Abstract

Maraknya anak jalanan, gelandangan, dan pengemis di Kota Palembang sangat memprihatinkan di era Pandemi Covid-19. Hal ini menjadi masalah sosial yang cukup serius. Apabila dibiarkan menimbulkan dampak yang berakibat pada kesenjangan sosial, dan berpengaruh pada tingkat kriminalitas. Meskipun sudah ada Peraturan Daerah yang mengatur. Penelitian ini tentang efektivitas Peratura Daerah Kota Palembang tentang anak jalanan, gelandangan dan pengemis yang berkesejahteraan sosial. Jenis penelitian kualitatif untuk menganalisis efektifitas Peraturan Daerah Nomor 12 Tahun 2013 tentang Pembinaan Anak Jalanan, Gelandangan dan Pengemis di Kota Palembang, dan dampak Peraturan Daerahyang berkesejahteraan sosial. Tipe penelitian normatif-empirismenggunakan data sekunder dan data primer. Sumber dan jenis primer, sekunder, dan tersier. Metode pengumpulan data dengan observasi dan wawancara tidak terstruktur dengan Dinas Sosial Kota Palembang, DPRD Kota Palembang, Anak jalanan, Gelandangan, dan Pengemis, Sat Pol PP, Serta Masyarakat Kota Palembang. Teknik pengambilan data menggunakan Purposive Sample, yaitu penentuan informan tidak didasarkan pedoman atau berdasarkan perwakilan populasi, namun berdasarkan kedalaman informasi yang dibutuhkan. Adapun hasil penelitian dalam riset ini adalah belum efektifnya Peraturan Daerah Nomor 12 Tahun 2013 tentang Pembinaan Anak jalanan, Gelandangan Dan Pengemis di Kota Palembang. Peraturan belum berjalan secara maksimal. Faktor kendala di lapangan di mana kinerja  aparat penegak hukum kurang maksimal dankesejahteraan aparat penegak hukum. Keterbatasan sarana dan prasarana dalam melakukan penjangkauan, dan kurangnya sumber Daya Manusia dalam melakukan pembinaan. Faktor masyarakat karena  minimnya kepedulian serta kesadaran masyarakat terhadap aturan yang ada. Faktor kebudayaan di mana kurangnya nilai ketertiban dannilai ketenteraman.Dampak Peraturan Daerah Nomor 12 Tahun 2013 tentang Pembinaan Anak jalanan, Gelandangan Dan Pengemis di Kota Palembang yang belum berkesejahteraan dan meningkatnya tindak kriminalitas, pergaulan bebas diantara mereka, dan menyebabkan banyak masyarakat Kota Palembanglain beralih profesi serupa untuk keberlangsungan hidupnya.

Abstract

Legal politics of the Constitutional Court Decision Number 46 / PUU-VIII / 2010 concerning the status of children outside of marriage is that Article 43 of Law Number 1 of 1974 which reads "Children born out of wedlock only have a civil relationship with their mother and mother's family" contrary to the 1945 Constitution. The legal politics of the Constitutional Court is based on the principle of "equality before the Law", namely the principle of "equality before the law". This principle is contained in the 1945 Constitution Article 28B paragraph (1) and (2) and Article 28D paragraph (1). According to the Court naturally, it is not possible for a pregnant woman without meeting between the ovum and spermatozoa either through sexual contact or through other means based on technological developments that cause fertilization. Therefore, it is incorrect and unjust when the law stipulates that a child born from a pregnancy due to sexual relations outside of marriage has only a relationship with the woman as his mother. Thus, the civil rights of children outside of marriage meant by the Constitutional Court's ruling are only material rights. Siyasah Syar'iyyah, in this case, is a review of the maqasid shari'ah that the aim is to protect and maintain the child's nasab (hifzuu nasl). So the study of sharia maqasid on the decision of the Constitutional Court Number 46 / PUU-VIII / 2010 is interpreted as civil rights to biological fathers only limited to material rights to children not the rights of the people and inheritance.

