Abstract

Mass organizations registered with The National Unity and Politics Agency of Lampung Province are not in accordance with the number of mass organizations currently in Lampung Province which means that there are still many mass organizations that are not yet registered with The National Unity and Politics Agency of Lampung Province. The problem in this study is how is the implementation of Mass Organization Control in Lampung by The National Unity and Politics Agency? and what are the obstacles in the implementation? The results of this study, namely the implementation of controlling mass organizations in Lampung at this time is still not optimal due to the obstacles faced, namely the limited number of employees of the Lampung Province The National Unity and Politics Agency, limited budget, not yet optimal socialization of regulations, facilities and infrastructure has not been maximized, lack of public awareness, lack of knowledge of the management of mass organizations regarding the obligation to register their organizations.

Abstract

Rule of Law village Badran Sari and Nuts Rejo in the system of hierarchy legislation of village regulations is no longer mentioned explicitly as a type of legislation. That is, the position of village rule is considered only as a further description of the higher legislation, but there is no local government to give village empowerment. The process of establishing a village regulation covering the implementation of the village regulation Program Badran Sari and Nuts Rejo in central Lampung District, Badran Sari Village is already in accordance with the Village Regulation reference Number 6 year 2014 about the village and the role of village head and the village consultative agency while Natan Rejo village has not applied the village regulation and regulations in accordance with Law No. 6 of 2014 but it is appropriate as the absolute rule of the village head without any discussion and consultation with the community in advance. Constraints faced in the establishment of regulations village Badran Sari and Nuts Rejo in central Lampung regency. In the village of Badran Sari that they are experiencing obstacles that relate to the reason of the retribution in the village government, while the village of Nuts Rejo Kecamtan Elephant City is the quality of the performance of villages and BPD is less maximal, lack of socialization of village government to the community, and the performance capabilities of village governance.

Abstract

The village is a unit of the legal community that has a genuine arrangement based on the privileged origin rights. The cornerstone of the thinking on village governance is diversity, participation, autonomy, democratization and community empowerment. The result of the study is the Implementation of Article 19 of Government Regulation No. 60 of 2014 on Village Funds sourced from the State Revenue and Expenditure Budget in Rama Yana Village Sub-District Seputih Raman Central Lampung Regency is currently done in accordance with government regulations but not yet maximized. The problem is still the lack of knowledge of village apparatus in understanding the rules about village fund management, lack of understanding of the tupoksi of each position, delay in the transfer of village funds, system of management of the village administration that is not optimal, lack of aspiration and active role of the community, ineffective communication between the community and the village head.

Abstract

The unclear regulation on the power of President as the highst war Command of the Army, Navy And Air Force, raises the problems in the practices of Indonesian State. It has the scope and implementation of power of President based on Article 10 Constitution. The method of this research used this paper is juridical normative, juridical historic, and juridical comparative. The research was undertaken on library research to collect primary, and tertiary data. The result of research, showed that scope of President power based on article 10 of the 1945 Constitution include the financial, personal, and National defense. Implementation of President power based on Article 10 of the 1945 Constitution as long as the Presdiden government of Indonesia has implementatition. The was Command, was used as power instrument.

Abstract

Bank Indonesia created an appropriate regulatory regime to drive the pace of innovation carried out by Financial Technology Providers while still applying the principles of consumer protection, risk management and prudence. One of the efforts made by Bank Indonesia was by issuing provisions concerning a regulatory sandbox for Financial Technology Providers along with their products, services, technology and/or business models in a Board of Governors Member Regulation No 19/14/PADG/2017 on the Limited Technology Testing Room (Regulatory Sandbox) Financial Technology. Meanwhile, the Financial Services Authority also issued regulation regarding the Regulatory Sandbox for Financial Technology Organizers in Financial Services Authority Regulation No. 13 / POJK.02/2018 on the Digital Financial Innovations in the Financial Services Sector. The main point of view to be analysed is the existence of regulatory sandbox approach held by Bank Indonesia and the Financial Services Authority as an effort to encourage the growth of Financial Technology in Indonesia.

