Abstract

The study, the Authority of regional government Formation of Regional Regulation (Perda) shari'a aims to assess four legal issues, namely: (1) Establish a Regional Authority Perda Syariah; (2) The criteria of Shariah legislation; (3) The procedure of Legislative Shari'ah; (4) Testing Regulation to shariah. This research is normative by using several approaches, namely: (a) Conceptual Approach (Conceptuan aproach); (B) Approaches Legislation (Statute aproach); and (c) Approach the case (Case aproach). The results of this study are expected bermenfaat either for the development of Science and to assist practitioners in the formation of legislation. The research results are as follows: (1) The Regional Authority to establish Sharia legislation can be found in several laws and regulations, both in the Constitution and in the implementation of such rules in the Act; (2) Criteria Sharia legislation is contained in the contents that are based on the values and teachings of Islam; (3) Procedures establishment of sharia in praktinya regulations following the establishment of regulations in general; (4) review of sharia regional regulation also follow the testing procedures and legislation in general. Forward suggest that the process of formation of Perda Syariah scholars to enroll in the area at least in the process of forming draft local regulations. Similarly, in the process of judicial review and evaluation should be based on the sources of Islamic law and involves an element of religious leaders and religious judges.

Abstract

The PPAT deed is one of the main sources for the maintenance of land registration in Indonesia, which serves to ensure legal certainty of the occurrence of a legal act of transition and the imposition of the Mortgage Rights. The purpose of this study is to analyze the legal implications of PPAT form deed after the enactment of Regulation of the Head of National Land Agency (Agreement) No. 8 of 2012. This research is Normative legal research. This study used a statutory approach, conceptual approach and sociological approach. Technique of collecting legal materials through literature study after that done the processing of legal materials with logical and systematic reasoning and analyzed descriptively qualitative and draw deductive conclusions. Based on the result of research of inconsistency in arranging the form of PPAT deed after the issuance of Regulation of Head of National Land Agency (Agreement) Number 8 Year 2012 and its solution if the rules Regulation of Head of National Land Agency (Agreement) Number 8 Year 2012 which is not in accordance with its application. The existence of Regulation of Head of National Land Agency Number 8 Year 2012 About Amendment of Regulation of State Minister of Agrarian / Head of National Land Agency Number 3 Year 1997 About Regulation of Implementation of Government Regulation Number 24 Year 1997 About Land Registration hierarchically higher position than circular letter. In accordance with the principle of lex superior derogat legi inferior which means higher regulation put aside the low (hierarchy principle) and solution Circular letter issued after Regulation of Head of National Land Agency (Agreement) Number 8 Year 2012 must be revoked / withdrawn.

Abstract

Indonesia dalam konteks mewujudkan demokrasi, AD/ART memiliki kedudukan sangat penting yang berfungsi sebagai alat untuk mengatur sistem pengambilan keputusan dan tata kelola organisasi secara demokratis, adil, dan transparan. Dengan demikian, AD/ART dapat menjadi pedoman bagi suatu organisasi untuk memastikan bahwa seluruh anggota memiliki hak yang sama dalam mengambil keputusan serta dilakukan secara terbuka. Selain itu, AD/ART dapat membantu dalam memastikan bahwa kepentingan seluruh anggota organisasi dilindungi dan dihormati, serta mencegah terjadinya tindakan diskriminasi atau penyalahgunaan kekuasaan. AD/ART juga dapat menjadi alat untuk memastikan akuntabilitas dalam pengelolaan organisasi.

Abstract

This research aims to analyze whether the authority to make deeds of a Notary applies to all forms of agreement and what is the Notary's responsibility for making Deeds of loan agreements (nominees) related to buying and selling land involving foreigners. This legal research method uses normative legal research. The approach used is a statutory approach and a conceptual approach. From this research the author found, firstly, that there is disharmony between article 15 paragraph (1) a of Law number 2 of 2014 concerning amendments to Law number 30 of 2004 concerning the Position of Notaries hereinafter abbreviated as UUJN and Law number 5 of 1960 concerning the Basic Regulations on Agrarian Principles, hereinafter abbreviated to UUPA. Where in article 15 paragraph (1) a UUJN which states that Notaries have the authority to make authentic deeds regarding all deeds, agreements and provisions required by statutory regulations and/or which are desired by interested parties to be stated in authentic deeds, this is often a loophole in a acts of legal smuggling carried out by foreigners and Indonesian citizens and often involving notaries in a loan agreement (nominee) related to the sale and purchase of land involving foreigners, which is contrary to UUPA article 21 which states that only Indonesian citizens can have property rights. Due to this conflict of norms, the authority to make deeds of a notary does not apply to all forms of agreements. Secondly, if the notary is proven to have committed an act of legal smuggling, the notary must be responsible for his actions both civilly, administratively and criminally.
