Abstract

Terdapat banyak faktor yang mempengaruhi pengulangan tindak pidana narkotika oleh pelaku (bandar narkotika) bukan tanpa alasan, hal tersebut dikarenakan bandar narkotika ini sendiri masih memiliki harta kekayaan yang diperolehnya dari hasil penjualan narkotika, sehingga setelah terpidana narkotika tersebut bebas dari lembaga pemasyarakatan mantan narapidana ini dapat mengulangi tindak pidana yang sebelumnya ia lakukan, bahkan terdapat juga jaringan pengedaran narkotika yang dikendalikan dari dalam lembaga pemasyarakatan atau bahkan dapat membentuk jaringan yang lebih besar dan tetap menjalankan kejahatannya dari dalam lembaga pemasyarakatan, dimana hal tersebut adalah bukti nyata dari dampak tindak pidana pencucian uang yang dilakukan oleh para pengedar tindak pidana narkotika. Oleh karenanya upaya pemberantasan tindak pidana pencucian uang dari hasil tindak pidana narkotika ini menjadi penting bukan hanya menjadi sebuah penegakan hukum semata terhadap upaya pemberantasan tindak pidana pencucian itu sendiri melainkan juga sebagai upaya pencegahan terhadap pengulangan tindak pidana narkotika.

Abstract

The discussion in this paper is entitled Fulfillment of the Rights of Pregnant Prisoners in Class IIA Women's Correctional Institution Bandar Lampung which is a study to find out how the guidance provided by the Class IIA Women's Correctional Institution Bandar Lampung to pregnant women inmates. Because basically female inmates have different natures from men, such as menstruation, pregnancy, childbirth, and breastfeeding. The formulation of the problem in this study consists of the first to examine how to fulfill the rights of inmates who are pregnant in Class IIA Women's Correctional Institution Bandar Lampung and are there any inhibiting factors in fulfilling the right to obtain health services for inmates who are pregnant? This type of research is a field using an empirical juridical approach. The empirical juridical approach is the collection and discovery of data and information through field studies at the Class IIA Women's Correctional Institution in Bandar Lampung, aiming to study the reality that occurs in the field. This study concluded that the fulfillment of the rights of the inmates who were pregnant and breastfeeding had been fulfilled properly in accordance with Law Number 12 of 1995.

Abstract

Cross border surrogacy presents complex legal issues in Indonesia because no specific rule determines the legal status of a child born through a surrogacy arrangement abroad, while Article 58 of Law Number 17 of 2023 permits assisted reproduction only when an embryo created from a married couple's own gametes is implanted in the wife from whom the ovum originated. Existing discussions commonly separate the permissibility of surrogacy, nasab (lineage), foreign parentage, citizenship, and children's rights. The research gap lies in the absence of an integrated Indonesian framework that distinguishes the invalidity of the adult arrangement from the continuity of the child's legal status. This normative legal study applies statutory, conceptual, case, and functional comparative approaches, comparing Indonesia with France, the United Kingdom, and India. The study identifies four dimensions of legal vacuum: substantive parentage rules, conflict of laws rules, judicial and registration procedures, and inter institutional coordination. Its novelty is a two-track status separation model: an ex ante track that retains prohibition or strict restriction of surrogacy, and an ex post track that guarantees birth registration, nationality assessment, judicial determination of parentage, non-abandonment, maintenance, and access to origin information according to the child's best interests. Thus, protecting the child does not legalise surrogacy; it prevents the rejection of adult conduct from becoming the legal abandonment of the child.
