Abstract

YouTuber is one of the jobs that millennials are increasingly interested in. Although the income generated is not still like an employee, but there are some YouTubers who are able to gain income up to  billion as well. A lot of income, becomes a study for the rules of zakat profession, where there are rights that must be excluded from the income obtained. Zakat on profession is part of zakat  mal and becomes a contemporary of fiqh, so a lot of controversion in there. The controversion is part of the prudence of the scholars in establishing the sharia law of zakat on profession, one of which is used  qiyas. This research aims to find out the sharia law of zakat on profession for youtuber by using qiyas of  zakat on gold. This research used a qualitative descriptive approach that focused on the study of literature. The results of the analysis showed that by qiyas of zakat on gold, Muslim YouTubers are obliged to issue zakat on proffesion if the net income obtained if it reaches the nisab of gold, which is 85 grams of gold with a level of 2.5% and reaches haul.

Abstract

Food security can be achieved by the existence of adequate food land. The government has made efforts to implement land protection with the passage of Law No. 41 of 2009 concerning the Protection of Sustainable Food Agricultural Land. The implementation of this law is constrained because it must be further implemented in derivative laws that are the domain of local governments. In addition, the large number of interests related to the use of land for use outside the agricultural sector is also a serious obstacle. This is further complicated by the passage of the Job Creation Law (Ombibus Law) which states that sustainable food agricultural land can be converted to realize public interests or national strategic projects (Article 122). This research is qualitative research with library sources using the analysis of contract theory in fiqh muamalah. The result is that waqf can serve as a safeguard for agricultural land which is now often converted, it can also serve as capital to support the agricultural sector with several contracts such as muzaro'ah, mukhabaroh, ba'i salam, and ijarah. These contracts will intensify productive agricultural activities with a broad distribution of profits. This activity can also be used with non-profit and commercial programs. The agreement is expected to improve food security in Indonesia and, in addition, the welfare of farmers who have been at a low economic level can be improved.Keywords: Food Security; Waqf; Contract; Mu'amalah

Abstract

This research investigates the "Bales nae" tradition within the Sasak community in Lombok, Indonesia. Bales nae is an essential post-wedding ritual where the groom's family visits the bride's family following the merariq ceremonies. This tradition aims to strengthen family bonds, foster mutual respect, and preserve cultural heritage. Using a socio-legal approach and theories from Émile Durkheim and Maqashid Sharia, this qualitative study explores the reasons why the Sasak community maintains this tradition. Data were collected through observation and interviews with 12 key informants, including community members, traditional leaders, and families who have practised Bales nae. The research findings reveal that Bales nae functions to introduce and strengthen relationships among extended families, enhance social cohesion, and preserve cultural heritage. Durkheim's functionalism theory highlights the role of Bales nae in social stability and solidarity, while Maqashid Sharia emphasizes its contribution to preserving religion, life, intellect, lineage, and property. This tradition, with its rich symbolic meaning, underscores the importance of maintaining cultural practices amid modern influences. The study concludes that Bales nae is crucial for reinforcing family and social structures, reflecting the profound significance of traditional rituals within the Sasak community.

Abstract

The interest of Indonesian people in investing in real sector businesses, particularly MSMEs, is relatively low due to high risks and business uncertainties. Unfortunately, Sharia Financial Institutions have not played an active role in channeling cooperation-based financing. Instead, they have mostly focused on channeling murabahah financing under the buying and selling scheme. However, Sharia P2P Lending can help develop the real sector and have a positive impact on the national economy by reducing bureaucracy and complicated requirements. Sharia P2P Lending is an investment platform in real sector businesses that benefits business actors and investors. The use of Sharia P2P Lending can encourage the public to invest in the real sector because of the following reasons: (1) it provides a safe investment with higher returns compared to conventional investments, (2) it offers access to invest in the real sector with relatively small capital, (3) it allows investors to choose business actors and monitor their investment performance, (4) it has relatively low transaction costs and is easy to conduct transactions online, and (5) it provides protection through risk management and financing management policies carried out by the company.

Abstract

This research discusses the concept of economic efficiency from an Islamic perspective, focusing on verses QS. Al-Isra verses 26-29. Economic efficiency in Islam is analyzed through the ethical guidelines and principles contained within these verses. The findings of this study indicate that Islam emphasizes the importance of wise resource management, fair wealth distribution, ethical conduct in transactions, and a balance in the use of wealth. Economic efficiency in Islam also considers social justice and moral values, not solely focusing on profitability. Overall, the verses in QS. Al-Isra verses 26-29 provide guidance on the concept of economic efficiency in Islam, encompassing fair distribution, avoiding waste, emphasizing ethics in every economic transaction, and balancing resource allocation. These principles can help society achieve sustainable economic efficiency while considering moral and social values.

Abstract

This study aims to analyze the regulatory dynamics of Baytul Māl wat Tamwīl (BMT) within the Indonesian legal system, particularly the shift from regulatory fragmentation to legal unification following the enactment of Law Number 4 of 2023 on Financial Sector Development and Strengthening (UU P2SK), as well as its institutional implications for BMT. This research employs a normative legal method using historical, statutory, and conceptual approaches. The findings indicate that prior to UU P2SK, the legal construction of BMT was shaped by the legacy of the concordance principle, which relied on legal entity classification and resulted in fragmented regulation. As a consequence, BMT developed strong social legitimacy at the grassroots level but lacked a solid juridical foundation. Following the enactment of UU P2SK, BMT has been formally recognized as part of the national financial ecosystem, with a regulatory framework based on functional roles and risk exposure through open-loop and closed-loop schemes. This unification has ended regulatory fragmentation, resolved supervisory dualism, and directed BMT toward more accountable governance standards. However, BMT remains vulnerable to identity erosion due to the dominance of tamwīl (commercial) logic, shifting its orientation from community empowerment toward profit and financial stability. The main challenge in the post-P2SK era lies in BMT’s ability to maintain a balance between its māl and tamwīl functions while preserving its foundational ethos and ideological orientation amid increasing demands for professionalism and regulatory compliance.
