Abstract

The escalation of divorce lawsuits has become a significant problem that must be addressed. The high number of divorce cases is clear evidence that the purpose of marriage is not being achieved. It is urgent to pay attention to the strong reasons for the occurrence of divorce lawsuits, as this can form the basis for policy-making, particularly concerning the concept of a strong bond in marriage. This research aims to understand the indicators of the causes of divorce lawsuits and to investigate the consequences and control of those involved in divorce cases. The study is a qualitative descriptive field research with juridical, normative theological, and sociological approaches. The data management used includes data reduction, data presentation, and drawing conclusions. The data analysis results depict a substantial escalation of divorce lawsuits in The Religious Court Class 1A in Watampone over time, with a higher incidence of divorce lawsuits compared to divorce by talak. The factors influencing divorce lawsuits in the Religious Court include moral factors, causing harm, underage marriage, ongoing disputes, biological defects, lack of harmony, all supported by situations of "inability" and "unwillingness" to fulfill rights and obligations in marriage. Divorce lawsuits have a negative impact on both parties and their descendants. Psychologically, it affects the children and the wife, socially it affects the husband and wife due to their status as widows and widowers, and economically it affects the wife's finances, which were previously supported by the husband.

Abstract

AbstractE-commerce business has become an interesting phenomenon in recent years. With advances in technology, the internet and digital platforms, the e-commerce business model is growing rapidly. One of the most popular business models in e-commerce is the dropshipping system. The dropshipping system is a business model in which the seller does not store or manage the stock of goods sold. Instead, the seller works with a supplier or manufacturer who will ship the goods directly to the customer on the seller's behalf. In this model, the seller acts as an intermediary between the supplier and the customer, managing the sales process and making a profit on the difference in selling prices. This study aims to examine the suitability of the dropshipping system with sharia principles. The research method used in this research is descriptive qualitative. The results of the study indicate that the mechanism implemented in the dropshipping concept has similarities with aqad bai' as-salam. Therefore, the sale and purchase of the dropshipping system in terms of Islamic law is permissible. In addition, the dropshipping system makes it easy for everyone. This is in accordance with Islamic teachings in the field of mu'amalah.Abstrak Bisnis e-commerce telah menjadi fenomena yang menarik dalam beberapa tahun terakhir. Dengan kemajuan teknologi, internet dan platform digital, model bisnis e-commerce semakin berkembang pesat. Salah satu model bisnis yang populer dalam e-commerce adalah sistem dropshipping. Sistem dropshipping adalah suatu model bisnis di mana penjual tidak menyimpan atau mengelola stok barang yang dijual. Sebaliknya, penjual bekerja sama dengan pemasok atau produsen yang akan mengirimkan barang langsung kepada pelanggan atas nama penjual. Dalam model ini, penjual bertindak sebagai perantara antara pemasok dan pelanggan, mengatur proses penjualan dan mendapatkan keuntungan dari selisih harga jual. Penelitian ini bertujuan untuk menelaah kesesuaian sistem dropshipping denganprinsip syariah. Metode penelitian yang digunakan dalam penelitian ini adalah kualitatif deskriptif. Hasil penelitian mengindikasikan bahwa mekanisme yang dijalankan dalam konsep dropshipping memiliki kesamaan dengan aqad bai’ as-salam. Oleh karena itu, jual beli sistem dropshipping ditinjau dari segi hukum Islam hukumnya boleh. Selain itu, sistem dropshipping memberikan kemudahan bagi semua orang. Hal tersebut sesuai dengan ajaran Islam dalam bidang mu’amalah

Abstract

Safeguarding constitutional rights in regional elections is essential to Indonesia’s democratic integrity. This study analyzes the handling of violations in the 2024 Bone Regency election, focusing on the effectiveness and challenges of the Election Supervisory Board (Bawaslu). Employing a qualitative juridical-empirical approach, data were obtained from regulations, official reports, and interviews. Of 19 alleged violations, only 11 were registered as most reports failed to meet procedural requirements. Electoral criminal offenses dominated, while administrative violations were minimal. Bawaslu’s effectiveness was constrained by limited resources, short deadlines, and weak institutional coordination. Constitutional Court Decision No. 104/PUU-XXIII/2025, which elevated Bawaslu’s recommendations to binding decisions, reinforced its role in protecting voters’ rights. The study concludes that electoral oversight functions as a constitutional safeguard for electoral justice. It recommends strengthening institutional capacity, expanding digital monitoring, and enhancing public legal literacy to sustain democratic integrity.
