Abstract

Tujuan penelitian adalah untuk mengetahui konsep ikhtikar perspektif hukum positif. Penelitian ini merupakan jenis penelitian deskriptif analisis, dengan metode penelitian kepustakaan (library research) dan jenis penelitian kualitatif, serta analisis data dengan menggunakan pendekatan atau cara berpikir deduktif. Hasil dari penelitian menunjukkan bahwa ikhtikar dalam hukum positif yaitu penimbunan barang. Penimbunan adalah kegiatan menimbun barang pada barang pokok dan barang penting pada jumlah dan waktu tertentu. Hukum penimbunan barang dalam hukum positif tidak boleh. Penimbunan kebutuhan pokok dan barang penting di dalam gudang dalam jumlah dan waktu tertentu yang terjadi ketika terjadi kelangkaan barang, gejolak harga, dan hambatan lalu lintas perdagangan barang. Dan haram hukumnya menimbun barang menurut kalangan Syafi’iyah dan hukum positif pelaku usaha dilarang menyimpan barang pokok dan barang penting

Abstract

This study aims to determine the practice of adopting children as well as review Islamic law and positive law regarding child adoption in society. This study uses the method of "library research" and "field research" document review, observation, and interviews. The results showed that the mechanism for implementing child adoption among the community, the stages carried out by the community there was no special event or other rituals in the adoption process, but only by doing small feasts, and the reason for adopting children was because families who adopted children tended to because they do not have children of their own. Then it is recommended to every adoptive parent to find out how the procedure for adopting a child is correct according to religion and state laws and regulations, and to religious leaders and community leaders so that they can socialize the procedures for adopting children by Islamic teachings and applicable regulations. regarding the adoption of children, so as not to cause problems in the future.

Abstract

This paper discusses the issue of post-divorce puberty child custody. In our daily life we often encounter in society, that after the divorce of parents of children we often find that we lose our identity. We encounter various kinds of judgments in the midst of society towards divorced families. Even though the problem of divorce is not a new problem in Islam. Shari'a has arranged in such a way for every follower of Islamic teachings in a very systematic way. As we will discuss here, every husband and wife who has divorced Islam provides steps that are mutually beneficial, even children are also regulated by Shari'ah regarding the rights of children when their parents are separated. Therefore, parents should hold each other back to avoid divorce in the household for the sake of children who still need perfect attention and affection from both parents. According to Islam, the child has the right to be cared for by the mother if he is still small and if he has entered puberty, the child may choose to live with the father or mother, this depends on the wishes of the child. However, if a child who has entered puberty chooses to live with his mother, the mother may not restrain the child from being with his father and vice versa. This is done to meet the needs of love and attention from both parents which are still very much needed by puberty children.
