Abstract

This article is the result of research that aims to explain the importance of study about socio-legal. The rapid development of society can lead to problems in life. Human beings must immediately fulfill the demands of practical interest. Therefore, sociolegal development as a discipline of law closely related to real-life in society becomes an urgent role. Various problems in social relations require the role of the law to solve them. We see how the law of life and development in society becomes essential in the science of law because law and society can not be separated. The research method used is a literature review with a philosophical approach. The research results show that sociolegal study is significant to see and understand the law in real life in society. The method of generalized inductive reasoning becomes sociolegal to understand it, and its practical value of use makes sociolegal a legal discipline that can follow the realities of the times.Artikel ini adalah hasil penelitian yang bertujuan untuk menjelaskan pentingnya studi tentang sociolegal. Perkembangan masyarakat yang pesat dapat menyebabkan masalah dalam kehidupan. Tuntutan kepentingan praktis harus segera dipenuhi oleh manusia. Oleh karena itu, pengembangan sociolegal sebagai disiplin ilmu hukum yang erat kaitannya dengan kehidupan nyata dalam masyarakat menjadi peran yang mendesak. Ada berbagai masalah dalam hubungan sosial yang membutuhkan peran hukum untuk menyelesaikannya. Melihat bagaimana perkembangan hukum dan pembangunan dalam masyarakat menjadi penting dalam ilmu hukum, karena hukum dan masyarakat tidak dapat dipisahkan. Metode penelitian yang digunakan adalah studi pustaka dengan pendekatan filosofis. Dari hasil penelitian menunjukkan bahwa kajian sosiologi hukum sangat penting untuk melihat dan memahami hukum dalam kehidupan nyata di masyarakat. Metode penalaran generalisir induktif membuat sociolegal untuk mendapatkan pemahaman tentang itu dan nilai praktis penggunaannya membuat sosiologi hukum merupakan disiplin hukum yang dapat mengikuti realitas zaman.

Abstract

The study aims to analyze criminal liability for perpetrators who disseminate intimate content without consent (revenge porn) and to assess the effectiveness of legal protections for victims based on the framework of the Electronic Information and Transactions Law (ITE Law) and Indonesian criminal law. The method employed is normative legal research using a legislative and conceptual approach, supplemented by an examination of relevant law enforcement practices to assess the application of norms and principles of criminal liability. The novelty of this study lies in its critique of the inability of Indonesia’s cybercriminal law regime to classify revenge porn as a consent-based crime. To date, the provisions in the ITE Law have placed greater emphasis on aspects of public decency, and thus have not been fully capable of addressing the harms arising from violations of the victim’s privacy. This study proposes a new normative framework that establishes a violation of consent as the basis for criminal liability, thereby ensuring that the concept of revenge porn is understood not only as a violation of public decency but also as a violation of an individual’s right to privacy and dignity. The findings indicate that although the ITE Law has established a legal basis for criminalizing the dissemination of intimate content without consent, its implementation still faces normative and technical obstacles, such as ambiguous legal provisions, overlapping regulations with the Pornography Law and the Criminal Code, weak digital evidence mechanisms, and insufficient protection for victims who continue to suffer psychological and social harm. The conclusions of this study underscore the need for more specific regulatory updates regarding electronic-based sexual crimes, clarification of legal boundaries within the ITE Law, strengthening of the “right to be forgotten” mechanism, and capacity building for law enforcement officials so that legal protection for victims of revenge porn can be realized more effectively, fairly, and with a focus on the victims’ recovery.

Abstract

Sexual intercourse with children is a criminal offense that causes long-term physical, psychological, and social harm. The dominance of retributive sentencing raises concerns about the marginalization of victim recovery and restorative justice. This study examines whether Indonesian criminal law, in practice, has integrated victim-oriented protection and restorative principles in adjudicating sexual offenses against minors. Using normative legal research with a case approach, it analyzes statutory child protection provisions and the ratio decidendi of Ponorogo District Court Decision Number 16/PID.SUS/2025/PN Png, focusing on the construction of fault (schuld), judicial reasoning, and sentencing orientation, particularly regarding juvenile consent and restorative justice. The findings show that the court strictly applied Article 81 paragraph (2) of the Child Protection Law, affirming the legal irrelevance of a child’s consent and recognizing persuasion through promises of marriage as sufficient to establish intent (dolus). The defendant was sentenced to eight years’ imprisonment and a fine of IDR 200 million, reflecting a predominantly retributive and deterrent approach. However, the judgment gave limited attention to restorative justice, as victim recovery, psychological rehabilitation, and participatory restorative measures were not explicitly incorporated into the sentencing rationale..

