Abstract

The objective of this research is to examine how the polemics of the proprietary rights of apartment units are provided by the government for foreign nationals who temporarily reside in Indonesia to encourage the improvement of investment, especially in the property sector. This research employed normative-juridical methods by conducting library research involving books, journals or scientific articles, internet media, and statutory approach involving Law No. 20 the year of 2011 regarding Apartment Units, the Law on Job Creation. This research has learned that the Proprietary Rights granted by foreign nationals staying in Indonesia refer to property rights to own apartment units or apartment unit spaces, excluding the land underneath based on land rights, namely Proprietary Rights, Building Rights, and Usufructuary Rights. Granting the status of Proprietary Rights means that the foreign nationals who obtained apartments have the same rights as Indonesian citizens do. The ownership status of Property Rights is granted to foreign nationals. The government in its program of providing apartments for the Low-Income Communities (LIC) should also give legal certainty to the communities.  Due to the large number of investors entering Indonesia, it is feared that procurement of apartments for the LIC will be marginalized by the construction of Apartments special for foreign nationals.  Therefore, the government should determine which areas may be allowed for foreign nationals’ ownership, where in fact the expansion of this proprietary status is an implication of the economic sector for business interests in the property sector.

Abstract

This study analyzes the verdict in the Ferdy Sambo case through the lens of Critical Theory and Habermas' deliberative democracy to understand how law operates within power structures. Using a qualitative, critical-legal approach based on Habermas' framework, it examines court decisions, media reports, and institutional dynamics. The findings reveal that law is influenced by political and institutional dynamics rather than being fully neutral. The Supreme Court’s reduction of Ferdy Sambo’s sentence from death to life imprisonment reflects institutional compromise to preserve social stability and the police’s image. Technological manipulation, such as CCTV footage deletion, and public and media pressures during the trial further illustrate how legal communication is distorted by power relations. The study highlights the need for legal reforms beyond procedural aspects, emphasizing more democratic and inclusive communication mechanisms. Referring to Habermas' theory, it stresses that transparency and accountability are crucial to prevent law from merely legitimizing elite interests and to promote law as a means of social emancipation

Abstract

In Indonesia, the participation of child victims in criminal proceedings remains highly constrained. Courtroom questioning still centers on extracting material facts, while the psychological, emotional, and developmental harm inflicted by crime receives scant judicial attention. This article analyzes whether embedding Victim Impact Statements (VIS) in juvenile proceedings could correct that imbalance. Using a normative‑juridical methodology that combines statutory interpretation, doctrinal analysis, and comparative research, the study reviews VIS implementation in the United States, Canada, England and Wales, and South Africa, and tests its coherence with Indonesia’s Law No. 11 of 2012 on the Juvenile Criminal Justice System (JCJS Law). The comparative findings demonstrate that VIS offer a structured, low‑cost channel for children and their guardians to describe the multidimensional fallout of crime, thereby enriching judges’ sentencing rationales and promoting restorative outcomes. Evaluations in those jurisdictions also show that VIS boost victim satisfaction and enhance perceived legitimacy of the courts. To harness these benefits, the paper proposes amending the JCJS Law to require judges to solicit and consider VIS in every juvenile case involving a child victim. Procedural safeguards-mandatory psychological assistance, child‑friendly language,  closed‑court delivery options, and trauma‑informed questioning are recommended to prevent secondary victimization.Codifying these protections would close a normative gap, align national law with both the U.N. Convention on the Rights of the Child and Sustainable Development Goal 16 on justice, and support Indonesia’s broader commitment to child‑centered jurisprudence. Ultimately, institutionalizing VIS can transform victims from passive evidence providers into active rights holders whose voices shape fair, balanced, and developmentally sensitive judicial decisions.

Abstract

Neurolaw offers an innovative interdisciplinary framework that bridges the gap between neuroscience and legal theory and providing new insights into how human brain influences behavior, intention, and moral decision-making. This study examines the intersection of neurolaw and Islamic law, emphasizing the importance of integrating neuroscience findings, such as brain function, decision-making processes, and mental disorders, into Islamic law’s understanding of criminal responsibility, intention (niyyah), and reasoning (ʿaql). This study demonstrates the potential of neurolaw to strengthen empathy, justice, and an evidence-based legal approach in Islamic law using normative legal research methods through legislative, conceptual, comparative, and futuristic approaches. Furthermore, this study explores how Islamic law’s values of justice, objectivity, and responsibility can serve as ethical guidelines for the responsible use of neuroscience in legal reasoning. Ultimately, this study encourages a careful and principled integration of brain science and Islamic law that maintains fundamental Islamic values while embracing scientific advancements to create a more holistic and humane justice system.

Abstract

Literacy, when taken literally, refers to a person's capacity to read and write. People who can read and write are often referred to as literate, while those who are illiterate are referred to as illiterate. Descriptive research methods are used by the author in making this scientific article. The results of the research show that Surabaya, as the first literacy city in Indonesia, has implemented various strategies and initiatives to encourage interest in reading and turn reading into a tradition in society. The literacy program in Surabaya provides positive benefits for the community, by increasing interest in reading, participating in conversations, and developing reading habits. a well-organized literacy movement program has been implemented in the city of Surabaya since 2014, according to a compilation of research articles about the government's goal to make Surabaya a city of literacy. The government's approach to a series of literacy initiatives in Surabaya City seems to have succeeded at the habituation and development stage). Internal and external factors can be used to demonstrate this. Internal factors include lack of interest and motivation in reading for Surabaya residents and inadequate library room infrastructure, which includes incomplete books, outdated books, sloppy bookkeeping, and lack of funds that have not been utilized optimally. The external factor itself comes from family support, which fully supports the existence of literacy programs in this city which aims to foster literacy culture and support for the literacy program of Surabaya City in assisting the implementation of literacy programs. Therefore, it can be claimed that the government's strategy to create a literacy city in Surabaya City is weak or has not been fully realized. Keywords: Strategy; Government; Literacy
