Abstract

Determination of the beginning of the month of Qamariah is very necessary, this is related to worship, such as determining the period of iddah, haul zakat, fasting and other transactions. People become restless when the determination of the beginning of the month is different between Islamic organizations and the government. The image of Muslims becomes even worse in the eyes of non-Muslims when there is conflict. This study aims to reveal the causes of differences of opinion in determining the criteria for the beginning of the month, efforts to unite opinions, and unification of vision in determining the criteria for the beginning of the month of Qamariah. The research method used is a literature study with a descriptive analysis approach. Data collection on the procedure for determining the beginning of the month of Qamariah started from the time of the Prophet Muhammad who adhered to rukyat. The results showed that the difference in determining the criteria for the beginning of the month of Qamariah was due to the way to understand the arguments about the rukyat and reckoning methods. Unification can be done by holding muzakarah, training and deliberation every year at the isbat session. The Hisab Rukat Agency (BHR) of the Ministry of Religion of the Republic of Indonesia determines the criteria for the beginning of the month using the Ru'yah Imkan method, which is to see the height of the new moon at least two degrees above the horizon at sunset. Unifying the vision for the commonality of each mass organization by holding training, seminars, involving BMKG and LAPAN. At its peak, an isbat meeting was held that nationally the beginning of Ramadan, Shawwal and Eid al-Adha was determined. Alternative unification of ru'yah and astronomical calculations, by seeing directly using the senses of sight and science so that an astronomical view enters by looking at the calculations hinted at in the Qur'an Surah al-Baqgarah verse 189, Arrahman verse 5, Yunus verse 5, Yasin verse 39 and at-Taubah verse 36.Keywords: Qamariyah month, reckoning rukyat, determination

Abstract

This research was motivated by the fact that breast milk is the most important and best nutrition for babies from birth, but what happened in Tanjung Senang District was different. there are mothers who are reluctant to give breast milk to their children for various reasons, both acceptable and unacceptable reasons. The formulation of the problem in this study is how the views of Islamic law on the reluctance of a mother to give breast milk (ASI) to children in Tanjung Senang District, Lampung. This type of research is a field research using a descriptive qualitative approach. The approach in this study was intended to identify and describe the reluctance and implementation of breastfeeding by mothers in Tanjung Senang District, Lampung. The technique of collecting data in this research is by interviewing mothers, health workers and religious leaders. Based on the research conducted, it can be concluded that some mothers are reluctant to give breast milk to their children. The reluctance of mothers that occurred in Tanjung Senang District not to breastfeed for various reasons. There is a lack of knowledge, work, breastfeeding is the same as formula milk, lifestyle, breast milk doesn't come out, cannot get support from family and some people's habit of replacing breast milk with other drinks and foods. According to Islamic law, breastfeeding is mandub or recommended. The law of mandub can become mandatory if it harms the soul or the growth of the baby. On this basis, the mother does not give breast milk without a clear reason and contrary to the Shari'a that the mother is seen as lacking in carrying out her religion and obligations because it will make the baby's growth unfulfilled.

Abstract

This paper examines the concepts of muthlaq and muqayyad within the context of Islamic law, employing the Mutakallimin and Hanafiyah methods. These two concepts are crucial in understanding and interpreting legal texts in the Quran and Sunnah. Muthlaq refers to an unbound or unrestricted term, while muqayyad refers to a term that has been restricted by another term. This research uses a literature review method to analyze the definitions, examples, and applications of the concepts of muthlaq and muqayyad. The differences between the Mutakallimin and Hanafiyah methods in interpreting these two concepts are also discussed and compared.

