Abstract

AbstractAccording to the annual report of PT. KCI until December 2018, PT. KCI has 792 KRL units, and continues to grow to date to meet the growing passenger demand from time to time. Users of the Commuter Line Train service, as a whole, as of December 2018, there were 336.7 million passengers. That number increased 7% from the number of passengers in 2017 amounted to 315.8 million passengers. At present, PT. KCI serves 79 stations throughout the Greater Jakarta, Banten and Cikarang areas with a route range of 418.5 km. In the face of an increase in the number of passengers, one of the efforts that can be emphasized in improving the quality of customer service is by implementing e-ticketing technology as a substitute for manual payment systems using paper tickets. Based on this with the large number of KRL enthusiasts, the need for legal arrangements governing consumer protection for KRL users. This is necessary to protect consumer rights in the event of undesirable events, such as Extraordinary Events (PL) on Jabodetabek commuter line train trips.This study aims to determine, describe, and provide an understanding of the forms of consumer protection and compensation mechanisms for passengers using the LinkAja application for the extraordinary events of the Jabodetabek Commuter Line Train trip by PT. Kereta Commuter Indonesia.This study uses qualitative research, with a juridical empirical research method, namely legal research with existing facts and applied by humans living in the community itself that can be constrained or observed and free of values to determine the implementation of applicable legal norms.The results of the analysis showed that the form of passenger protection for users of the LinkAja application for extraordinary events on the Jabodetabek Commuter Line train trip, namely the compensation of the amount of money spent and the compensation could be given if the passenger canceled the Jabodetabek commuter line train trip. Jabodetabek commuter line train trip cancellation mechanism, can be done by Passenger can report to station officer to cancel Jabodetabek commuter line train trip. After that the station accompanied the passengers to cancel the Jabodetabek commuter line train trip to the station ticket clerk. Then the station ticket clerk confirmed to the linkaja that the passenger would cancel the Jabodetabek commuter line train trip due to an extraordinary event on the Jabodetabek commuter line train trip. When it has been confirmed by the linkaja, the passengers only need to wait for the balance to be returned to the passenger linkaja account itself.Abstrak Menurut laporan tahunan PT. KCI hingga Desember 2018, PT. KCI telah memiliki 792 unit KRL, dan terus bertambah hingga saat ini untuk memenuhi permintaan penumpang yang terus bertambah dari waktu ke waktu. Pengguna jasa Kereta Commuter Line, secara keseluruhan, per Desember 2018, terdapat 336,7 juta penumpang. Angka tersebut meningkat 7% dari jumlah penumpang tahun 2017 sebesar 315,8 juta penumpang. Saat ini, PT. KCI melayani 79 stasiun di seluruh wilayah Jabodetabek, Banten, dan Cikarang dengan jangkauan rute mencapai 418,5 km. Dalam menghadapi kenaikan jumlah penumpang, salah satu upaya yang dapat ditekankan dalam peningkatan kualitas pelayanan pelanggan, yaitu dengan penerapan teknologi e-ticketing sebagai pengganti dari sistem pembayaran manual dengan menggunakan tiket kertas. Berdasarkan hal tersebut dengan banyaknya peminat KRL, diperlukannya pengaturan hukum yang mengatur mengenai perlindungan konsumen bagi pengguna KRL. Hal ini diperlukan untuk melindungi hak-hak konsumen apabila terjadi hal-hal yang tidak diinginkan, seperti Peristiwa Luar Biasa (PL) pada perjalanan kereta commuter line Jabodetabek.Penelitian ini bertujuan untuk mengetahui, mendeskripsikan, dan memberi pemahaman mengenai bentuk perlindungan konsumen serta mekanisme ganti rugi pada penumpang pengguna aplikasi LinkAja atas  peristiwa luar biasa perjalanan Kereta Commuter Line Jabodetabek oleh PT. Kereta Commuter Indonesia.            Penelitian ini menggunakan jenis penelitian kualitatif, dengan metode penelitian empiris yuridis, yaitu penelitian hukum dengan fakta yang ada dan diterapkan oleh manusia yang hidup dalam masyarakat itu sendiri yang dapat dikonstatasi atau diamati dan bebas nilai untuk mengetahui implementasi norma hukum yang berlaku.            Hasil dari analisis yang dilakukan menunjukkan bahwa bentuk perlindungan konsumen penumpang pengguna aplikasi LinkAja atas peristiwa luar biasa pada perjalanan kereta Commuter Line Jabodetabek, yaitu pemberian kompensasi sejumlah uang yang dikeluarkannya dan kompensasi tersebut dapat diberikan apabila penumpang membatalkan perjalanan kereta commuter line Jabodetabek. Mekanisme pembatalan perjalanan kereta commuter line Jabodetabek, dapat dilakukan dengan cara Penumpang dapat melapor ke petugas stasiun untuk melakukan pembatalan perjalanan kereta commuter line Jabodetabek. Setelah itu stasiun mendampingi penumpang untuk melakukan pembatalan perjalanan kereta commuter line Jabodetabek ke petugas loket stasiun. Lalu petugas loket stasiun mengkonfirmasi ke pihak linkaja bahwa penumpang tersebut akan melakukan pembatalan perjalanan kereta commuter line Jabodetabek dikarenakan adanya peristiwa luar biasa pada  perjalanan kereta commuter line Jabodetabek. Ketika sudah terkonfirmasi oleh pihak linkaja, penumpang hanya tinggal menunggu saldo dikembalikan ke akun linkaja penumpang itu sendiri.

