Abstract

In the midst of prolong conflict and the delay of reconciliation, Indonesian government provides a special autonomy to the Aceh people to implement Islamic laws (sharia') in the sociopolitical realms. Yet, for Aceh women the implementation of sharia' creates discriminative regulations such as enforcement to wear jilbab and curfew for them. Many recent political policies are totally disregarding Aceh women as part of the Aceh society. Various local regulations (qanun) that proposed by local government are not gender-sensitive and put forward violence in doing conflict resolution. Local autonomy brings the oppression of women's roles in the society. Historically, Aceh women have significant roles in shaping cultural identity of Aceh society. In the past, the interpretation of sharia' recognized and supported women's leadership in the society. Hence, a new approach to put back women's public roles in order to participate in reconciliation process of the Aceh society is needed. Abstract

In conflict or post-conflict contexts, women experience layered violence: both daily and structural. The two main approaches commonly used in studies and programs in both contexts are peace and transitional justice. Both give a focus on violence experienced by women, but are not sufficient to provide analysis and solutions to the occurrence of structural injustice experienced by women. This paper is a reflection of the long journey of the author’s involvement in both approaches. The main question of this paper is: how can peace and transitional justice provide solutions to transform structural injustices experienced by women in conflict and post-conflict areas? Where to start?

Abstract

When democratization took place in 1998 after three decades of authoritarianism in Indonesia, transitional justice became one of the agendas for the country. With the nature of compromised political transition, transitional justice brought together the interest of the elements who wished to challenge the repressive regime, and those who wished to distant themselves from the old regime in order to return to politics. As the result, transitional justice measures were successfully adopted in the beginning of political transition but failed to achieve its goals to break with the old regime and bring justice to victims. Today, after twenty years since reformasi, elements of the politics are consolidated, including those coming from the old regime. Transitional justice is undergoing a period I refer as “post transitional justice”. The main character of this state is the extensive roles of civil society. I argue in this paper that civil society, in particular the human rights groups, have important roles since the beginning of the transition in setting the agenda for transitional justice until today when state-centered mechanisms failed and led to post-transitional justice situation. These groups shift strategies to work from below and from the margins, which give strong character for post-transitional justice in Indonesia.

Abstract

This article discusses three key questions. First, what and how is the development of policies and legal protection that can be the support for the central government in implementing the Aceh Truth and Reconciliation Law? Second, how is the Aceh TRC and Human Rights Court as a mechanism of justice can mutually strengthen the protection of human rights for victims and their families? Third, how is to build solid legal relationships among state institutions to fortify the TRC’s recommendation regarding reparation? This article is written based on research and focus group discussion and is aimed to encourage several legal policy developments oriented as solutions to the limited efforts to protect and fulfill victims, particularly related to reparation and restoration of their rights. It also emphasizes the legal position of the basic national political and legal context, associated as a reminder to the dignity of the Memorandum of Understanding of Helsinki for the future of Aceh. Abstrak: Artikel ini mendiskusikan tiga pertanyaan kunci, yakni pertama, apa dan bagaimana pengembangan kebijakan dan payung hukum yang dapat menjadi dukungan Pemerintah Pusat terhadap pemberlakuan KKR Aceh? Kedua, bagaimana secara institusional kelembagaan KKR Aceh dan Pengadilan HAM sebagai mekanisme keadilan dapat saling memperkuat perlindungan HAM bagi korban dan keluarganya? Ketiga, bagaimana membangun relasi hukum yang kuat antar Lembaga negara untuk memperkuat rekomendasi KKR terkait reparasi? Dihasilkan dari proses riset dan diskusi grup terarah, artikel ini mendorong sejumlah pengembangan kebijakan hukum yang diorientasikan sebagai jalan keluar atas terbatasnya upaya perlindungan dan pemenuhan bagi korban, terutama terkait reparasi dan pemulihan hak-haknya. Serta, menegaskan posisi hukum atas konteks politik hukum nasional yang mendasar dikaitkan kembali sebagai pengingat marwah MOU Helsinki bagi masa depan Aceh. Artikel ini membahas sunat perempuan yang pada umumnya didasarkan pada tradisi dan budaya masyarakat, diturunkan dari generasi ke generasi, dan diperkuat melalui ajaran agama. Pelaksanaan sunat perempuan sangat kuat kaitannya dengan kontrol seksual dan bentuk kuasa terhadap perempuan serta melahirkan opresi. Penelitian ini bertujuan untuk mengkaji bentuk opresi yang dialami perempuan dalam kelompok budaya melalui studi kasus sunat perempuan di Banten dan dampaknya pada pengakuan hak perempuan dalam masyarakat adat. Secara khusus, kajian ini mengelaborasi opresi terhadap perempuan dalam konteks politik pengakuan identitas kelompok budaya di Banten. Penelitian ini menggunakan metode kualitatif dengan melakukan wawancara mendalam. Dengan menggunakan Interpretative Phenomenological Analysis (IPA), atau analisis interpretasi fenomenologis, penelitian ini menunjukkan bahwa terdapat dua bentuk opresi yang terjadi dalam praktik sunat perempuan di Banten, yaitu pelemahan (powerlessness) dan kekerasan (violence). Bentuk opresi tersebut merupakan dampak pelemahan perempuan dalam praktik sunat perempuan, yang menjadi salah satu implikasi negatif dari politik pengakuan identitas kelompok budaya yang terjadi di Indonesia.

Abstract

This research departed from the low score of political parties in Indonesian Democracy Index. Assuch, this paper tries to analyze as to the primary problems faced by political parties in the era of reformation with previously giving historical backgrounds regarding to political parties’ transformation in Indonesia. The main purpose of this research is to identify obstacles and opportunities so as to strengthening political parties towards consolidated democracy. The study finds that there are three main issues faced by political parties in reform era, which are corruption, money politics, and the failure of political representation. other problems are about accountability, transparency, and political party funding, in which the income and the outlay of political parties are not balanced so that triggering the possibility of corruption. Subsequently, there are some challenges which later known in the effort of strengthening political parties, which are patronage, clientelism, and supervising policy by government.

Persons with disabilities experience vulnerability in fulfilling their right to protection in a pandemic situation This study aims to examine the participation process of groups of persons with disabilities, namely the Indonesian Association of Women with Disabilities (Himpunan Wanita Disabilitas Indonesia – HWDI) through the struggle for disability protection during the Covid-19 period in DKI Jakarta. This study uses the perspective of inclusive citizenship to see efforts to involve active participation of citizens in encouraging the fulfillment of rights by the government. This study uses a descriptive qualitative method with narrative analysis techniques. The results of the study show that although HWDI has been able to influence the DKI Jakarta provincial government in several policies, there are rights that still need to be fulfilled in the dimension of inclusive citizenship. These rights include social, civil, and political rights which have not been fulfilled by the government, which has implications for persons with disabilities not being further involved in handling the Covid-19 pandemic.