Abstract

The development of information technology today has made the social media platforms YouTube and Instagram very popular and has given birth to many YouTuber and Celebgram content creators. Content creators use this social media platform as a means to earn income with fantastic financial value of up to hundreds of millions, even billions of rupiah every month. This article aims to discuss zakat for YouTubers and Celebgrams. By using the library research method with a normative approach, this article provides answers to the issue of zakat for YouTubers and Celebgrams. This article concludes that: First, Yusuf al-Qardhawi views income YouTubers and Celebgram is included in al-mâl al-mustafâd, and must be given zakat. Second, there are differences of opinion as to whether zakat is paid to gold and silver zakat, or agricultural zakat. Yusuf al-Qardhawi in one condition qiyas the provisions of agricultural zakat. In other conditions, if the nisab is not met then zakat is paid to gold and silver. Meanwhile, based on MUI Fatwa No. 3 of 2003 concerning Income Zakat, reinforced by MUI Fatwa No. 04 of 2024 concerning Zakat for YouTubers, Celebrities, and Other Digital Creative Economy Actors, its implementation is subject to zakat on gold and silver. Al-Qardhawi's opinion and the provisions contained in the MUI Fatwa, provide an answer to the need to determine zakat law for the income of YouTubers and Instagram celebrities, as part of the dynamic development of information technology which has resulted in the development of contemporary law in the field of zakat. Perkembangan teknologi informasi saat ini menjadikan platform media sosial YouTube dan Instagram menjadi sangat diminati dan melahirkan banyak pelaku konten kreator YouTuber dan Selebgram. Pelaku konten kreator menjadikan platform media sosial ini sebagai sarana untuk meraup penghasilan dengan nilai finansial yang fantastis hingga mencapai ratusan juta, bahkan milyaran rupiah setiap bulannya. Artikel ini bertujuan untuk mendiskusikan zakat bagi YouTuber dan Selebgram. Dengan menggunakan metode library research dengan pendekatan normatif, artikel ini memberikan jawaban terhadap persoalan zakat bagi YouTuber dan Selebgram. Artikel ini menyimpulkan bahwa: Pertama, Yusuf al-Qardhawi memandang pengasilan YouTuber dan Selebgram termasuk dalam al-mâl al-mustafâd, dan wajib untuk dizakatkan. Kedua, terdapat perbedaan pendapat apakah penunaian zakatnya diqiyaskan kepada zakat emas dan perak, atau zakat pertanian. Yusuf al-Qardhawi pada satu kondisi meng-qiyaskan pada ketentuan zakat pertanian. Pada kondisi lain, jika nisabnya tidak terpenuhi maka diqiyaskan kepada zakat emas dan perak. Sementara, berdasarkan Fatwa MUI No. 3 Tahun 2003 tentang Zakat Penghasilan, diperkuat dengan Fatwa MUI No. 04 Tahun 2024 tentang Zakat YouTuber, Selebgram, dan Pelaku Ekonomi Kreatif Digital Lainnya, pelaksanaanya diqiyaskan kepada zakat emas dan perak. Pendapat al-Qardhawi serta ketentuan yang termuat pada Fatwa MUI, memberikan jawaban terhadap kebutuhan penetapan hukum zakat bagi penghasilan YouTuber dan Selebgram, sebagai bahagian dari dinamika perkembangan teknologi informasi yang berakibat pada perkembangan hukum kontemporer dalam bidang zakat.

Abstract

Artikel ini menganalisis pertimbangan hukum hakim dalam Putusan Nomor 48/Pdt.G/2023/PA.Pdg terkait sengketa pembiayaan murabahah dan pengabulan eksepsi kompetensi absolut berdasarkan klausula pilihan forum dalam akad. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan studi putusan. Hasil penelitian menunjukkan adanya ketegangan antara asas kebebasan berkontrak dan norma kewenangan absolut yang bersifat imperatif dalam hukum ekonomi syariah. Diperlukan interpretasi sistematis dan teleologis untuk menjaga integritas rezim hukum ekonomi syariah.Kata Kunci: kompetensi absolut; murabahah; klausula forum; ekonomi syariah

Abstract

This article discusses the concept of Dilalah Lafzhiyah in the Hanafi school of thought by reviewing it from the Shafi'i perspective and applying it to contemporary cases involving the use of artificial intelligence (AI) as a substitute for muftis. The development of AI technology capable of generating religious answers raises questions regarding the legitimacy of AI's role in providing religious information such as fatwas. This issue requires an analysis of usul fiqh, particularly in the discussion of ad-dilalah as the main instrument for understanding and deriving laws from the texts of the Qur'an and Sunnah. In usul al-fiqh, the Hanafi and Shafi'i schools of thought have different methods of classifying and using ad-dilalah. The Hanafi school divides dilalah into two broad categories: dilalah lafzhiyyah and dilalah ghairu lafzhiyyah, while the Shafi'i school divides it into dilalah manthuq and mafhum. This study uses a descriptive-comparative analysis method by examining the main literature of both schools and then applying it to arguments related to fatwa authority. The results of the study show that, terminologically, there are differences in expression between the Hanafi and Shafi'i schools, but substantively, many concepts have equivalent meanings. For example, the concepts of Ibarah Nash, Isyarah Nash, and Iqtidha' Nash in Hanafiyah are comparable to Manthuq in the jumhur ulama. Similarly, Dilalah Nash in Hanafiyah is equivalent to Mafhum Muwafaqah in the jumhur. However, the main difference lies in Mafhum Mukhalafah, which is recognized by the jumhur ulama but not by Hanafiyah. In the context of AI as a substitute for muftis, the Shafi'i approach, which accepts mafhum mukhalafah, tends to reject the legitimacy of AI as an independent mufti, because it understands ahl adz-dzkr as rational and competent subjects. Conversely, the Hanafi approach, which does not consider mafhum mukhalafah as evidence, opens up a more limited scope of analysis on the function of AI as a tool, not as an authority on fatwas.

Abstract

This paper examines the transformation of Islamic politics and civilization from the classical period to the modern era, as well as the contributions of Islam to the development of global knowledge. In the classical period, Islamic civilization was characterized by strong political institutions, intellectual openness, and the integration of religious and rational sciences, which enabled significant advancements in science, medicine, philosophy, and social thought. However, internal political fragmentation, external pressures, and colonial domination led to the decline of Islamic political power and intellectual influence. The modern period marks a phase of transformation in which Muslim societies faced the challenges of modernization, Western influence, and the reconfiguration of political and intellectual frameworks. Despite these challenges, Islam continued to contribute to global knowledge through its rich scientific heritage, methodological approaches, and ethical perspectives. The transmission of Islamic knowledge to Europe played a crucial role in shaping modern science and the Renaissance. This study highlights that the transformation from classical to modern Islamic civilization reflects both continuity and change, demonstrating the enduring relevance of Islamic intellectual traditions in the contemporary world.
