Abstract

Abstrak Country can be said to be a state if elements of the state have been fulfilled. One of the most fundamental elements is the existence of the people. The existence of the people means that there are people who live and become subjects of government and enforced rules. Without rules, the consequence is that there will be a large number of crimes that cannot be overcome. Therefore criminal law exists to optimize a regulation and implementation in the community. In the constitution of the Indonesian state, there has been guaranteed the rights of everyone from the right to life, the right not to be tortured, the right to religion and human rights that cannot be reduced in any case. But with Article 81 A paragraph (3) of Law No. 17 of 2016 concerning the second amendment to Law No. 3 of 2002 concerning Child Protection. In this article the phrase the addition of basic crimes especially chemical castration punishment becomes a problem that causes controversy among the public. So the government needs to reconsider with regard to Article a quo by using preventive and repressive measures to address these problems.  The theory that author use is Law Enforcement along with the principles of das sein and das sollen. With normative research methods that are descriptive, and through a conceptual approach. So the author recommend that the application of chemical castration and rehabilitation as a form of treatment oriented to protect perpetrators and sexual crimes.

Abstract

Abstract:The controversy over the amendment to the Mineral and Coal Law (the Minerba Law) has made people worried. Because there is some substance of the articles in the law that cause problems affecting the community. One crucial thing that has become polemic is that many changes of authority at the regional level are replaced directly by the central government which has logical consequences for the erosion of regional autonomy. Besides, the emergence of disharmony between one principle with another principle in the process of the Formulation of Laws Number 15 the Year 2019. Because at the time of its formation, the legislative body did not legislate transparently but was carried out in private. Therefore, the author tries to use a juridical-normative research method to analyze the problem, so that there are reasons to cancel some articles that are considered detrimental to the community.Keywords: Minerba Law, Rechstaat, Indonesian State Administration Abstrak:Kontroversi Perubahan Undang-Undang Mineral dan batu-bara (UU Minerba), telah membuat masyarakat khawatir. Hal itu karena ada beberapa subtansi pasal-pasal didalam undang-undang tersebut yang menimbulkan permasalahan  berdampak kepada masyarakat.  Sesuatu hal krusial yang menjadi polemic yaitu banyaknya perubahan kewenangan pada tingkat daerah diganti langsung oleh pemerintah pusat yang menimbulkan konse kuensi logis terhadap penggerusan otonomi daerah. Selain, timbulnya disharmonisasi antara satu asas dengan asas yang lain dalam proses Pembentukan Peraturan Perundang-Undangan Nomor 15 Tahun 2019 tersebut. Karena saat pembentukannya, lembaga legislative tidak melegislasi dengan transparan, melainkan dilakukan dengan tertutup. Oleh karena itu, penulis mencoba menggunakan metode penelitian yuridis-normatif untuk menganalisis permasalahan tersebut, sehingga didapatkan alasan untuk membatalkan beberapa pasal yang dirasa merugikan masyarakat.Kata Kunci: Undang-Undang Minerba, Rechstaat, Tata Negara Indonesia

Abstract

Public services as the basic needs of the community in the form of service activities facilitated by the state are considered not optimal and effective. One of the implementations of public services, especially in terms of the implementation of democracy is in the holding of elections through conventional mechanisms facilitated by the state through the General Election Commission. There are several problems in its implementation such as high levels of fraud, human error, and budget. Based on these problems, it has implications for the damage to the principle of election and the decline in the level of community satisfaction with the implementation of elections. Considering that Indonesia has entered the era of revolution 4.0, public service reform is needed in order to effectively establish election principles. The purpose of this paper is to find out the mechanism and problem of organizing elections as one form of public service in Indonesia. The theoretical foundation that we use is good and clean governance which is a fundamental principle in the administration of public and election services. Thus, the writer uses the juridical normative research method, through a case approach, comparative approach and conceptual approach. Therefore, the authors initiated the concept of e-voting in elections as an effective and efficient solution in rebuilding people's trust in the government in terms of public services. So, based on this research it can be concluded that currently public services in the holding of elections are considered not able to run well, causing the level of public satisfaction with the holding of elections to decline. keywords: Public Service, General Election, Industrial Revolution 4.0, e-votingAbstrakPelayanan publik sebagai kebutuhan dasar masyarakat berupa kegiatan pelayanan yang di fasilitasi oleh negara dinilai belum optimal dan efektif. Salah satu implementasi pelayanan publik terutama dalam hal pelaksanaan demokrasi yaitu dalam penyelenggaraan pemilu melalui mekanisme konvensional yang difasilitasi negara melalui Komisi Pemilihan Umum. Terdapat beberapa problematika dalam penyelenggaraannya seperti tingginya tingkat kecurangan, human error, dan pendanaan yang tinggi. Berdasarkan permasalahan tersebut berimplikasi kepada pencederaan asas pemilu dan turunnya tingkat kepuasan masyarakat terhadap pelaksanaan pemilu. Mengingat Indonesia telah memasuki era revolusi 4.0 diperlukan reformasi pelayanan publik agar terciptanya asas-asas pemilu secara efektif. Tujuan dari penulisan ini adalah untuk mengetahui mekanisme dan problematika penyelenggaraan pemilu sebagai salah satu bentuk pelayanan publik di Indonesia. Landasan teori yang penulis gunakan yaitu good and clean governance yang merupakan asas fundamental dalam penyelenggaraan pelayanan publik maupun pemilu. Dengan demikian penulis memakai metode penelitian normative yuridis, melalui pendekatan kasus (case approach), pendekatan komparasi (comparation approach) dan pendekatan konsep (conceptual approach). Oleh karena itu penulis menggagas konsep e-voting dalam pemilu sebagai solusi yang efektif dan efisien dalam membangun kembali kepercayaan masyarakat kepada pemerintah dalam hal pelayanan publik. Maka berdasarkan penelitian ini dapat disimpulkan bahwa dewasa ini pelayanan publik dalam penyelenggaraan pemilu dinilai belum mampu berjalan dengan baik, sehingga menyebabkan tingkat kepuasan masyarakat terhadap penyelenggaraan pemilu menurun. Sehingga penulis merekomendasikan untuk merubah penyelenggaraan pemilu secara konvensional menjadi e-voting dan merevisi Undang-undang Nomor 7 Tahun 2017 tentang Pemilihan Umum.Kata Kunci: Pelayanan Publik, Pemilu, Revolusi Industri 4.0, e-voting

