Abstract

Tujuan penelitilan untuk mengetahui dallam perkara pidana pasca putusan Mahkamah Konstitusi No.20/PUU-XIV/2016 tentang sistem pembuktian elektronik dalam tindak pidana. Teknik Penellitian Menerapkan metode normatif untuk menyelidiki penerapan aturan atau norma dalam hukum positif dengan pendekatan undang-undang dan pendekatan kasus yang membahas tentang legalitas penggunaan alat bukti elektronik untuk membuktikan suatu kejahatan melalui penggunaan penelitian hukum lnormatif. Teknlik pengambilan bahan hukum dengan bahan hukum primer adalah dengan mencari, memahami, dan menguraikan dalam bentuk peraturan perundang-undangan, putusan pengadilan yanlg telah mempunyai kekuatan hukum tetap dengan menggunakan bahan hukum sekunder, yang dilakukan dengan cara mengumpulkan bahan kepustakaan guna memahami putusan. permasalahan hukum sekaligus sebagai pedoman, dan bahan hukum tersier sebagai bahan hukum tambahan yang dapat menemukan istilah-istilah hukum dalam bentuk kamus. Dalalm penlelitian ilni menawavrkan kebaruan yalitu perubahan sistem pembuktilan sebelum dan sesudah adanya putusan Mahkamah Konstitusi. Hasil penelitian ini yaitu seiring dengan perkembangan teknologi, bukti elektrlonik menjadi bagian dari alat bukti yang salalh jika mengacu pada undang-undang khusus. Allat bukti elektrlonik merupakan bagian dari alat bukti petunjuk, artinya alat bukti elektronik bukanlah alat bukti yang berdiri sendiri. Kata kunci: : legalitas, pembuktian, alat bukti elektronik

Abstract

Protection of clear legal rights for persons with intellectual disabilities is promulgated in Law No. 8/ 2016. However, these legal provisions face disharmony because they are out of sync with the laws and regulations that govern criminal justice in the matter of being a victim-witness. This conflict between law and related legislation raises the most important ambiguity in matters of law enforcement. therefore, must try horizontal sync. Legal requirements regarding the standard procedure for determining witnesses for a variety of disabilities, the obligation to assist mentally retarded people linked to legal expertise and accessibility for persons with disabilities in court of law. The government needs as soon as possible to draft a government regulation as the implementing provision of Law No. 8/ 2016, so that there is clarity and legal certainty, especially for law enforcers and people with intellectual disabilities

Abstract

According to DKPP Regulation No. 1 of 2021, Second Amendment to Election Organizer Ethics Council Regulation No. 3 of 2017, Regulation No. 3 of the Procedure for the Procedure for the General Election Organizer Code of Ethics Article 39(1), DKPP reserves the right to: make final and binding decisions. However, DKPP Decision No. 317-PKE-DKPP/X/2019 decided to impose a permanent dismissal sentence on Evi Novida Ginting Manik, Commissioner of the The President of the Republic of Indonesia promptly issued Presidential Decree No. 34/2020 P for the disrespectful removal of a member of the General Election Committee for the 2017-2022 term. By PTUN Decision No. 82/G/2020/PTUN-JKT, the judge issued his 2020 Presidential Decree No. 34 regarding the disrespectful dismissal of a member of the General Election Commission from 2017 to his 2022 term. /P overturned. The method of this paper uses a form of research called normative legal research. A method of collecting materials by searching library materials, reading and researching various documents such as books, laws, articles, and other primary, secondary, and tertiary legal codes. The investigation conducted in this letter covers Law No. 7 of 2017, decisions of the Administrative Court, decisions of the DKPP and related Presidential Decrees. Institutionally, the DKPP's position is equivalent to that of the KPU and Bawaslu, both of which are national, permanent and independent electoral authorities. Considering the Supreme Court's ruling No. 31/puu-xi/2013, which is final and binding, the DKPP's decision is definitive and binding on the President, KPU, Provincial KPU, Regency/Municipality KPU, and Bawasul. layout. His final and enforceable DKPP ruling is not the same as a judicial final and enforceable judgment, but it is final and enforceable and comparable to a TUN decision. Institutionally, the Honorary Council of Electoral Organizations (DKPP) status in the Indonesian legal system is either a subordinate body of the government or an independent supporting government agency. In practice, the DKPP's decisions are not final. This is because it implies the finality of judicial decisions in general and MK decisions in particular. It is so named because the Presidential Decree, Provincial KPU, Regency/Municipality KPU, and Bawaslu, Provincial Bawaslu, Regency/Municipality Bawaslu are still required to implement the decisions of the DKPP

Abstract

The purpose of this study was to determine how the rules of law and how legal certainly regarding the terms of good looking at job vacancy information, which is by methodempirical juridical research concluded : 1. that by including good looking requirements in employee vacancy information is a form of discrimination and violates the rules of law regarding the requirements that may be included in job vacancy information according to Article 15 Paragraph (3) of the Minister of manpower Regulation Number 39 of 2016 concerning the placement of Labor and Law Number 39 of 1999 concerning human rights. 2. employees who are hired should be seen from the abilities and competencies that match the demands of the job not from their physical appearance. 3. if a company requires good looking requirements, then these requirements do not need to be included in job vacancy information, because good looking has a subjective nature.

Abstract

In the study of law there is always concern about the applicability of a statutory regulation. The concern, if explored further, is the inability to carry out responsibilities which can be caused by many things, including ignorance of what is being faced, inability to resolve legal issues resulting in rejection, inability due to cases that affect. Community service activities are carried out from January to February 2023. The purpose of community service is ultimately to provide an understanding for Candipari Village that receiving grants from universities is actually very helpful for the village in implementing its program. The grant funds referred to are like the Matching Fund where there are provisions in kind that villages generally already have so that the achievement of the program according to the current year's APBDes is achieved more quickly

Abstract

The Unitary State of the Republic of Indonesia (NKRI) as a legal state based on the Almighty God has an obligation to protect the rights of its citizens, including press freedom. Press freedom, as the fourth pillar of democracy, is guaranteed by the 1945 Constitution and Law of the Republic of Indonesia Number 40 of 1999 on the Press, which guarantees the right to obtain and disseminate information. However, recent laws such as Law No. 19 of 2016 on Electronic Information and Transactions (ITE Law) and its revision in Law No. 1 of 2024, along with provisions in the Criminal Code, pose potential norm conflicts with press freedom. Articles in the ITE Law are often used to curb press freedom, contrary to the Press Law which provides legal protection for journalistic activities. This research uses a normative legal method to analyze the conflict of norms between the ITE Law, the Criminal Code, and the Press Law. Through this approach, the research examines how legal principles such as Lex Superior Derogat Legi Inferiori and Lex Specialis Derogat Legi Generalis can be applied to resolve conflicts and ensure effective protection of press freedom within the Indonesian legal framework
