Abstract

This ethnography study investigates the sociocultural significance of the Tonggoluan and Pusi’ death rituals that persist in Bolaang Mongondow society despite the threat of modernity. Current understanding ignores its ontological role in preserving the existence of Bolaang Mongondow, so this research aims to explain these traditions as a basis for identity formation and social reproduction through the lens of Victor Turner's symbolic anthropology. Using a rigorous ethnographic field study, data was collected through in-depth interviews and observation of six elders in Bolaang Mongondow. These findings reveal that Tonggoluan graves encapsulate the eternal spiritual connection between living and deceased ancestors. Its sacralization reflects a strong belief in a metaphysical realm that upholds the collective memory of this community. Meanwhile, wearing Pusi’ mourning clothes symbolizes sadness and passing down cultural values from generation to generation. This ritual also builds communal solidarity during mourning, reaffirming Bolaang Mongondow's identity. Essentially, these two traditions combine the temporary and the eternal through the creative reproduction of meaning, forming the basis of local existence. Therefore, maintaining this death ceremony amidst the erosion of modern culture is very important to ensure the continuity of the unique identity of this indigenous community. This encourages a deeper global appreciation of the role of death rituals in strengthening the cultural vitality of the Bolaang Mongondow community group.

Abstract

The problem of poverty is an issue that has existed for a long time and it can almost be said that it will remain an "eternal fact" in life. The definition of poverty itself as a scientific concept was born as a side effect of the term development. Hence, in every discussion about development, the discussion about development, especially the discussion of poverty, gets an important place. Poverty is seen as part of the problem in development, whose existence is marked by unemployment, underdevelopment which then increases into inequality. In this case, this study aims to look for the role of PNPM Mandiri in overcoming community poverty in Islamic urban villages. In addition, this study also examines the impact of PNPM Mandiri on the community in overcoming poverty. Methodologically, this study employed a qualitative method using an analytical descriptive approach. In the meantime, data collection was carried out using three methods, namely in-depth interviews, observations of the processes or results of PNPM Mandiri activities, as well as the collection of relevant documents. In general, this study found that the PNPM Mandiri program in Islamic Kelurahan had been implemented properly. The program implemented included the distribution of revolving funds. Only a portion of the fund disbursement program was actually utilized by the poor. Regarding PNPM Mandiri for overcoming poverty, PNPM Mandiri activities in the form of channeling revolving funds were still not helping the community's economy, because the funds disbursed were small in number while the community's need for business capital was large. For this reason, it had not been able to provide fundamental changes in society.

Abstract

This research examines the integration of Islamic law and psychology within the Indonesian criminal justice system to enhance protection for women victims of violence. Utilizing the domestic violence case of social media influencer Cut Intan Nabila as a case study, this research develops the Islamic-Psychological Judicial Framework (IPJF), which combines principles of Islamic law, understanding of trauma psychology, and best practices in the judicial system. Through juridical-normative analysis and an interdisciplinary approach, this study identifies gaps in the existing system and formulates strategies for IPJF implementation. The findings indicate that IPJF has the potential to increase the effectiveness of case handling, reduce revictimization, and enhance victim recovery. The implementation of IPJF is projected to transform legal culture to become more gender-responsive and victim protection-oriented, as well as serve as a potential model for other Muslim-majority countries.

Abstract

This research investigates the "Bales nae" tradition within the Sasak community in Lombok, Indonesia. Bales nae is an essential post-wedding ritual where the groom's family visits the bride's family following the merariq ceremonies. This tradition aims to strengthen family bonds, foster mutual respect, and preserve cultural heritage. Using a socio-legal approach and theories from Émile Durkheim and Maqashid Sharia, this qualitative study explores the reasons why the Sasak community maintains this tradition. Data were collected through observation and interviews with 12 key informants, including community members, traditional leaders, and families who have practised Bales nae. The research findings reveal that Bales nae functions to introduce and strengthen relationships among extended families, enhance social cohesion, and preserve cultural heritage. Durkheim's functionalism theory highlights the role of Bales nae in social stability and solidarity, while Maqashid Sharia emphasizes its contribution to preserving religion, life, intellect, lineage, and property. This tradition, with its rich symbolic meaning, underscores the importance of maintaining cultural practices amid modern influences. The study concludes that Bales nae is crucial for reinforcing family and social structures, reflecting the profound significance of traditional rituals within the Sasak community.

