Abstract

The Narcotics crimes are special crimes outside the Criminal Code, this is stated explicitly in Article 25 of Government Regulation Number 24 of 1960 which came into effect on June 9 1960 concerning the investigation, prosecution and examination of criminal acts. Special criminal law is criminal law established for special groups of people, including military criminal law (special groups of people) and fiscal criminal law (special actions) and economic criminal law. The formulation of the problem in this study is how the how to analyze the legal aspects related to special narcotics crimes as extraordinary crimes and what are the negative impacts related to special narcotics crimes on victims as extraordinary crimes. The research method used by the author is normative juridical method carried out through literature studies that examine secondary data in the form of laws and regulations relating to narcotics, and narcotics crime laws as well as research results and other references. This research uses a type of normative legal research because of the provisions regarding the analysis of narcotics crimes as extraordinary crimes. The results of this study are in With the existence of laws, criminal law is born. The formation of statutory sanctions is determined by the legislator which requires the realization of an agency in ways that can actually apply or implement the criminal regulations in question. To realize this crime, infrastructure is needed. Criminal sanctions aim to provide special suffering to violators so that they are deterred by the consequences of their actions. Criminal sanctions are also a form of statement of condemnation of the perpetrator's actions. The principle difference between criminal sanctions and criminal sanctions is also often referred to as the presence or absence of blame, not the presence or absence of the element of suffering. Meanwhile, action sanctions have a more educational purpose. Narcotics crime is a dangerous crime, damaging the younger generation as well as the character and physique of society or its users. These crimes can also be linked to a number of crimes, such as robbery, theft, money laundering and terrorism. Therefore, the consequences of narcotics use not only have a negative impact on the user himself but also directly or indirectly affect the family, community and country. This narcotics crime has been going on since the era of independence until now.

Abstract

Konsep hirarki kepemimpinan di lembaga pendidikan, kepala sekolah adalah diantara pemimpin di tingkat mikro, skop kapasitas kepemimpinanya berada di tingkat sekolah. Sebagai pemimpin yang levelnya langsung bersentuhan dengan masyarakat, sejatinya mampu memerankan berbagai strategi dikehidupan sosal masyarakat. Kecakapan komunikasi, interaksi dan kolaborasi terhadap kehidupan di masyaraka adalah suatu keharusan. Namun demikian, tugas fokok utama kepala sekolah, tentunya masyarakat yang ada di sekolah itu sendiri, seperti para dewan guru, staf, peserta didik sampai dengan mitra kerjanya yaitu komite pendidikan. Sebagai penanggung jawab keberhasilan para peserta didik, memperoleh ilmu pengetahuan, yang bermuara pada output siswa, kunci keberhasilan utama kepala sekolah adalah mencitptakan guru yang profesional dan bermutu. Untuk merealisasikan hal tersebut kepala sekolah jangan trpaku pada rutinitas semata, namun penting technical skills dan strategi yang mumpuni. Pemikiran strategis adalah kompetensi melihat peluang pasar, ancaman, kelemahan serta kekuatan yang dimiliki adalah suatu keniscayaan kompetensi kepala sekolah. Kebutuhan potensi tersebut sebagai wujud keseriusan dalam mengabdikan diri sebagai seorang ladear di suatu instansi, karena boleh jadi atau tidak menutp kemungkinan, orang-orang yang dipimpin, dalam hal ini para dewan guru khususnya, etos kerja mereka menjadi stagnan bahkan depresiasi. Maka untuk mengantisipasi hal sedemikian, etos kerja perlu digalakkan dengan berbagai strategi alternatif dan menciptakan brbagai variasi, seperti kompensasi reward and recognition, pola komunikasi interpersonal, bahkan sampai memperhatikan kehidupan pesonal pribadi mereka. Untuk objektivitas strategi dengan membuat pelatihan, workshop untuk pengembangan secara kontinuitas. Hasil penelitian menunjukkan bahwa, 1). Persoalan kepala sekolah abai dalam memperhatikan kebutuhan personal para guru, 2). Kepala sekolah apatis mengasah wawasan strategi membngun etos kerja guru, 3). Memberikan konvensasi (reward and recognition) responsif meningkatkan etos kerja guru.

Abstract

The era of economic globalization requires Indonesia to adapt its environmental legal instruments to the increasingly complex dynamics of international trade. The regulatory transformation through Law No. 6 of 2023 on Job Creation has shifted the paradigm from an “environmental permit” system to an “environmental approval” system, while the implementation of carbon taxes through Law No. 7 of 2021 and various related conservation regulations presents new challenges in balancing economic competitiveness and environmental protection. This study aims to analyze the effectiveness of Indonesia's environmental legal instruments in meeting international environmental standards such as the EUDR and CBAM. The research method employs a normative legal approach using library research techniques, examining primary legal sources such as the latest laws and their implementing regulations, as well as secondary sources from academic literature and international reports. The results of the study show that environmental regulatory transformation creates a paradox between deregulation to attract investment and increasing environmental standards demanded by the global market. The implementation of a carbon tax at a rate of Rp30,000 per ton of CO2e and a carbon trading mechanism shows progressive steps but is still limited in scope. The development of synergies between conservation and trade requires strengthening the Payment for Environmental Services scheme and sustainable product certification. The study's conclusions emphasize the need for a more balanced policy reorientation and a holistic approach to integrate economic, social, and environmental aspects in addressing the dynamics of international trade that prioritize sustainability principles.