Abstract

The development of the internet which is increasing both in technology and its use, has made crimes that were originally conventional such as threats, theft and fraud can now be carried out by using computer media online with a very small risk of being caught. cases of fraud by manipulating someone's data or using someone's name to carry out their fraudulent actions through Facebook and Whatsapp online media occurred in the Lampung Province area. This study was conducted to identify and explain the factors that cause perpetrators to commit criminal acts of manipulation and creation through Facebook social media accounts and how to implement criminal sanctions. This research is a normative juridical research that wants to identify the background aspects and the application of criminal sanctions. The data used consists of primary legal materials, secondary legal materials, and tertiary legal materials. The results showed that the factors causing the perpetrators to commit criminal acts of manipulation and creation through Facebook social media accounts were environmental factors, lack of social control, community interests, people's ignorance, facilities, facilities, technological progress and psychological factors. The application of material criminal sanctions against the perpetrators of the criminal act of manipulation and creation through the Facebook social media account that was applied was appropriate because the elements of a criminal act were proven.

Abstract

Hukum adalah himpunan peraturan yang mengurus tata tertib suatu masyarakat yang harus ditaaati oleh masyarakat itu. Tradisi hukum di daratan Eropa mengenal pembagian hukum menjadi dua yaitu hukum publik dan hukum privat, tetapi di sistem Anglo Saxon atau Common Law tidak ada pembagian seperti demikian. Suatu ketentuan yang mengatur hak dan kepentingan antar seluruh individu dalam masyarakat disebut Hukum Privat. Pengangkatan anak harus dilakukan dengan proses hukum, yaitu melalui penetapan pengadilan. Pengangkatan anak melalui lembaga pengadilan adalah untuk mendapatkan kepastian hukum, karena akibat hukum dari pengangkatan anak menyangkut kewarisan dan tanggung jawab orangtua kepada anaknya. Pengajuan permohonan penetapan pengangkatan anak dapat dilakukan di Pengadilan Negeri maupun Pengadilan Agama bagi orang yang beragama Islam. Permasalahan penelitian mengenai tinjauan yuridis terhadap permohonan pengangkatan wali bagi anak dalam hal untuk memenuhi salah satu persyaratan masuk Tentara Nasional Indonesia Angkatan Darat berdasarkan hukum perdata dan faktor-faktor penghambat implementasi perubahan pengangkatan wali bagi anak dalam hal untuk memenuhi salah satu persyaratan masuk Tentara Nasional Indonesia Angkatan Darat. Metode penelitian yang digunakan yaitu yuridis normative. Penunjukan wali bertujuan untuk melindungi hak dan memenuhi kebutuhan dasar Anak serta mengelola harta Anak agar dapat menjamin tumbuh kembang dan kepentingan terbaik bagi anak. Dalam perundang-undangan di Indonesia, pada dasarnya yang berhak dan mempunyai tanggung jawab menjadi wali, pengasuhan serta pemeliharaan anak adalah kedua belah pihak, yaitu suami dan istri selama memiliki kecakapan untuk menjalankan tugasnya tersebut.