Abstract

AbstractThe right to privacy is a personal right of every individual which must be protected by the state in accordance with the mandate of the constitution. Along with the development of information and communication technology, the discourse regarding the right to privacy has come under the spotlight again given the high intensity of personal data utilization, especially by corporations in the digital business era. This research will further analyze the use of consumer personal data by corporations from a legal perspective. The research method used is library research through a statute approach. The results of this study indicate that there is still obesity in regulations related to personal data protection in Indonesia, where the total reaches 30 regulations in various sectors. Moreover, this reality is exacerbated by the inadequacy of the Ministry of Communication and Information Technology (Kominfo) in conducting surveillance and investigations related to personal data protection. The result of all of this is the creation of legal loopholes that are often exploited to carry out crimes in the form of hacking and theft of personal data that harm consumers and the wider community. Therefore, there is a need for legal reform accompanied by a reconception of supervisory agencies regarding the protection of personal data as an integral part of upholding privacy rights in an era of constitutional disruption. Keywords: Personal Data Protection, Privacy Rights, Corporation, Constitution. AbstrakHak privasi merupakan hak pribadi setiap individu yang wajib dilindungi oleh negara sesuai dengan amanat konstitusi. Seiring dengan perkembangan teknologi informasi dan komunikasi, diskursus perihal hak privasi kembali mendapat sorotan mengingat tingginya intensitas pemanfaatan data pribadi, terutama oleh korporasi di era bisnis digital. Penelitian kali ini akan menganalisa lebih jauh terkait penggunaan data pribadi konsumen oleh korporasi dari perspektif hukumnya. Adapun metode penelitian yang digunakan adalah penelitian kepustakaan melalui pendekatan perundang-undangan (statute approach). Hasil dari penelitian ini menunjukkan bahwa masih terjadinya obesitas regulasi terkait perlindungan data pribadi Di Indonesia, dimana totalnya mencapai 30 Undang-Undang di berbagai sektor. Terlebih, realita tersebut semakin diperburuk dengan tidak optimalnya Kementrian Komunikasi dan Informatika (Kominfo) dalam melakukan pengawasan dan investigasi terkait perlindungan data pribadi. Akibat dari semua itu ialah terciptanya celah hukum yang kerap kali dieksploitasi untuk melancarkan kejahatan berupa peretasan dan pencurian data pribadi yang merugikan konsumen serta masyarakat dalam cakupan yang lebih luas. Oleh karena itu, diperlukannya reformasi hukum yang diiringi dengan rekonsepsi lembaga pengawas terkait perlindungan data pribadi sebagai bagian integral dari penegakan hak privasi di era disrupsi berdasarkan konstitusi. Kata kunci: Perlindungan Data Pribadi, Hak Privasi, Korporasi, Konstitusi.

Abstract

This study reviews the problems regarding the mechanism for convicting corruption cases in Supreme Court Regulation Number 1 of 2020 concerning Guidelines for Conviction of Article 2 and Article 3 of the Law on the Eradication of Corruption Crimes. The presence of these normative rules has created a de-organization of the freedom of judges which should still reflect and go high the conception of Divine Justice in accordance with the irah-irah which reads "For the Sake of Justice Based on the Almighty Godhead". The research method used is normative juridical research, while the research approach is to use the assessment of statutory policies (statutory approach). The results of this study show that there are still problems in terms of the normative level and their implementation regarding the misalignment between the decisions decided by judges and the conception of Divine Justice in Indonesia.Keywords: Conviction; Divine Justice; Uniformity of MA Regulations AbstrakPenelitian ini mengulas permasalahan mengenai mekanisme dalam pemidanaan kasus korupsi pada Peraturan Mahkamah Agung Nomor 1 Tahun 2020 tentang Pedoman Pemidanaan Pasal 2 dan Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi. Hadirnya aturan normatif tersebut telah menciptakan penderogasian terhadap kebebasan hakim yang seharusnya tetap mencerminkan dan menjunjung tinggi konsepsi Divine Justice yang sesuai dengan irah-irah yang berbunyi “Demi Keadilan Berdasarkan Ketuhanan Yang Maha Esa”. Metode penelitian yang dipakai yaitu penelitian yuridis normatif, sementara pendekatan penelitiannya yaitu menggunakan pengkajian peraturan perundang-undangan (statutory approach). Hasil penelitian ini menunjukkan bahwa masih terdapat problematika dari segi tataran normatif serta implementasinya mengenai ketidakselarasan antara putusan yang diputuskan oleh hakim dengan konsepsi Divine Justice di Indonesia.Kata Kunci: Pemidanaan; Divine Justice; Penyeragaman Peraturan MA
