Abstract

Penahanan merupakan salah satu bentuk tindakan penghentian kemerdekaan seseorang, yang dalam penerapannya seringkali berbenturan dengan hak asasi manusia. Sering kali terjadi tindakan sewenang-wenang oleh penyidik dalam melakukan upaya paksa dilakukan tanpa prosedur yang tepat sehingga tersangka pelaku tindak pidana seperti sudah divonis dihukum bersalah sebelum dinyatakan bersalah berdasarkan kekuatan hukum yang tetap. Pemeriksaan tersangka yang dilakukan oleh penyidik (polisi), seringkali dilakukan dengan tindakan kekerasan dan intimidasi serta bentuk-bentuk pemaksaan lainnya hanya untuk mendapatkan keterangan dan bukti keterlibatan tersangka dalam sebuah perkara. Tulisan ini berusaha mengelaborasi tentang pandangan Hak Asasi Manusia (HAM) dalam memandang penahanan yang dilakukan oleh penyedik (penegak hukum). Kata Kunci: Hak Asasi Manusia, hak tahanan, hukum pidana.

Abstract

This research aimed to explore how the concept of Restorative Justice is applied in resolving criminal acts of theft caused by poverty. Due to the many weaknesses and problems that arise as a result of positive repressive law enforcement, it is deemed necessary to resolve minor criminal cases through non-penal measures by fulfilling the principles of Restorative Justice to safeguard people's lives and to fulfill a sense of justice, rather than carrying out and resolving criminal cases. through the courts, especially for perpetrators of criminal acts of theft caused by poverty. The research method used is Normative Juridical. The research employed a Normative Juridical approach to analyze the concept of Restorative Justice in addressing theft crimes related to poverty. From the research results, it was found that criminal acts of theft which are usually committed because of poverty can be carried out with Restorative Justice efforts considering that the criminal threat under Article 362 of the Criminal Code is no more. from five years because this is one of the requirements according to Prosecutor's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice and Republic of Indonesia Regulation Number 6 of 2019 concerning Criminal Investigation.

Abstract

This article explores the complexities and challenges of understanding and translating Arabic terms in the context of contemporary legal systems. The Arabic language, which is rich in nuances and has a deep Islamic legal heritage, plays a central role in shaping legal foundations. Key terms such as hudud, ta'zir and faraid take centre stage, with an emphasis on the need for a deep understanding of culture and history to ensure accurate interpretation of the law. The article identifies key challenges, including contextual differences and terminological discrepancies between countries, and details the impact of misunderstanding Arabic on the fair enforcement and harmonisation of international law. By inviting in-depth reflection, the article highlights the importance of a cautious approach and interdisciplinary collaboration to ensure that Arabic is not only correctly translated, but also contextually understood in an increasingly complex and cross-border connected contemporary law.