Abstract

Pemohonan menjadi pengampu sangatlah penting di ajukan kepengadilan karena merupakan bukti otentik bagi seseorang untuk di taruh di bawah pengampuan dan bagi orang yang bertindak sebagai pengampuannya. Metode penelitian menggunakan pendekatan yuridis normatif dan empiris. Jenis data yang digunakan adalah data sekunder dan data primer. Pengumpulan data melalui penelitian kepustakaan (library research) dan penelitian lapangan (field research). Analisis data yang digunakan adalah yuridis kualitatif. Hasil penelitian menunjukkan pertimbangan hakim dalam menetapkan seseorang sebagai pengampu berdasarkan Putusan Nomor 35/Pdt.P/2020/Pn.Tjk adalah tidak ada bukti-bukti yang otentik yang menjelaskan pengampu berkelakuan buruk terhadap si terampu. pengadilan tetap tidak melaksanakan pemeriksaan baik terhadap si terampu ataupun keluarga sedarah tersebut dengan alasan bukti-bukti tentang keadaan si terampu telah dijelaskan pada permohonan penetapan pengampuan.  Tugas dan wewenang dalam pengampuan atau perwalian mengenai Putusan Nomor 35/Pdt.P/2020/Pn.Tjk adalah: Pengampu melakukan pengurusan pribadi dan harta kekayaan pihak yang diampu (Pasal 449 jo. 441 KUH Perdata). Pengampu hanya melakukan tugas pengurusan terhadap hal-hal yang terkait dengan kepentingan si terampu, misalnya dalam situasi menggantikan si terampu sebagai pemegang kekuasaan sebagai orang tua atas anak si terampu yang belum dewasa (Pasal 1453 KUH Perdata). Saran, sebaiknya dalam melakukan pemeriksaan calon terampu harus benarbenar didengar pendapat para pihak yang terkait. Bukan dari pendapat satu pihak saja yaitu orang yang mengajukan permohonan pengampuan. Sehingga tidak akan menimbulkan kerugian dan tuntutan dari pihak-pihak yang merasa keberatan terhadap penetapan pengampuan tersebut dan pada kenyataannya pengadilan juga jarang melakukan pemeriksaan secara langsung bagaimana keadaan si terampu karena akan membutuhkan waktu yang lebih lama. Menurut pengadilan jika bukti-bukti telah cukup maka pemeriksaan secara langsung tidak dilakukan, padahal ini merupakan hal yang penting agar memberi kejelasan bagaimana keadaan si terampu sebenarnya.

Abstract

The Criminal Act of Forgery of Letters is a criminal act whose implications have an impact on the truth and trust of people. The perpetrator uses a fake letter aimed at obtaining benefits for himself and for his actions it can harm others both losses of an individual nature and losses that have a broad impact on the act itself. The research methods used in this writing are normative juridical, and empirical approaches. The data used are secondary data and primary data. Data analysis uses descriptive analysis. Factors causing the perpetrator to commit a criminal act of forgery of a rapid antigen test letter in Case Number: 384/Pid.B/2021/PN. Kla is the Intention of the Perpetrator, the Factor of Low Education, the Factor of Economic Needs, and the Factor of Low Morals and Religious Knowledge. Liability of Criminal Offenders of forgery of rapid antigen test letters in Decision No. 384/Pid.B/2021/PN. Kla is charged with article 14 paragraph (1) of law of the Republic of Indonesia Number 14 of 1984 concerning Infectious Disease Outbreaks Jo Article 55 paragraph (1) 1 of the Criminal Code. The people of South Lampung Regency should support efforts to overcome the infectious disease outbreak carried out by the South Lampung Police So that Covid-19 in the South Lampung area can be overcome to the maximum. The Public Prosecutor should be careful and careful in compiling the indictment letter, so that the indictment letter can be used the basis for the judge to impose or not impose a sentence on the offender who is facing trial.

Abstract

Propemperda is a planning instrument for the formation of regional regulations which are arranged in a planned, integrated and systematic manner. Article 8 paragraph (5) Regulation of the DPRD Province of Lampung Province 1/2019, the determination of Propemperda takes into account the realization of Propemperda with local regulations which are stipulated every year with a maximum addition of 25% of the number of regional regulations stipulated in the previous year. In 2020 the Province of Lampung established 5 regional regulations, so the Propemperda for 2021 should have 7 regional regulations but instead stipulated 25 regional regulations. This stipulation has an impact on the quality of regional legal products produced, the existence of regional regulations that have been canceled and the low IDI of the Lampung Provincial Government in the field of law and the formation of regional legal products. Article 8 paragraph (5) DPRD Regulation 1/2019 has been implemented but has not been maximized due to obstacles. The obstacles include not having gone through the Regional Regulation Needs Analysis and the absence of a regional regulation on Procedures for Forming Propemperda. The implication of the ranperda which exceeds the stipulated amount is the low IDI value for Lampung Province.
