutral. The Supreme Court’s reduction of Ferdy Sambo’s sentence from death to life imprisonment reflects institutional compromise to preserve social stability and the police’s image. Technological manipulation, such as CCTV footage deletion, and public and media pressures during the trial further illustrate how legal communication is distorted by power relations. The study highlights the need for legal reforms beyond procedural aspects, emphasizing more democratic and inclusive communication mechanisms. Referring to Habermas' theory, it stresses that transparency and accountability are crucial to prevent law from merely legitimizing elite interests and to promote law as a means of social emancipation

Abstract

This study aims to analyze the legal implications of Constitutional Court Decision No. 90/PUU-XXI/2023 concerning the minimum age requirement for presidential and vice-presidential candidates under Article 169 (q) of the Election Law, viewed as discriminatory against younger candidates with leadership potential. Using a post-positivist approach within the Guba and Lincoln paradigm, this research examines the Court’s role in either upholding or reforming legal norms to align with social dynamics. The method employed is a literature study and qualitative analysis, describing the post-positivist perspective in legal philosophy as a foundation for evaluating the constitutionality of the age requirement. The findings indicate that the Court proposes an alternative criterion—leadership experience as a regional head—as a substitute for the minimum age requirement, considering relevant social changes. The post-positivist approach emphasizes that law is not a static system but a social construct that must adapt to moral and cultural contexts. In conclusion, legal norms must be flexible and capable of re-evaluation in evolving social situations to maintain fairness and relevance in democratic processes. This decision demonstrates that Indonesia’s legal framework needs to accommodate youth participation in government without imposing discriminatory restrictions.
