Abstract

Penulisan ini dilakukan berdasarkan pada permasalahan tentang lahan pertanian pangan memiliki fungsi strategis secara sosial, ekonomi dan religius bagi masyarakat Indonesia yang agraris. Namun karena kebutuhan terhadap lahan-lahan baru serta luas lahan yang terbatas serta laju pertumbuhan penduduk  yang memerlukan  lahan,  alih  fungsi  lahan tidak  dapat dihindari. Alih fungsi lahan bila  tidak  diantisipasi  akan mengancam ketahanan, kemandirian dan kedaulatan pangan petani dan  masyarakat. Karena itu,  akan ditelaah lebih lanjut mengenai perlunya perlindungan hukum bagi lahan pertanian pangan yang ada menjadi lahan pertanian abadi dalam kebijakan negara mengenai perlindungan lahan pertanian pangan berkelanjutan. Melalui penelitian normative dengan pendekatan dan pendekatan  peraturan  perundang-undangan,  hasil penelitian menunjukan  bahwa Bagi masyarakat sebagai tambahan pengetahuan   bahwa untuk mewujudkan ketahanan pangan nasional,lahan pertaniannya harus dipertahankan.Bagi pemerintah untuk menyusun program dan kebijakan  terkait  dengan   perlindungan   lahan   pertanian berkelanjutan di Kabupaten Sinjai. Pemerintah Daerah perlu  menetapkan kebijakan perlindungan lahan pertanian pangan berkelanjutan dalam Peraturan daerah tentang Rencana Tata Ruang Wilayah yang selanjutnya diderivasi ke dalam Peraturan daerah tentang Perlindungan Lahan Pertanian Pangan Berkelanjutan agar alih fungsi lahan dapat dicegah dan lahan pertanian pangan dapat dikembangkan menjadi lahan pertanian abadi untuk mewujudkan kemandirian dan ketahanan pangan.

Abstract

Tanah Tongkonan merupakan salah satu bentuk tanah milik masyarakat hukum adat yang ikut serta kedalam program Pendaftaran Tanah Sistematis Lengkap (PTSL), yang dilakukan oleh Badan Pertanahan Nasional Kabupaten Toraja Utara berdasarkan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 6 Tahun 2018  tentang Pendaftaran Tanah Sitematis Lengkap (PTSL), yang mana hal tersebut bertentangan Peraturan Pemerintah Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah. Penelitian ini bertujuan untuk menganalisis bentuk Pendaftaran Tanah Sistematis Lengkap (PTSL) terhadap tanah tongkonan. Penelitian ini menggunakan metode penelitian empiris, dengan menganalisis data yang terkumpul melalui wawancara dan studi kepustakaan. Hasil penelitian ini menunjukkan bahwa apabila tanah tongkonan didaftarkan melalui program pendaftaran tanah sistematis lengkap (PTSL) akan menimbulkan berbagai permasalahan terutama yang berwenang sebagai pemegang sertifikat hak atas tanah tongkonan, dan kemudian pemberian hak melalui penerbitan sertifikat bertentangan dengan semangat Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok Agraria (UUPA).

Abstract

Regulations on the Recognition and Protection of Customary Law Communities are not always effective. This study was to determine the concept of recognition and protection of the Customary Law Community in Rawa Aopa Watumohai National Park. This research is a normative legal research. The results of the research are First, the law still provides conditional recognition of indigenous peoples, which limits their space. second, that the recognition and protection of the customary MHA of Moronene Hukaea Laea in Bombana Regency has not been maximized. They have received recognition and protection through a recognition of perda, but their customary territory still has the status of designating a National Park Area, so they cannot use it as customary land.

Abstract

Regarding the buying and selling used customary land without signing in front of the Camat as the temporary PPAT that occurred in the Wajo area, this has certainly become a legal problem. This problem is related to the authentication of the land transaction deed as the principle of land registration at the National Land Agency of Wajo Regency. The research method in this study uses empirical legal research (law in action), which is to examine and analyze the workings of law in society, using a sociology of law approach. The legal sociology approach is an approach that analyzes how the reaction or interaction occurs when the norm system works in society. With the results of the study, although the signing of the deed of sale by the parties concerned, the seller, buyer and witnesses were not carried out before the authorized PPAT, in this case the PPAT of the Camat, if there was no legal problem (dispute) then the deed of sale and purchase was still considered as an authentic deed because physically in the form of the deed of sale there are signatures of the parties concerned, namely the seller, the buyer, the witnesses and the PPAT itself. The implementation of the sale and purchase of former property rights (custom) in Wajo Regency which is carried out before the Village Head is basically not in accordance with land law in Indonesia. This is because since the UUPA was enacted, only deeds made by authorized officials (PPAT) can be used as the basis for the transfer of land rights as stated in Article 37 paragraph (1) Government Regulation no. 24 Years l997.
