Abstract

Abstract Wasîat wajîbah is a study of contemporary Islamic family law, which emerged as an answer to the problem of inheritance in diverse Indonesian society due to the existence of heirs (relatives) who do not receive tirkâh from the deceased because of the sharia prohibition on accepting it. inheritance, for example, inheritance for adopted children, and stepchildren, grandchildren of daughters and husband and wife who have different religions or are apostates. Conditions like this cannot be separated from the reality of social conditions in society, including norms, structures, and traditions passed down from generation to generation that have existed for a long time (living law). The granting of inheritance rights to them through the wajîbah will institution merely accommodates local wisdom to maintain justice for Muslims in Indonesia. This research examines the main problem, namely whether the legal instrument of granting inheritance rights using a mandatory will is an appropriate alternative. This research uses a method called analytical descriptive. From this research, results were obtained which show that the use of the wajîbah will institution to resolve new cases in inheritance law has a juridical reason by using the concept of justice to guarantee legal certainty for adopted children, stepchildren, grandchildren of daughters and husband and wife, of different religions because inheritance is prohibited. Abstract

The background of this study is that there are still problems in fulfilling women's rights after divorce, especially default decisions. Even default decisions for imposing obligations on ex-husbands to their wives are relatively minimal and almost ignored. Even if there are any, their implementation could be better because ex-husbands do not fulfil their obligations voluntarily. If executed, the costs incurred are more significant than the husband's obligations imposed in the decision, and there is no interconnection of systems between related institutions. This study aims to determine the considerations of judges at the Cimahi City Religious Court in granting the rights of women in default and to what extent these rights can be fulfilled and their implementation. In answering these problems, the theory used is the mubádalah theory. The study results indicate that a breakthrough is needed so that every divorce decision contains the ex-husband's obligations to the ex-wife as long as it has not been nusyúz. To facilitate its implementation, an interconnection system is needed between institutions that can guarantee the fulfilment of women's rights after divorce as women who are facing the law.

Abstract

One form of legal act of a person or legal entity is called wakif. It is separating or handing over part of his property to be used and institutionalized forever or for a certain period of time according to his interests for the purposes of worship or public welfare, therefore wakif cannot be canceled. The purpose of this study is to determine the legal reasons so that wakif cannot be canceled from the perspective of the Religious Court's decision. This topic is interesting to study further even though the regulations are clear. There are still lawsuits for the cancellation of wakif that reach the legal realm. This research method uses a formal legal approach with analytical descriptive specifications. The source of research data was obtained from primary and secondary legal materials with data collection techniques from various libraries and literature studies. Data presentation is through descriptive, and the author's analysis method is through qualitative analysis. The results of the study indicate the need for the principle of legal certainty in wakif because wakif no longer has a legal bond with the wakif and returns to being the right of Allah SWT, and the wakif is not included as a legal subject in a lawsuit for the cancellation of wakif. The contribution of this study is to analogize wakif with a grant, by revoking or canceling a waqf. The law of canceling a waqif includes acts that are not permitted.

Abstract

Nusyúz is a classical conception codified as a standard law written in Qs. an-Nisáa’ verses 34 and 128. The conventional fiqh perspective of nusyúz connotes the wife’s disobedience to her husband, because it is influenced by the patriarchy of pre-Islamic Arab culture. Presidential Instruction Number 1 of 1991 concerning the Compilation of Islamic Law in Indonesia mentions nusyúz in Articles 80, 84 and 125, only regulates the wife’s nusyúz and its legal sanctions, while the husband’s nusyúz is not mentioned. There is ambivalence, ambiguity and legal injustice for the wife. The focus of this research is the concept of nusyúz in KHI from a gender perspective and its correlation with the development of family law in Indonesia. This type of research is library research with a gender equality analysis approach. The results of this study indicate that it is necessary to rearrange the concept of nusyúz in the KHI, including the modern era understanding of nusyúz and adding the husband's concept of nusyúz and its legal sanctions in KHI.Keywords:     Nusyúz Modern Era, Gender Perspective, Justice.

Abstract

Latar belakang penelitian ini adalah Masa remaja merupakan masa yang penting, karena masa ini merupakan masa peralihan, masa mencari jati diri, masa di mana individu menginginkan kebebasan, mencoba sesuatu yang baru, dan mudah terpengaruh, atau disebut dengan masa yang labil. Dengan adanya lokalisasi KM 10 Loa Janan yang Letak awalnya jauh dari lingkungan Masyarakat sekarang sudah berubah berdampingan dengan rumah penduduk, maka tidak menutup kemungkinan akan memberikan dampak moral untuk remaja yang tinggal di lingkungan sekitar lokalisasi.Tujuan penelitian ini adalah untuk mengetahui status hukum perizinan lokalisasi Km 10 Loa Janan serta bagaimana Hukum Islam Memandang Keberadaan Lokalisasi Pekerja seks Komersial dan mengetahui dampak bagi remaja terhadap Keberadaan Loakalisasi. Penelitian ini merupakan penelitian Normatif-Empiris, dengan metode kualitatif dan jenis deskriptif, yaitu jenis penelitian yang berusaha menggambarkan dan menjabarkan gejala-gejala yang terjadi dalam lokalisasi komplek pekerja seks komersia (PSK) di Desa Purwajaya Kabupaten Kutai Kartanegara meliputi pencarian data dan analisis data. Teknik pengumpulan data dilakukan dengan cara library research dan field work research yaitu observasi, wawancara langsung dengan responden dan penelitian arsip-arsip serta dokumen yang ada pada kantor Desa Purwajaya. Sumber data diperoleh dengan menggunakan teknik purposive sampling dan accidental sampling. Hasil penelitian disimpulkan bahwa lokalisasi merupakan tempat aktifitas prostitusi. Prostitusi di Indonesia dilarang di atur dalam KUHP yakni Pasal 295, Pasal 296, Pasal 297, Pasal 506, dan Pasal 284 yang bisa digunakan untuk kasus tertentu. Adapaun adanya dampak bagi remaja yang di timbulkan dari adanya lokalisasi Km10 yaitu berdampak terhadap Moral remaja, berdampak terhadap perkembangan sosial dan Psikologinya. Dalam Hukum Islam Prostitusi merupakan dosa besar sehingga tindakan prostitusi dilarang, larangan tersebut tercantum dalam Al-Quran surah Al-Isra '17: 32. Q.S An-Nisa; 24:33, QS An-Nur 24 : 2. Hukuman bagi para pelaku prostitusi dalam hukum islam yaitu Jilid dan rajam.

Abstract

This study examines the interpretation of the meaning of walad and its implications for the inheritance status of girls from the perspective of Religious Court decisions. The term walad in the Qur'an and Islamic jurisprudence is often understood generally as 'child', but there are differences in interpretation among scholars regarding the scope of its meaning, whether it includes only boys or also girls. This difference in understanding has implications for the distribution of inheritance rights, particularly in the context of equality between boys and girls. This study uses a qualitative approach with normative legal research methods through a study of tafsir literature, classical fiqh books, and an analysis of several relevant Religious Court decisions. The results show that some Religious Court decisions interpret walad inclusively, namely to include both boys and girls, in line with the principles of justice and protection of rights in contemporary Islamic law. The implication of this interpretation is the strengthening of the legal position of girls as legitimate heirs and entitled to receive a share in accordance with the provisions of the Qur'an. This study emphasizes the importance of contextualizing the meaning of walad in religious court practice to align with the values ​​of gender justice and the development of modern Islamic law.
