Abstract

Discussing consumer protection is very interesting, because it is related to daily life, one can become a consumer and one can become a business actor. Many consumers and business actors do not understand their rights, obligations and responsibilities. There are important legal rules as the basis for consumer protection policies in Indonesia. First, the 1945 Constitution, as a source of law in Indonesia, mandates that national development aims to create a just and prosperous society. To realize a democratic economic development system so that it can grow and develop a world that produces goods and services that are suitable for consumption by the community. Second, Law Number 8 of 1999 concerning Consumer Protection. The enactment of this Law provides hope for the Indonesian people, to obtain protection from losses suffered on transactions of goods and services, where the Consumer Protection Act guarantees legal certainty for consumers.

Abstract

This paper discusses the issue of the role of tax law in national economic development in order to achieve state goals in relation to tax law by using a functional approach to tax law. Therefore, the nature of tax law must be clarified in advance so that the concept of tax law in economic development in order to achieve state goals can be interpreted appropriately. This paper explains that taxes are used for state financial resources which are vital for the running of the country, besides that it is also a manifestation of state financing facilities in realizing the implementation of national development, because all government expenditures, including development expenditures, are funded by taxes, taxes are very important for the functioning of the state, especially in terms of implementing development.

Abstract

Indonesia consists of a diversity of ethnicities, races, cultures and beliefs. One of the most basic pluralisms of the Indonesian nation is the pluralism of beliefs held by the nation. In Indonesia, there are six recognized religions, each of which has its own rules. Like the rules of marriage. In Indonesia there are 2 marriage registration institutions, namely in Islam it is registered at the Office KUA while non-Muslims are registered at the Civil Registry Office (KCS). In KUA itself, interfaith marriages cannot be recorded, as well as in Disdukcapil unless there is a provision for dispensation. Indonesia needs regulations regarding religious marriages, so that there is no legal vacuum in this matter, especially since Indonesia is a pluralistic country where there are many different beliefs. So that there is no more debate in interfaith marriages.

Abstract

Kasus penyalahgunaan media elektronik banyak terjadi di Indonesia saat ini. Hal ini menunjukkan bahwa masyarakat masih sangat rentan ketika melakukan aktivitas yang berhubungan dengan media elektronik. Untuk itu perlu menggunakan sarana elektronik untuk menyelidiki kejahatan, khususnya penipuan. Hal ini menjadi perhatian dalam mempertimbangkan kebijakan hukum terhadap penipuan media elektronik dan sanksi pidana terhadap pelaku penipuan media elektronik. Penelitian ini bertujuan untuk mengidentifikasi sanksi pidana bagi pelaku penipuan media elektronik dan untuk menentukan kebijakan hukum bagi pelaku penipuan media elektronik. Penelitian ini menggunakan metode penelitian normatif. Penipuan melalui media elektronik memenuhi kriteria Bagian 378 KUHP dan dapat dikenakan klausul ganda untuk pelanggaran yang memenuhi standar Bagian 28(1) Undang-Undang Informasi dan Transaksi Elektronik.Kata-kata Kunci: Hukum Pidana; Media Elektronik; Penipuan

Abstract

Online lending and borrowing agreements are transaction activities that continue to take place in people’s lives. So an online loan agreement is a type of ordinary loan agreement, but what distimguishes it is the intermediary media through online or online media. In the implementation of online loan agreements between debtors and creditors, it does not require space to interact directly. Online lending and borrowing agreements are considered legally valid because their provisions are still subject to articles 1320 and 1338 of the Civil Code. The benefits can be felt not only in the national scope but also in the world. As with the initial purpose of the internet being created as a means of connecting to make it easier for users to access everything they need, even now, the internet can also function as a medium for transaction. With the internet, the world’s economic development has significantly increased. This is due to the ease of convenience in transacting through internet technology media. In Article 1736 of the Civil Code, it is stated that whoever receives a loan, is obliged to return it in the same amount and condition, and at the specified time.

Abstract

Gambling has existed since time immemorial when human civilization developed. The Encyclopedia Britanica notes that gambling has been found since primitive times, for example Bushmen in South Africa, Aborigines in Australia and Indians in America, where they have known the game of dice. Gambling is essentially an act that is very contrary to religious norms, morality, decency and legal norms. So it can be said that gambling is actually not getting benefits but rather suffering and suffering even more. The implementation of Law Number 19 of 2019 concerning Information and Electronic Transactions cannot be separated from the implementation of other laws or regulations. Because this Law only qualifies criminal acts and carries out threats against perpetrators of criminal acts, and some special meanings (for example the definition of documents electronics, telecommunications).

Abstract

Prostitution is an activity that has a very long history in human civilization. Along with the times, today's prostitution activities also adjust to the development of information and communication technology which makes prostitution activities increasingly difficult to limit. Prostitution activities are only regulated in the Criminal Code which can only be imposed on pimps. Meanwhile, other parties such as users and providers of prostitution services who are involved in these activities have not yet received legal regulations that can ensnare them. Penalties regulated in the Criminal Code and the Law define punishment only for service providers or pimps. The Criminal Code and the Law do not regulate the provisions for sentencing service users for online prostitution crimes. This study aims to discuss criminal responsibility for users of online prostitution services for minors and to find out criminal responsibility for children who distribute information containing prostitution. This research method is normative research.

Abstract

Corruption is a serious problem that hampers the development process and creates social and economic instability in Indonesia. In an effort to tackle increasingly disturbing criminal acts of corruption, the Indonesian government has taken concrete steps by enacting various regulations, one of which is Law Number 1 of 2023 concerning Law Enforcement Against Corruption. This research aims to conduct an in-depth analysis of various factors that influence the effectiveness of law enforcement against corruption, especially in the context of implementing Law no. 1 of 2023. In order to achieve this goal, this research uses a qualitative approach with descriptive analysis methods, which aims to thoroughly understand the role and influence of this law on improving the quality of law enforcement against criminal acts of corruption. Several factors analyzed in this research include institutional aspects involved in law enforcement, the quality and competence of human resources, the law enforcement policies implemented, as well as various challenges and obstacles faced by law enforcement officials in implementing this law effectively. Through this analysis, it is hoped that this research can provide deeper insight into the effectiveness of the implementation of Law no. 1 of 2023 in overcoming corruption, as well as providing constructive recommendations to improve the law enforcement system in Indonesia to achieve more optimal results in eradicating corruption.

Abstract

The dissemination of information that cannot be proven true or what is often called fake news is very vulnerable today. In reporting, the press has a responsibility in the event of an objection to a news report. Based on the Press Law, the press is obliged to serve the right of reply and the right of correction to public complaints about press coverage. Regarding fake news in Indonesia, the regulations are contained in the Criminal Code, ITE Law, Broadcasting Law and other laws. This research aims to find out the regulations that become the legal umbrella for victims of fake news perpetrated by the press and the extent to which the press is responsible for fake news in the news. The research method used is a literature study using primary, secondary and tertiary legal materials.

Abstract

The use of social media as a means of the press has various legal implications amidst the rapid development of information technology. Social media makes it easy to disseminate information quickly and widely, but on the other hand, the absence of clear regulations in categorizing it as part of the formal press raises legal problems, especially related to responsibility for content, protection of individual rights, and freedom of expression. This study aims to examine the position of social media in the legal framework of the press in Indonesia, and to analyze its legal consequences for users who act as conveyors of public information. Using the normative juridical method, it was found that social media has not received explicit recognition as a press entity in the Press Law, thus creating legal loopholes in terms of accountability and legal protection. Regulatory updates are needed to ensure legal certainty and maintain a balance between freedom of expression and legal responsibility in the digital era.