Abstract

This study aims to explore the role of Progressive Islamic Education in women's empowerment from the perspective of Suud Sarim Karimullah. It employs a qualitative research methodology, focusing on a literature review that includes an analysis of the works of Suud Sarim Karimullah and related literature, such as relevant books and journals, analyzed based on structuralism theory. This study demonstrates that Progressive Islamic Education, which combines fundamental Islamic principles with modern values such as gender equality and human rights, can enhance women's access to quality education. This education not only empowers women in terms of education but also increases their participation in the workforce and political decision-making. Additionally, Progressive Islamic Education helps to overcome social and cultural barriers, as well as gender stereotypes that limit women's roles. By involving the Muslim community, including religious leaders and families, Progressive Islamic Education can foster positive change in society. The impact of women's empowerment through Progressive Islamic Education is evident in the improvement of economic well-being, poverty reduction, and increased social stability. Structuralism analysis shows that Progressive Islamic Education can shape social structures that support change, address patriarchal norms, and promote sustainable gender equality. Therefore, from the perspective of Suud Sarim Karimullah, Progressive Islamic Education is an effective tool for women's empowerment and the development of an inclusive and just society.

Abstract

Bilalang Satu Village is a village in Bilalang Subdistrict, Bolaang Mongondow Regency, North Sulawesi, where the majority of residents are Muslim. On several occasions, they have engaged in pawning practices to meet financial needs. Unfortunately, the current pawning practices are deemed non-compliant with Islamic Law, for example: 20% monthly interest rates without time limits, smaller loan amounts compared to the pawned item's value, creditor intimidation during default, and weak legal instruments protecting pawn customers. The community's lack of understanding regarding Sharia pawning further aggravates this situation. This study aims to analyze the Sharia compliance of pawning practices in Bilalang Satu Village and formulate recommendations for reform. The research utilizes a qualitative method with a case study approach. Data collection is conducted through in-depth interviews, observations, documentation review of pawning contracts, and literature review. The collected data is then qualitatively analyzed from an Islamic economic perspective. The results show that asset pawning in this village has minimal compliance with Sharia principles and provisions, making it potentially exploitative and detrimental to villagers. The recommendations formulated include: massive socialization and regulation of Sharia pawning, establishment of a Sharia Pawning Cooperative, as well as sustainable educational and assistance programs. These reform efforts require a participatory approach to be genuinely accepted by villagers. Thus, it is hoped that pawning practices in Bilalang Satu Village will be able to align with the principles of justice in the Islamic economy.

Abstract

Doll claw machine games have become an increasingly popular phenomenon in Indonesia, including in Poyowa Besar Village, Kotamobagu. Although appearing as entertainment, the presence of doll claw machines raises concerns from an Islamic economic perspective due to containing elements of gharar. This research aims to evaluate the practice of doll claw machine games from an Islamic economic perspective, focusing on three aspects: review of gharar transactions, socio-economic implications, and compliance with Islamic economic principles. Using a qualitative approach with case study methods, this research conducted semi-structured interviews with shop owners and parents, participatory observation, and document study. The results show that doll claw machine games contain significant gharar elements in their transaction procedures and business model. The identified socio-economic implications include increased family expenditure burden, changes in children's consumption patterns, and addiction risks. From an Islamic economic perspective, this practice contradicts fundamental principles such as the prohibition of gharar and protection of wealth (hifz al-mal). In conclusion, doll claw machine games in Poyowa Besar Village require re-evaluation and stricter regulation to protect the community from economic practices that do not comply with sharia.

Abstract

The implementation of electronic court systems in Indonesia has gained momentum with the issuance of PERMA No. 7 of 2022 on Electronic Case Administration and Court Proceedings. This study aims to analyze the implementation of e-Court and e-Litigation in the Bitung and Praya Religious Courts, focusing on identifying factors that influence the level of adoption and effectiveness of the system. Using an empirical juridical method with a qualitative approach, this research combines in-depth interviews with 12 key informants (including court presidents, vice presidents, judges, and clerks), direct observation for 3 days in each court, and documentation analysis. The results showed a low level of adoption, with the use of e-Court in Bitung only 9.26% and Praya 8.70%, while e-Litigation was even lower (0.54% in Bitung and 0.23% in Praya). The significant difference in case volume between the two courts (367 cases in Bitung and 3,814 cases in Praya) does not correlate with the level of technology adoption. The main barriers include limited digital infrastructure, low technological literacy and user preference for conventional services. The study recommends the development of a multilevel policy that takes into account local characteristics, the strengthening of digital literacy programs through partnerships with educational institutions, and a tiered incentive system to encourage the use of electronic services.