Abstract

In this study, we will look into the First to File system and the principle of equality in the law on trademarks and geographical indications. We will also look into how the judges looked at the Geprek Bensu case in the Supreme Court Decision Number 57/2018/PN Niaga Jkt.Pst. First to File is the most important thing in Law Number 20 of 2016, which deals with trademarks and geographical indications. It is the first step to a chance. Article 3 of Law Number 20 of 2016 says that if the mark has been registered in the General Register of Marks, you can get the right to a mark. Even though the law doesn't say it, this is what it says (DUM). It was found that Ruben Samuel Onsu was not careful when he tried to use the Geprek Bensu trademark. The Supreme Court ruled that he broke the First to File system. The results of this study show that some Indonesian people haven't paid much attention to the First to File system. One of them is Ruben Samuel Onsu. It was finally up to the judge in this case to decide that he didn't believe the Plaintiff, Ruben Samuel Onsu, and that he wanted the Director General of Trademarks and Geographical Indicators to remove the registration of the marks in the name of Ruben Samuel Onsu.

Abstract

Penelitian bertujuan untuk menjelaskan perlindungan hukum bagi para pihak dalam transaksi elektronik. Meskipun telah dibentuk regulasi mengenai teknis penyelenggaraan perdagangan elektronik, nyatanya aturan tersebut masih memiliki kelemahan dalam segi perlindungan hukum dikarenakan para pihak dalam transaksi elektronik baik penjual ataupun pembeli seringkali dirugikan oleh pihak-pihak yang melakukan perbuatan melanggar perjanjian serta penyelesaian sengketa yang disediakan melalui platform online dispute resolution dianggap masih merugikan salah satu pihak.Hasil penelitian ini menyebutkan bahwa Perlindungan para pihak dalam transaksi elektronik dilakukan melalui mekanisme online dispute resolution yaitu aplikasi yang disediakan oleh platform shopee untuk menyelesaikan sengketa, namun hal tersebut belum sepenuhnya menjamin perlindungan hukum karena pengunaan online dispute resolution seringkali merugikan pihak yang telah menjalankan perjanjian secara benar.

Abstract

The purpose of this study is to examine regulations relating to foreign investment in the Financial Services Authority Regulation Number 77 of 2016 about Information Technology-Based Borrowing-Lending Services, which was published in 2016. It is burdensome if it is applied in a systematic manner in conjunction with other laws and regulations. Apart from that, the implementation of the organizers in accordance with the Financial Services Authority Regulation Number 77 of 2016 and market behavior (ethical behavior) governed by the organization, in this case the Indonesian Joint Funding Fintech Association, are equally important (AFPI). In this study, the research method is based on a statutory methodology. The type of research used in this study is normative empirical research, with data collection methods such as library research and interviews serving as the primary data sources. According to the findings of the study, foreign investment in the Financial Services Authority Regulation is in conflict with the aforementioned regulations, and the implementation for the operator is classified as less than optimal due to the limited authority of the Financial Services Authority, which is only classified as an authority regulation and not a law, and the implementation for the operator is classified as less than optimal.

