Abstract

The purpose of this paper is to express the urgency of determining the amount of time deposits by foreign mining companies in Indonesia. The application of time deposits is a manifestation of enforcement of environmental protection carried out by foreign mining companies in Indonesia. Disbursement of funds placed in partner banks that have been determined before the issuance of a Mining Business License (IUP) is based on the projected value of mining production profits as a form of environmental protection if real errors are made by foreign mining companies in relation to environmental management. This research is normative through library studies using secondary data sources, namely using primary legal materials, secondary legal materials, and tertiary legal materials. Data analysis and data validation used source criticism related to the theme of time deposits guaranteed for reclamation and post-mining by foreign mining companies in Indonesia. The results of the study indicate that the old method of determining time deposits based solely on the projected value of mining production profits, is something that is not right. This is because the amount of time deposits placed is sometimes not proportional to the level of environmental damage caused as a result of mining production. A new method is needed to determine time deposits that should be based on the level of environmental damage, both during the mining production process until the end of the company's responsibility for the former mining production area as a form of environmental protection and management. Therefore, the determination of the amount of reclamation and post-mining time deposits based on the level of environmental damage caused by the production of foreign mining companies in Indonesia is deemed necessary as a real effort to improve environmental protection and management in the mining sector in Indonesia.

Abstract

The research problems are: first, implementation of open sky policy in the frame of flight service trade liberalization based on Act No. 1 of 2009 on Flight; second, the implication of enactment of open sky policy for Indonesia in the frame of flight service trade.This research is empirical legal research. The data used is primary and secondary data which are analyzed using editing analysis style technique later.This is caused by many factors which are: the government’s lack of preparation in protecting domestic flight industry by not providing clear regulation in determining tariff, the operator’s lack of preparation in conducting flight service, the lack of facility in pursuing open sky. There is economical, social, defense and security implication from the application of open sky policy for Indonesia. However, the most significant implication from these impacts is economy defense, and security implication.

Abstract

Ide mengenai keadilan telah berkembang seiring perkembangan kehidupan manusia, paradigma, dan nilai-nilai yang dianutnya. Dengan demikian, keadilan dapat diartikan berbeda-beda tergantung pada siapa, kapan, dimana, dan dalam konteks apa keadilan dimaknai. Demikian pula halnya yang terjadi pada sistem hukum perdagangan internasional, prinsip keadilan pada sistem perdagangan internasional yang dilakukan di bawah aturan dan prosedur WTO telah memainkan peran yang penting, terutama dalam kaitannya dengan pendistribusian hak dan kewajiban yang bersifat fundamental dan cara menentukan pembagian keuntungan dari kerja sama sosial yang ada didalamnya. Dalam hal ini prinsip keadilan diperlukan dalam rangka menanyakan apakah keputusan sosial yang dihasilkan oleh WTO benar dan konsisten dengan nilai-nilai yang ada di dalamnya. Hasil penelitian menunjukkan bahwa prinsip keadilan yang terdapat dalam aturan WTO mengandung dua makna yaitu makna “the equality of opportunity” dan “keadilan distributif”. Equality of opportunity dapat diwujudkan apabila prinsip reciprocity (timbal balik) ditegakkan baik dalam hal pengurangan hambatan perdagangan, akses pasar, maupun penyelesaian sengketa. Keadilan distributif berarti bahwa perdagangan internasional merupakan sarana untuk mewujudkan hubungan dagang yang saling menguntungkan diantara negara anggota. The Existence of Principles of Justice in International Trade Law System AbstractThe notion of justice has evolved along with the development of human being, paradigms, and their values. Therefore, justice can be interpreted differently, depends on who, when, where, and in what context people define it. It is also the case for the international trade law system. The principle of justice in the international trading system, conducted under the rules and procedures of the WTO, has played an important role; especially in relation to the distribution of obligations and fundamental rights, and the distribution of benefit from social cooperation within. In this case, the principle of justice is needed in order to inquire whether WTO’s social decisions are proper and consistent with the values that exist within The results show that the principle of justice in the WTO rules contains two meanings: “the equality of opportunity” and “the distributive of justice”. The Equality of opportunity can be realized if the reciprocity principle in the context of the reduction of trade barriers, market access, and dispute settlement are enforced. Abstract

