Abstract

Tujuan penelitian menganalisis efektivitas penerapan pembuktian terbalik dalam penegakan hukum tindak pidana gratifikasi di Pengadilan Negeri Makassar, dan 2). Untuk mengetahui serta mengidentifikasi faktor yang mempengaruhi efektivitas penerapan pembuktian terbalik dalam penegakan hukum tindak pidana gratifikasi di Pengadilan Negeri Makassar. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian penulis mendapatkan bahwa: 1). Efektivitas penanggulangan pembuktian terbalik dalam penegakan hukum tindak pidana korupsi gratifikasi di Pengadilan Negeri Makassar kurang berjalan efektif. Hal ini disebabkan oleh belum adanya aturan yang jelas terkait penerapan sistem tersebut dalam hukum Indonesia. 2). Faktor yang mempengaruhi efektivitas penanggulangan pembuktian terbalik dalam penegakan hukum tindak pidana korrupsi gratifikasi di Pengadilan Negeri Makassar, dipengaruhi oleh tiga faktor: substansi hukum, struktur hukum, dan budaya hukum.. The research objective is to analyze the effectiveness of applying reverse evidence in enforcing the law on gratification crimes at the Makassar District Court, and 2). To identify factors that influence the effectiveness of applying reverse evidence in law enforcement for criminal acts of gratification at the Makassar District Court. This type of research is empirical juridical. The author's research results found that: 1). The effectiveness of countering reverse evidence in law enforcement regarding criminal acts of corruption in gratification at the Makassar District Court is less effective. The absence of clear regulations regarding the implementation of this system in Indonesian law causes this. 2). Factors that influence the effectiveness of overcoming reverse evidence in law enforcement for criminal acts of corruption and gratification at the Makassar District Court are influenced by three factors: legal substance, legal structure and legal culture.

Abstract

Marriage in Islam aims to create a harmonious family rooted in the principles of sakinah (tranquility), mawaddah (love), and rahmah (compassion). However, a limited understanding of spousal rights and obligations—especially in Simpang Kiri Subdistrict, Subulussalam City, Aceh—often leads to conflicts that can culminate in divorce. This study analyzes the local community’s perceptions and practices regarding marital rights and obligations as outlined in Surah Al-Nisa’, verse 34, while also evaluating the impact of local customs on household dynamics. Employing a qualitative field research approach, data were gathered through semi-structured interviews and observations with community members, religious leaders, and officials from the local Office of Religious Affairs (KUA). The findings indicate that the community’s understanding of spousal rights and obligations primarily focuses on tangible aspects such as financial support and mahr (dowry), often overlooking the essential Islamic values of justice and compassion. Additionally, local customs significantly shape marital practices, frequently resulting in inconsistencies with Islamic principles. This study recommends enhancing religious education and fostering collaboration between religious institutions and community leaders to deepen the understanding of marital roles in accordance with Islamic teachings.