Abstract

The rise of domestic violence cases resolved through the courts is increasingly worrying, especially when there is an imbalance in processing a law carried out by law enforcement in Indonesia that the community's aspirations have not carried out. Issues that have caught the attention of the public and the public regarding the law in this country seem to turn a blind eye to justice and social norms that should be obtained by the victims whose rights have been injured. This polemic can be proven by one of the hot cases circulating in the community, namely the case of legal inequality felt by a housewife who was prosecuted for one year in prison for scolding her drunken ex-husband. Therefore, this study aims to examine aspects of law enforcement in dealing with cases like this through social theory. The research method used is a normative juridical research method, with a qualitative approach and looking at the social facts that exist in society. The results found in this study indicate that the law enforcement process in Indonesia still needs to be addressed, not only based on legal certainty but also needs to be accompanied by justice under the conditions of society.Keywords: Domestic Violence, Social Theory, Law Enforcement Abstrak Maraknya kasus kekerasan dalam rumah tangga yang diselesaikan melalui jalur pengadilan, semakin hari kian mengkhawatirkan, terlebih adanya ketimpangan dalam memproses suatu hukum yang dilakukan oleh para penegakan hukum di Indonesia yang belum berjalan sesuai dengan cita masyarakat. Persoalan yang menyita perhatian publik dan masyarakat terkait hukum di negara ini, seakan menutup mata atas keadilan dan norma sosial yang seharusnya diperoleh oleh pihak korban yang haknya tercederai. Polemik tersebut dapat dibuktikan dengan salah satu kasus yang hangat beredar di masyarakat yaitu terkait kasus ketimpangan hukum yang dirasakan oleh salah seorang ibu rumah tangga yang dituntut satu tahun penjara akibat memarahi mantan suaminya yang mabuk-mabukan. Oleh karena itu, penelitian ini bertujuan untuk mengkaji aspek penegakan hukum dalam menangani kasus-kasus seperti ini melalui teori hukum dan masyarakat. Metode penelitian yang digunakan yaitu metode penelitian sosio-legal, dengan pendekatan kualitatif serta melihat fakta-fakta sosial yang ada dalam masyarakat. Hasil yang ditemukkan dalam penelitian ini menunjukkan bahwa proses penegakkan hukum di Indonesia masih harus dibenahi, bukan hanya berdiri pada kepastian hukum, melainkan perlu dibarengi dengan keadilan yang sesuai dengan keadaan masyarakat.Kata Kunci: Kekerasan Dalam Rumah Tangga (KDRT), Teori Sosial, Penegakan Hukum

Abstract

Abstract:In reality, consumer as users and passenger’s public transportation (Angkot) have not received legal protection and maximum service that should be given regarding the application of minimum service standards. Besides, there are still problems related to public transportation service sector in the form of the decision of public transportation tariff that has not been matched by the availability of public transportation, the proper of public transportation and consumer safety from crime over public transportation. The result of this study explains that public transportation (Angkot) still has many weaknesses especially related to the implementation of minimum service standards.Keywords: Public Transportation, Angkot, Consumer Protection. Abstrak:Konsumen sebagai pengguna jasa maupun penumpang angkutan umum jenis angkot pada realitasnya belum mendapat perlindungan hukum dan pelayanan maksimal yang seharusnya diberikan berupa penerapan standar pelayanan minimal. Disamping masih adanya persoalan mengenai sektor pelayanan angkutan umum berupa: penetapan tarif angkutan umum yang belum atau tidak diimbangi dengan ketersediaan jumlah angkutan umum; kelaikan kendaraan angkutan umum; dan keamanan konsumen dari kejahatan di atas kendaraan angkutan umum. Hasil penelitian ini menjelaskan bahwa selama ini pelayanan angkutan umum jenis angkot ini masih memiliki banyak kekurangan terutama menyangkut penerapan standar pelayanan minimal.Kata Kunci: Angkutan Umum, Jenis Angkot, Perlindungan Konsumen.

Abstract

This study reviews the problems regarding the mechanism for convicting corruption cases in Supreme Court Regulation Number 1 of 2020 concerning Guidelines for Conviction of Article 2 and Article 3 of the Law on the Eradication of Corruption Crimes. The presence of these normative rules has created a de-organization of the freedom of judges which should still reflect and go high the conception of Divine Justice in accordance with the irah-irah which reads "For the Sake of Justice Based on the Almighty Godhead". The research method used is normative juridical research, while the research approach is to use the assessment of statutory policies (statutory approach). The results of this study show that there are still problems in terms of the normative level and their implementation regarding the misalignment between the decisions decided by judges and the conception of Divine Justice in Indonesia.Keywords: Conviction; Divine Justice; Uniformity of MA Regulations AbstrakPenelitian ini mengulas permasalahan mengenai mekanisme dalam pemidanaan kasus korupsi pada Peraturan Mahkamah Agung Nomor 1 Tahun 2020 tentang Pedoman Pemidanaan Pasal 2 dan Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi. Hadirnya aturan normatif tersebut telah menciptakan penderogasian terhadap kebebasan hakim yang seharusnya tetap mencerminkan dan menjunjung tinggi konsepsi Divine Justice yang sesuai dengan irah-irah yang berbunyi “Demi Keadilan Berdasarkan Ketuhanan Yang Maha Esa”. Metode penelitian yang dipakai yaitu penelitian yuridis normatif, sementara pendekatan penelitiannya yaitu menggunakan pengkajian peraturan perundang-undangan (statutory approach). Abstract