AbstractThe purpose of the article are to analyze the development of the meaning of the principle of secret balance confidentiality of HIV / AIDS patients and analyze the ideal construction of its application in Indonesia. It is normative research.  Confidentiality does not change as Hippocrates Oath, including HIV/AIDS confidentiality. Application of the HIV/AIDS confidentiality develops in conformity with the development of values in society and medicine. The obligation to keep this secret is not an absolute obligation but a prima facie, until there is a greater obligation to be undertaken such as to protect the sexual partner or to protect the public interest. This principle of balancing is a generally principle. The Balance of Medical Confidentiality is a certainty of protection for humans, in this case health workers /doctors and PLWHA and also must be able to restore the balance of disturbed community order in the original state. The development of the meaning of the balancing of Medical Confidentiality in HIV/AIDS sufferers has taken place in the effort of combating HIV/AIDS embodied in the principles that include Councelling, Consent, Confidentiality, diagnosis Correct Test with the consequence to Conect to health service to Care Support and Teratment (5C). The ideal construction of the balancing HIV confidentiality is an effort to overcome the still-sensitive issues of high stigma and discrimination against PLHIV and the key population which is an obstacle to the decline in HIV / AIDS rates. The existence of punitive and criminal regulations causes barriers to test in health services. It's should be reviewed or deleted in order to reduce the barriers to the reach of health services in HIV/AIDS cases.Keywords: Balancing:, Confidentiality: HIVAbstrak Tujuan dari artikel ini adalah untuk menganalisa perkembangan makna prinsip keseimbangan  pasien HIV / AIDS dan menganalisa konstruksi ideal di Indonesia. Penelitian bersifat normatif. Kerahasiaan tidak berubah seperti Sumpah Hippocrates, termasuk kerahasiaan HIV / AIDS. Penerapan kerahasiaan HIV / AIDS berkembang sesuai dengan perkembangan nilai-nilai dalam masyarakat dan kedokteran. Kewajiban menjaga rahasia ini bukanlah kewajiban mutlak tapi bersifat prima facie, sampai ada kewajiban yang lebih besar untuk dilakukan seperti melindungi pasangan seksual atau untuk melindungi kepentingan umum. Prinsip keseimbangan ini adalah prinsip umum. Keseimbangan Kerahasiaan Kedokteran merupakan kepastian perlindungan bagi manusia, dalam hal ini petugas kesehatan / dokter dan ODHA dan juga harus mampu mengembalikan keseimbangan ketertiban masyarakat yang terganggu. Perkembangan makna keseimbangan rahasia kedokteran pada penderita HIV / AIDS telah terlaksana dalam upaya pemberantasan HIV / AIDS yang tercakup dalam asas yang mencakup Konseling (Councelling), persetujuan (Consent), kerahasiaan (Confidentiality), test yang benar (Correct Test) dengan konsekuensi dihubungkan ke layanan , dukungan dan terapi (Conect to health service to Care and Treatment). Pembangunan yang ideal untuk menyeimbangkan kerahasiaan HIV adalah upaya untuk mengatasi isu-isu stigma dan diskriminasi terhadap ODHA dan populasi kunci yang merupakan hambatan bagi penurunan tingkat HIV / AIDS. Adanya peraturan hukum yang bersifat punitif dan kriminal menyebabkan hambatan dalam melakukan tes kesehatan. Ini harus ditinjau atau dihapus untuk mengurangi hambatan terhadap jangkauan layanan kesehatan dalam kasus HIV / AIDS.Kata kunci: Menyeimbangkan; Kerahasiaan; HIV

Abstract

Human trafficking and sex slaves are global problems that are very threatening. Southeast Asia is one of the centers of human trafficking activities causing a sense of insecurity in society. This research entitled Human Trafficking and Sex Slaves: How is International Law Enforcement in the Southeast Asian Region seeks to examine how ASEAN and its member countries make and apply international law to eradicate human trafficking. The data collection method used is descriptive qualitative. The results of the research show that there have been many efforts by ASEAN and its member countries against human trafficking. The established conventions and policies are a big boost for the ASEAN community to be aware of and participate in the fight against human trafficking. Abstract

The purpose of this research is to understand the level of harmonization of poverty alleviation regulations and policies in Indonesia within the Millennium Development Goals (MDGs), especially Target 1. From this research, it can be created a model of regulation and polices harmonization of poverty alleviation in Indonesia in order to harmony with the MDGs. To achieve these objectives, data collected by regulation and policies of poverty alleviation in Indonesia, and then it is analyzed with editing analysis style. The results of this research are the policies of poverty alleviation in Indonesia are not harmonious with the MDG target. It is because of the poverty alleviation policies in Indonesia with the MDG target as a result of differences in defining poverty, which is not focused on the definition of poverty used by the MDGs. The definition of poverty according to the MDGs is those who have income less than US$ 1 per day.  Key words: harmonization of regulations and policies, poverty alleviation, Millennium Development Goals

Abstract

Illegal fishing poses a critical threat to maritime sovereignty, undermining national security, ecological sustainability, and economic stability. This study conducts a comparative analysis of law enforcement against illegal fishing under Indonesian positive law and contemporary Islamic law. Employing a qualitative legal research method supported by statutory, case, and conceptual approaches, it examines the normative foundations, enforcement challenges, and philosophical principles underpinning both systems. The findings show that Indonesian positive law provides a comprehensive regulatory framework through instruments such as Law No. 45/2009 and the Fisheries Act. However, its enforcement faces significant obstacles, including jurisdictional overlaps, limited institutional resources, and weak interagency coordination. In contrast, contemporary Islamic law frames marine resource protection as part of ḥimāyah al-bi’ah (environmental protection) and maṣlaḥah (public welfare), advocating community-based accountability and ethical stewardship rooted in moral responsibility. The study highlights the potential for normative synergy between the two systems, suggesting that integrated legal pluralism could enhance maritime governance by balancing legal deterrence with ethical imperatives. Such an approach promotes not only compliance but also shared moral commitment to resource preservation. This research contributes to the discourse on environmental justice within Islamic jurisprudence and offers policy recommendations for strengthening enforcement mechanisms through a holistic, values-based legal framework.
