Abstract

Press criminal law has significant implications in the case of sending a pig's head to the editorial office of Tempo, an event that has drawn attention regarding press freedom and the limits of expression. This research aims to analyze how the provisions of press criminal law can be applied in the context of acts of intimidation against the media as occurred in this case. Employing a normative juridical study method with a case approach, this research will examine potential criminal violations and the relevance of the Press Law in providing protection for press freedom. The main focus of the analysis is to understand the limitations that can be imposed on expression, especially when such actions have the potential to threaten or create fear among journalists. This case is important to evaluate in order to maintain the dignity of the press as a free and independent pillar of democracy. Furthermore, this research is expected to contribute to a deeper understanding of how the legal system responds to actions that can undermine press freedom in Indonesia, as well as provide recommendations for more effective law enforcement in protecting press freedom without neglecting the principles of justice.

Abstract

The development of technology and freedom of the press in the digital era has brought great changes in the form and manner of news delivery by the mass media. However, in reality, the media often becomes a means of spreading hate speech that has a negative impact on society and the democratic order. This article aims to examine how media coverage can contribute to the dissemination of hate speech and its impact on the application of Law No. 40/1999 on the Press. Through a qualitative research method approach with a descriptive and inductive approach, this article evaluates the media's responsibility to deliver information objectively and identifies elements in the news that can accelerate the spread of hate speech, such as provocative elements, lack of verification, and excessive news presentation. In this context, the active role of supervisory institutions such as the Press Council is needed so that press freedom continues to run in line with journalistic ethics and applicable laws, in order to maintain social cohesion and uphold democratic values in Indonesia.

Abstract

The development of society and the increasing complexity of legal relations necessitate the reform of the national criminal law system. This research is motivated by the need to examine the relevance and responsiveness of provisions governing the criminal act of embezzlement in the 1946 Indonesian Criminal Code (Old KUHP) and the 2023 Indonesian Criminal Code (New KUHP). The aim of this study is to analyze the substantive similarities and differences between the two codifications of criminal law, and to assess the extent to which the New KUHP addresses the challenges of modern legal systems. This study employs a normative juridical method using a comparative approach to relevant legislation. The findings reveal that, while both codes share fundamental elements of embezzlement and similar sentencing structures, the 2023 KUHP adopts a more progressive approach. Key reforms include the expansion of legal subjects to include corporations, the adjustment of value thresholds for minor embezzlement, the implementation of more flexible sanctions such as fines, and the strengthening of restorative justice principles. The implications of these findings indicate that the 2023 KUHP is more adaptive to socio-economic dynamics and the needs of a modern criminal justice system. Accordingly, the New KUHP offers a more relevant and contextual legal framework, particularly in addressing embezzlement offenses.

Abstract

This study discusses a legal analysis of the differences between criticism and defamation in Indonesian law, especially in the Criminal Code (KUHP) and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE). The research method used is normative legal with a regulatory and contextual approach. The results of the study show that the Criminal Code and the ITE Law both provide protection for individual honor, but differ in the scope of application. The Criminal Code focuses more on conventional interactions, while the ITE Law regulates the electronic realm. Although it aims to protect the name well, the provisions in the ITE Law are considered to have weaknesses due to the potential for multiple interpretations that can threaten freedom of expression. Therefore, a proportional legal interpretation is needed to maintain a balance between protection of personal honor and respect for freedom.

Abstract

The advancement of Artificial Intelligence (AI) technology has generated significant benefits while simultaneously creating new opportunities for cyber-based sexual offenses, particularly through deepfake technology, which enables the manipulation of a person's face into pornographic content without consent. This study examines criminal liability for perpetrators of AI-based sexual harassment and legal protection for victims in deepfake pornography cases, focusing on a case involving a student at Udayana University, Bali. This research employs a normative legal method by analyzing primary, secondary, and tertiary legal materials. The findings indicate that although Indonesian law does not yet explicitly regulate deepfake technology, perpetrators can still be prosecuted under the Electronic Information and Transactions Law, Pornography Law, Sexual Violence Law, and the new Criminal Code. Criminal intent is established through the deliberate manipulation, creation, and dissemination of non- consensual sexual content. Furthermore, victims are entitled to legal protection, including psychological recovery, privacy rights, restitution, and content removal. This study highlights the urgency of developing specific regulations addressing AI-related sexual crimes, enhancing forensic digital capabilities, and strengthening victim-centered protection mechanisms. The research contributes to the legal discourse on emerging digital crimes and emphasizes the need for adaptive legal frameworks in the AI era.