This study seeks to explain the topic of the legal liability of e-money card issuers for losses incurred by their clients. Due to imprecise compensation procedures for the issuer, the issuer's legal responsibility is legally deficient, which frequently produces legal doubt for the protection of customers. It renders the e-money issuer legally immune from liability. In particular, this research attempts to create legal comparisons to demonstrate that the compensation and liability mechanism is not exhaustive, using UU No. 8, 1999 on Consumer Protection as an example. This research also discusses compensation for losses incurred by Bank Mandiri customers as a result of the incomplete compensation process outlined in Bank Indonesia Regulation Number 20/6 / PBI / 2018. This study is a legal normative study using a statutory approach (statute approach) and a case study approach (case approach). This research uses literary studies as its method of data collection. Through his or her review of the relevant literature, the researcher gathered and examined several documents using content analysis. The findings of this study demonstrate that the issuer of electronic money cannot be held liable for losses caused by client error. This compensation mechanism can only be used if the error was committed by the electronic money issuer and was determined to be incompatible with the Consumer Protection Law, which prioritizes consumer rights.

Abstract

The directors who are given the responsibility to carry out the company and are fully responsible for managing the company for the benefit of the company. However, the directors have limited liability to the company in accordance with the principle of limit liability, but the principle of limit liability does not apply if the actions or actions of the directors are proven to have committed negligence and mistakes so that their actions are categorized as unlawful and result in losses to the company. The research method used is normative juridical qualitative research through a conceptual approach and a statutory approach. The results of the study stated that the elimination of the limited liability of the directors was due to bad faith in distributing fictitious loans to local people's credit banking companies. Meanwhile, the results of the study concluded that the principle of limit liability for directors would be erased if it could prove that the company's losses were not the result of negligence or mistakes.Keywords: Responsibility; Directors; Bad Faith; Fictitious Credit Abstrak:Direksi yang diberikan tanggung jawab untuk mengemban perusahaan dan bertanggung jawab penuh atas pengurusan perseroan demi kepentingan perseroan. Akan tetapi direksi memiliki batasan tanggung jawab terhadap perusahaan sesuai dengan prinsip limit liability, namun prinsip limit liability tidak berlaku jika saja perbuatan maupun tindakan direksi terbukti melakukan kelalaian dan kesalahan hingga perbuatanya dikategorikan sebagai tindakan melawan hukum dan mengakibatkan kerugian pada perusahaan. Metode penelitian yang digunakan adalah penelitian kualitatif yuridis normatif melalui pendekatan konseptual dan pendekatan peraturan perundang-undangan. Hasil penelitian menyatakan bahwa hapusnya tanggung jawab terbatas direksi akibat itikad tidak baik dalam penyaluran kredit fiktif pada perusahaan daerah bank pengkreditan rakyat. Sedangkan, hasil penelitian menyimpulkan bahwa prinsip limit liability direksi akan terhapus jika dapat membuktikan dimana kerugian perusahaan bukan akibat dari kelalaian atau kesalahannya.Kata Kunci: Tanggung Jawab; Direksi; Itikad Tidak Baik; Kredit Fiktif

Abstract

Exchanges inside the community are commonly alluded to as securities financing exchanges or repos. In certain markets, this will moreover be seen as a prospects exchanging course of action whose essential reason is to lend or borrow cash. In any case, like all other exchange, a repo exchange isn't resistant to the chance of default, and the party who endures a loss due to default will be held at risk for the misfortune in great confidence. Shockingly, this is often not continuously the case. In a commentary titled "Legitimate Suggestions of Buybacks for Customers Who Have Misplaced Believe in Respectful Law," the creator analyzes different sources of data pertinent to entering into buyback understandings, counting the author's own composing fashion. The contention put forward by the creator is that for a substantial exchange the buyer must be a bona fide shopper who is unconscious of any surrenders within the products acquired and the exchange of title must be formalized in composing.
