Abstract

The purpose of this paper is to express the urgency of determining the amount of time deposits by foreign mining companies in Indonesia. The application of time deposits is a manifestation of enforcement of environmental protection carried out by foreign mining companies in Indonesia. Disbursement of funds placed in partner banks that have been determined before the issuance of a Mining Business License (IUP) is based on the projected value of mining production profits as a form of environmental protection if real errors are made by foreign mining companies in relation to environmental management. This research is normative through library studies using secondary data sources, namely using primary legal materials, secondary legal materials, and tertiary legal materials. Data analysis and data validation used source criticism related to the theme of time deposits guaranteed for reclamation and post-mining by foreign mining companies in Indonesia. The results of the study indicate that the old method of determining time deposits based solely on the projected value of mining production profits, is something that is not right. This is because the amount of time deposits placed is sometimes not proportional to the level of environmental damage caused as a result of mining production. A new method is needed to determine time deposits that should be based on the level of environmental damage, both during the mining production process until the end of the company's responsibility for the former mining production area as a form of environmental protection and management. Therefore, the determination of the amount of reclamation and post-mining time deposits based on the level of environmental damage caused by the production of foreign mining companies in Indonesia is deemed necessary as a real effort to improve environmental protection and management in the mining sector in Indonesia.

Abstract

This study analyzes the philosophical dilemma of the implementation of the theory of justice, the problem of the use of land rights between the Amungme Indigenous Tribe and PT Freeport Indonesia. This research is normative legal research using secondary data sources through prescriptive literature studies. The results show that there are problems in the use of land ownership rights; there are contradictions in the use of reasons for claiming ownership rights over the disputed land. The Amungme Adat tribe adheres to the theory of natural law with concrete implementation in the form of traditional customs which considers disputed land as ancestral heritage land, which is the absolute right of the Amungme Adat tribe. Meanwhile, PT Freeport Indonesia uses positivist legal theory with concrete implementation in the form of the use of Contract of Work and Agreement as positive law which is used as a strong basis for claiming ownership rights over the disputed land. In this research, we will discuss the philosophical dilemma of the implementation of the theory of justice comprehensively, the problem of the use of land rights between the Amungme Indigenous Tribe and PT Freeport Indonesia based on the use of the theory of justice. The limitation of this research lies in the study using literature data sources without empirical research. In the future, it is hoped that similar research can use this research as an essential reference in conducting research that can obtain factual data in the field so that it can provide more accurate results.

Abstract

Futsal adalah salah satu olahraga yang membutuhkan keterampilan teknis yang sangat baik, dengan kecepatan, ketangkasan, dan kemampuan pada reaksi menangkap yang cepat khususnya pada seorang kiper. Studi ini menyelidiki pengaruh latihan menggunakan resistance band dan bola tenis terhadap kecepatan reaksi penjaga gawang futsal. Kecepatan reaksi merupakan atribut penting bagi penjaga gawang, karena secara langsung memengaruhi kemampuan mereka untuk merespons tembakan ke gawang dan melakukan penyelamatan krusial. Sebanyak 12 penjaga gawang futsal berusia 15 hingga 20 tahun berpartisipasi dalam studi ini, Penilaian kecepatan reaksi sebelum dan sesudah latihan dilakukan menggunakan tes waktu reaksi standar, yang mengukur waktu yang dibutuhkan penjaga gawang untuk merespons rangsangan visual. Data dianalisis menggunakan uji-t berpasangan untuk menentukan signifikansi intervensi latihan. Hasil penelitian menunjukkan bahwa Kecepatan reaksi yang mengikuti latihan futsal menggunakan resistance band dan bola tenis meningkat sebesar 0,82 dengan nilai signifikansi 0,000 < 0,05. menunjukkan peningkatan yang signifikan dalam kecepatan reaksi, dengan kelompok resistance band dan bola tenis. Temuan ini menunjukkan bahwa menggabungkan latihan resistance band dan bola tenis dapat menjadi metode yang efektif untuk meningkatkan kecepatan reaksi penjaga gawang futsal. Studi ini menyimpulkan bahwa pelatih dan pembina harus mempertimbangkan untuk mengintegrasikan latihan resistance band ke dalam program latihan mereka untuk meningkatkan kinerja penjaga gawang dalam futsal.