Abstract

The enforcement of gross human rights violations in Indonesia continues to face significant normative and institutional challenges, particularly in the relationship between the National Commission on Human Rights (Komnas HAM) and the Attorney General's Office under Law No. 26 of 2000 on Human Rights Courts. In practice, the resolution of such cases is often delayed by repeated returns of investigation files, weak inter-agency coordination, and the limited authority of Komnas HAM, which is restricted to preliminary investigations without investigative or prosecutorial powers. This study examines the weaknesses in the current allocation of authority and proposes institutional reforms from constitutional law and human rights perspectives. This research employs a normative legal method using statutory, conceptual, and case approaches. Lawrence M. Friedman's legal system theory provides the analytical framework for assessing the structural and substantive dimensions of human rights enforcement in Indonesia. The findings indicate that Komnas HAM's dependence on the Attorney General's Office at the investigation and prosecution stages has contributed to legal uncertainty and impeded the fulfillment of victims' rights to justice. The study further finds that Law No. 26 of 2000 does not provide a clear mechanism for following up on Komnas HAM's findings or establish time limits for case resolution. The study contributes to the literature by proposing reforms grounded in state responsibility and victims' rights. It recommends amending Law No. 26 of 2000 to strengthen institutional coordination, establish mandatory follow-up procedures for Komnas HAM's findings, and enhance the protection of victims' rights within Indonesia's human rights enforcement framework.

Abstract

ABSTRACT Purpose of Study: This research aimed at analyzing Supreme Court Decision No. 575 K/Pdt/1983 and Supreme Court Decision No. 2686/Pdt/1985 concerning cumulative lawsuits and tort according to the judge's legal reasoning.  Methodology: This is library research using the normative juridical method. The approach used was the statutory approach. The statutory approach was carried out by analyzing Supreme Court Decision No. 575 K/Pdt/1983 and Supreme Court Decision No. 2686/Pdt/1985 in the context of the cumulative lawsuit and tort section. Result: This research found that even though unlawful acts and contracts are conventionally separated, there are still issues regarding overlapping understandings of the concepts of tort, cumulative lawsuit, and default in law. For example, there is an act by one party that, on the one hand, can be classified as an unlawful act, but it also has a contractual element. Similarly, one party’s actions have contractual consequences for the other party, but they can also result in liability based on tort. This condition causes several parties to accumulate lawsuits for unlawful acts and defaults at the same time. Supreme Court accepted the cumulative lawsuit in decision No. 575 K/Pdt/1983 and Supreme Court Decision No. 2686/Pdt/1985, indicating that it does not violate procedural law. Applications of this study:  This research is useful for analyzing Supreme Court Decision No. 575 K/Pdt/1983 and Supreme Court Decision No. 2686/Pdt/1985. These Supreme Court decisions have a ratio decidendi or jurisprudence that a cumulative lawsuit is permitted and it does not violate procedural law. Novelty: There are no previous researchers who conducted a legal analysis of the Supreme Court's decision, even though the Supreme Court is the jurisprudence in cases or legal issues of cumulative lawsuits and tort.   Keywords: Cumulation, Against the Law, Default, Decision, Ratio Decidendi  ABSTRAK  Tujuan: Penelitian ini bertujuan untuk menganalisis Putusan Mahkamah Agung No. 575 K/Pdt/1983 dan Putusan Mahkamah Agung No. 2686/Pdt/1985 tentang gugatan kumulatif dan perbuatan melawan hukum menurut penalaran hukum hakim.  Metodologi: Penelitian kepustakaan ini menggunakan metode yuridis normatif. Pendekatan yang digunakan adalah pendekatan Perundang-undangan. Pendekatan perundang-undangan dilakukan dengan menganalisis Putusan MA No. 575 K/Pdt/1983 dan Putusan MA No. 2686/Pdt/1985 dalam konteks gugatan kumulatif dan pasal perbuatan melawan hukum.  Hasil: Penelitian ini menemukan bahwa meskipun perbuatan melawan hukum dan perjanjian dipisahkan secara konvensional, masih terdapat permasalahan mengenai tumpang tindih pemahaman tentang konsep gugatan, gugatan kumulatif, dan wanprestasi dalam hukum. Misalnya, ada perbuatan salah satu pihak yang di satu pihak dapat digolongkan sebagai perbuatan melawan hukum, tetapi juga mengandung unsur perjanjian. Demikian pula, tindakan satu pihak memiliki konsekuensi kontraktual bagi pihak lain, tetapi tindakan tersebut juga dapat mengakibatkan pertanggungjawaban berdasarkan kesalahan. Kondisi ini menyebabkan beberapa pihak menumpuk tuntutan atas perbuatan melawan hukum dan wanprestasi secara bersamaan. Mahkamah Agung menerima gugatan kumulatif dalam putusan No. 575 K/Pdt/1983 dan Putusan MA No. 2686/Pdt/1985, yang berarti tidak melanggar hukum acara.  Aplikasi penelitian ini: Penelitian ini berguna untuk menganalisis Putusan Mahkamah Agung No. 575 K/Pdt/1983 dan Putusan Mahkamah Agung No. 2686/Pdt/1985. Putusan Mahkamah Agung ini memiliki ratio decidendi atau yurisprudensi bahwa gugatan kumulatif diperbolehkan dan tidak melanggar hukum acara.  Kebaruan/Orisinalitas: Belum ada peneliti terdahulu yang melakukan analisis hukum terhadap putusan MA, padahal MA merupakan yurisprudensi dalam perkara atau permasalahan hukum kumulatif gugatan dan perbuatan melawan hukum. Abstract

