Abstract

Penelitian ini mengkaji tanggung gugat antara dokter dengan rumah sakit kepada pasien pada kegagalan pelayanan medis di rumah sakit. Akhir-akhir ini sengketa antara dokter dengan pasien sering terjadi, bahkan dari beberapa konflik tersebut melibatkan rumah sakit sebagai salah satu sarana kesehatan, tempat dokter tersebut mengabdikan diri turut digugat. Fokus penelitian ini ada 2, pertama apakah yang menjadi penyebab terjadinya sengketa antara dokter dengan pasien di rumah sakit? dan kedua bagaimana bentuk pertanggungjawaban dokter dan rumah sakit terhadap pasien dalam pelayanan medis di rumah sakit? Penyebab terjadinya sengketa antara dokter dengan pasien di ruah sakit karena kesenjangan antara harapan dan kenyataan yang diperoleh oleh pasien dalam pelayanan medis. Hal ini disebabkan hasil upaya medis bersifat uncertainly yang tidak dapat diperhitungkan secara matematik dan akibat adanya kesalahpahaman dalam komunikasi antara dokter dengan pasien. Rumah sakit ikut bertanggungjawab jika terjadi kegagalan dalam pelayanan medis di rumah sakit berdasarkan doktrin Vicarious Liability dan berdasarkan Psal 1367 Kitab Undang-Undang Hukumm Perdata

Abstract

The relationship between doctor and patient is not equal. The relationship between doctor and patient gave birth to the legal aspects of which object of inspanningsverbintenis is maximum efforts for the recovery / maintaining the health of patients which performed with caution based on the knowledge and experience of the doctor to seek recovery of the patient. Legal relationship between doctor and patient in medical care effort began when the patient filed a complaint which responded to by a doctor. Doctor’s responsibility in medical services efforts include ethical, professional, and legal responsibility, which covers doctor’s responsibility related to criminal law, civil law and administrative law

Abstract

The Indonesian National Police (POLRI) is responsible for maintaining public security and order, as well as serving and protecting the community. However, there have been instances where members of the police force have clashed with civilians while carrying out their duties. This study employs normative legal research, focusing on secondary data obtained from various sources. The legal methodology approach is utilized to examine relevant regulations and guidelines related to the legal issues at hand. According to Article 2 of Unofficial Law No. 3 of 2003, which pertains to the Specialized Execution of General Legal Foundations for members of the Indonesian National Police, the law enforcement process for police officers is carried out within the procedural regulations applicable in general court proceedings. Thus, if a member of the National Police is reported to have committed a crime, they are processed by the Criminal Investigation Unit. Article 12 (4) of the Police Professional Code of Conduct stipulates administrative sanctions, which include 1) transferring duties to a different position, 2) transferring duties to different areas, 3) honorable discharge, or 4) dishonorable discharge. Transfers of positions and areas serve as administrative sanctions for police officers who have violated the Professional Code of Conduct, involving either demotion (transfer to a lower position) or reassignment to a different place/region. Honorable discharge or dishonorable discharge, on the other hand, are administrative actions taken against police officers who have demonstrated a violation of the Professional Code of Conduct.

Abstract

The overall game plans for pardoning people from the DPR are contained in Article 22 B of the 1945 Constitution of the Republic of Indonesia read "Individuals from the DPR can be excused from office, the circumstances and systems for which are controlled in regulation" and afterward managed further in Regulation Number 17 of 2014 concerning Individuals' Consultative Get together, Individuals' Delegate Gathering, Territorial Agent Chamber, and Local Individuals' Agent Committee (MD3) and Regulation Number 2 of 2008 concerning Ideological groups. In the legal literature in Indonesia which regulates dismissal and replacement between members of the DPR, political parties have a great role in it. Where these guidelines are contained in Article 239 section (2) letter d of Regulation Number 17 of 2014 concerning Individuals' Consultative Gathering, Individuals' Agent Committee, the Territorial Agent Board, and the Local Nation's Agent Chamber expressed that ideological groups can choose individuals from Individuals' Agent Board who comes from the ideological group itself to be excused. Regarding legal regulations like this, it can be said that political parties have an active role in monitoring members of the DPR.

Abstract

Penelitian ini mengkaji peran BPJS Kesehatan dalam mewujudkan hak atas pelayanan kesehatan bagi warga negara Indonesia. Latar belakang penelitian ini adalah masyarakat memerlukan perwujudan HAM dalam pelayanan kesehatan yaitu hak atas pelayanan kesehatan yang belum sepenuhnya terpenuhi terutama bagi masyarakat miskin. Permasalahan dalam penelitian ini adalah sejauh mana peran NPJS untuk mewujudkan hak atas pelayanan kesehatan bagi warga negara Indonesia dan apasaja faktor-faktor penghambat pelaksanaan BPJS Kesehatan bagi warga masyarakat. Metode penelitian yang digunakan adalah normative legal research dengan tipe penelitian diskriptif analitis, lokasi penelitian di Jakarta Hasil penelitian ditemukan Peran pemerintah untuk mewujudkan hak atas pelayanan kesehatan melalui BPJS Kesehatan bagi Warga Negara Indonesia melalui pembentukan suatu Badan Pelayanan Jaminan Sosial (BPJS Kesehatan), Faktor-faktor penghambat pelaksanaan BPJS Kesehatan bagi warga masyarakat diantaranya, masalah tarif dan obat-obatan, kepesertaan, rumit, mutu pelayanan, rujukan, sosialisasi Program BPJS, jamkesmas tidak masuk peserta BPJS

Abstract

The legal relationship between doctors and patients always employs communication as a means to reach a mutual acceptance and understanding of each party. However, miscommunication more often than not happens in that legal relationship, thus producing disputes between doctors and patients. The problem raised in this study is how miscommunication between doctors and patients in medical services can cause medical disputes. The study utilized sociolegal research as its research method, with the location of the research being done in Semarang. The results of the study reveal that miscommunication between doctors and patients can be a cause of disputes due to the distinct gap between expectations and the reality received by patients. This distinctive gap could emerge when there are differences in culture and language between doctors and patients. Therefore, the gap caused by miscommunication is one of the most frequent causes of disputes between doctors and patients in medical services.
