Abstract

The rulings of the constitutional court to review the Act No. 7 of 2004 on Management of Water Resources, Act No. 22 of 2001 on Crude Oil and Natural Gas, Act No. 20 of 2002 on Electricity caused controversy. These decisions gives a different interpretation of Article 33 of the Constitution of 1945, which likely have implications for Indonesia’s economic development policy. Branches of production which is important for the livelihoods of people and natural resources, is placed in the area of public law rather  than private. The consequences are arranged by state control rights as a collective representation of Indonesian society. Thus, the form that allows management of a joint is through cooperatives and the state delegation of the management of public goods to the non-state (cooperative), can only  be done with the instrument of one-sided legal action.

Abstract

Peraturan Perundang-undangan menempatkan Dewan Perwakilan Rakyat Daerah (DPRD) sebagai badan representasi yang menjadi unsur pemerintahan daerah. Di antara fungsi yang dimilikinya adalah fungsi legislasi. Citra yang berkembang saat ini adalah Rancangan Peraturan Daerah yang berasal dari inisiatif DPRD lebih sedikit daripada Raperda atas prakarsa Pemerintah Daerah. Hal ini perlu dibuktikan dengan mengambil contoh pencapaian produktifitas pembentukan peraturan daerah dari pengalaman beberapa Kabupaten Ciamis dan Kota Bandung. Pencapaian produktifitas tersebut tidak saja berhenti pada pemetaannya, melainkan adalah menelusuri apa landasan pemikiran fungsi legislasi oleh DPRD Kabupaten/Kota. Selain itu adalah perlu digali apa saja faktor- faktor penunjang akuntabilitas anggota DPRD dalam rangka pelaksanaan fungsi legislasi. Untuk menjawab demikian, dilakukan pendekatan penelusuran dan analisa terhadap peraturan perundang-undangan. Selain itu dilakukan pula verifikasi terhadap beberapa hal mengenai inisiatif DPRD dalam mengajukan Raperda. Penelitian menunjukkan bahwa landasan pemikiran fungsi legislasi oleh DPRD Kabupaten/Kota adalah berdasarkan pada pendekatan fungsi legislasi pada suatu elected representative dan akuntabilitas. Dalam pendekatan ini walaupun terdapat dinamika peran wakil rakyat dalam rangka hubungannya dengan yang diwakili, namun keterwakilannya dapat "ditagih". Sementara itu dari pendekatan landasan akuntabilitas diperoleh suatu deskripsi bahwa akuntabilitas DPRD digolongkan menjadi akuntabilitas secara kolektif dan akuntabilitas secara individu. Untuk mengetahui faktor-faktor penunjang akuntabilitas anggota DPRD dalam rangka pelaksanaan fungsi legislasi, terlebih dahulu sorotan utama pada DPRD Kota Bandung dan Kabupaten Ciamis dalam penelitian ini, baru dapat terekam terhadap jumlah produk Perda yang berasal dari inisiatif DPRD dalam rangka pelaksanaan fungsi legislasi. Melihat inisiatif DPRD yang dicontohkan di Kota Bandung dan Kabupaten Ciamis masih di bawah 50 persen dari keseluruhan Perda yang ditetapkan pada periode 2009-2014 ini. Adapun pengungkapan komposisi latar belakang yang berasal dari profil singkat masing-masing masih berada di permukaan saja untuk melihat dan mengukur akuntabilitas anggota DPRD secara individu. Atas dasar itulah dalam penelitian ini masih menyisakan kelemahan yang barangkali dapat diperkaya oleh peneltian-penelitian berikutnya Akuntabilitas secara individu perlu lebih jauh ditelusuri untuk diketahui sampai bagaimana pola rekruitmen dan kemungkinan ideal anggota DPRD dalam menjaga moral dan etika penyelenggaran negara. Abstract

This research is a literature study that analyzes the construction of regional autonomy perspectives in the appointment of Acting Regional Heads from the active Indonesian National Army (TNI) based on various academic studies. with various studies among academics. The appointment of acting regional heads from the military raises fundamental questions regarding its consistency with the principles of regional autonomy, merit systems, and local democracy. The appointment of acting regional heads from the military raises fundamental questions regarding its consistency with the principles of regional autonomy, merit systems, and local democracy. The main focus of this research is to examine: First, How is the construction of regional autonomy perspectives in various studies regarding the appointment of Acting Regional Heads from active TNI elements before the enactment of Permendagri No.4 of 2023? Second, What is the regulatory basis that can be corrected for the appointment of Acting Regional Heads from active TNI elements in the perspective of regional autonomy?. This research uses normative juridical methods and uses secondary data from library materials. The approaches used in this research are legislative approach and conceptual approach. This research concludes: First, the dominance of the perspective stating that the practice of appointing Acting Regional Heads from among the active TNI tends to conflict with local democracy. Second, a more assertive regulatory reformulation is needed in limiting the appointment of Acting Regional Heads from the active TNI and strengthening mechanisms of transparency, accountability, and DPRD participation in the selection process.

Abstract

The urbanisation of the contemporary world reveals urban challenges, for example, inequalities in spatial distribution, and Indonesia is no exception. One of the challenges is the insufficient opportunity for participation in planning decision-making. Country leaders worldwide agree to address their urban challenges by applying the New Urban Agenda (NUA) to accelerate Goal 11 of the 2030 Agenda for Sustainable Development (SDGs). This article aims to emphasize the extent of public participation in the NUA to enrich the relevant legal improvements and promote prospective enhancements to regulate public participation in planning decision-making as a right to participate in public life. A legal doctrine design, a library-based approach, and the NUA standard are applied to examine the existing laws resting on urban planning, local government, and human rights law regimes. Accordingly, the public participation setting in planning decision-making requires the NUA standard to include the key features of “equal treatment”, “design and implementation”, “evaluation”, and “effective remedies”. The study suggests that the legal compatibility in Indonesia is insufficient to accommodate those NUA standards. Therefore, it contributes to developing legal compatibility in Indonesia, which should foster citizens’ enjoyment of public participation in spatial planning decision-making towards the actualization of the NUA.