Judicial ethics constitutes a fundamental pillar in ensuring justice, integrity, and accountability within legal systems. In Islamic teachings, the judicial profession is regarded as an amanah (trust) that requires judges to uphold ethical and moral principles in carrying out their duties. This study aims to analyze the ethical principles that guide judicial conduct from an Islamic perspective and to examine their relevance to contemporary judicial professionalism. This study employed a normative juridical approach using statutory and conceptual approaches. Data were collected through library research from legal regulations, Islamic legal sources, academic books, and scholarly journal articles, and were analyzed qualitatively through descriptive and thematic analysis. The findings reveal that Islamic judicial ethics is fundamentally grounded in the prophetic values of shidiq (truthfulness), amanah (trustworthiness), tabligh (transparency), fatanah (competence and wisdom), and istiqamah (consistency). These ethical values provide a comprehensive framework for judicial conduct by integrating moral integrity, professional responsibility, and spiritual accountability. The study further finds that Islamic judicial ethics contributes significantly to the realization of maqāṣid al-sharī‘ah through the protection of rights, prevention of injustice, and promotion of social welfare. Moreover, Islamic judicial ethics demonstrates substantial compatibility with contemporary judicial standards, particularly the principles of independence, impartiality, integrity, accountability, equality, and competence reflected in the Bangalore Principles of Judicial Conduct. This study concludes that Islamic judicial ethics remains highly relevant as a normative and practical framework for strengthening judicial professionalism, enhancing public trust, and improving judicial governance in contemporary legal systems.

Abstract

This study examines the hypocritical attitudes of officials in this country from a critical juridical perspective with a moral dimension. The method used in this study is a literature study method with a legal philosophy approach. This study also uses relevant empirical and normative legal data to support the research. The urgency of this research is the increasingly disturbing hypocritical attitudes of officials in this country, which have a negative impact on the life of the nation. Law is an instrument that plays a crucial role in improving this situation. This research differs from previous research that has focused more on the study of cases of violations of positive law by state officials. Meanwhile, this study has a critical dimension through legal morality towards the hypocritical attitudes of officials. The novelty of this research is also evident in the issue of hypocrisy of officials, which is the main topic of study, rather than violations of laws and regulations. The dimension of moral attitudes that is rarely touched by the law becomes a separate and different study in this study.