Abstract

Study on the juridical analysis of SEMA No. 3 of 2015 on the Decision of the Narcotics Law Number 35/2009 based on a hierarchical law with legal certainty is very necessary. The number of narcotics cases was decided as a crime of drug abuse, example of the decision of the narcotics case in the Lahat District Court, where the Panel of Judges sentenced based on Article 112 paragraph (1) of Law 3/2009 and the demands of the Public Prosecutor. His sentence was only ten months. far above the minimum sentence stated in Article 112 paragraph (1), which is four years according to SEMA 3/2015, where the judge may decide narcotics cases below the minimum. This violates the principle of "lex superior derogate legi inferiori", If there is a conflict between high and low laws and regulations, then the high one must take precedence. This type of research is normative, with analytical descriptive method. Research shows that SEMA is classified as a policy regulation (bleidsregel), and because it is intended specifically for court officials. The legal position of SEMA No.3/2015 on the Decision of Law No.35/2009 based on the hierarchical legislation in deciding narcotics cases deviates from the criminal rules stipulated in Law No.35/2009, and deviates from existing legal principles.

Abstract

In the legal and governmental aspects, bureaucratic reform is very urgent to be realized, including the policy of ASN political neutrality. Therefore, this study aims to analyze the political neutrality policy of ASN according to Law Number 5 of 2014 concerning State Civil Servants in the Perspective of Human Rights Protection. The scope of this research is carried out by drawing legal principles against written positive law. Legal principles are used in interpreting Law Number 5 of 2014 concerning ASN by relating it to the perspective of protecting human rights. The method used is normative juridical legal research using secondary data. The research results reveal that every civil servant organization does not take sides with any form of influence and interests of anyone. In this case, there are restrictions on the political rights of ASN according to Law Number 5 of 2014 concerning State Civil Servants not violating human rights as stipulated in the 1945 Constitution of the Republic of Indonesia. According to the principles of Islamic law, ASN must be neutral and obedient to leaders. Elected without antagonizing him. Thus, it is concluded that the ASN political neutrality policy has met 4 indicators of a rule of law, namely protection of human rights, distribution of power, governance based on laws and regulations, and state administrative court.

Abstract

In the political policy of the village, there has been a systematic uniformity through the laws and regulations. The enactment of the Law on Villages was followed by other regulations. With the enactment of Law No. 6/2014 on Villages, it has given new hope to build more independent villages. For example, 70 percent of village funds are allocated for development, and no more than 30 percent of other operations. Village funds are used by the village government based on the mandate of the law to be effective. This is in accordance with the goals and plans that have been set at the village meeting. For this reason, a study of the effectiveness of the legislation on village funds is very important. Based on the problems above, this study analyzes the effectiveness of the legislation on village funds on funding governance in villages for the advancement of rural communities. The research method used is juridical. Data analysis is described. In conclusion, the legislation on village funds is no longer effective, because it does not show the level of success that has been set, and the results of its activities are not in accordance with its objectives. Although it has been arranged, it is not yet perfect.

Abstract

The Criminal Procedure Code is a generally accepted procedural law for criminal acts in Indonesia. It is regulated that those who have the right to carry out prosecutions are the Public Prosecutor or the Prosecutor. There is an element of legal uncertainty regarding his authority in prosecuting corruption crimes, for example. The separation of the authority of the Corruption Eradication Commission from the Prosecutor's Office, specifically as a claimant. In fact, the prosecution is on behalf of the Public Prosecutor or the Prosecutor. With the dominus-litis principle, expressly states that there is no other institution other than the Prosecutor as the Public Prosecutor who has the absolute right to sue. This study examines the principle of dominus litis for the prosecutor in the prosecution of criminal acts based on the law. The research method, the type of normative research with a descriptive approach. It was concluded that it was necessary to clarify the position of the Indonesian Prosecutor's Office as an executive agency. According to the rules, the Prosecutor's Office should be under the same roof as the judiciary. or the sake of the presence of legitimacy for the Prosecutor's Office itself. So that there is no uncertainty of authority for the Public Prosecutor in prosecuting criminal cases. Oleh karena itu perlu dibuat peraturan baru terkait dengan Kejaksaan RI untuk menuntut kasus tindak pidana berdasarkan asas dominus litis. Where the Prosecutor's Office is the owner of the dominus litis authority in terms of prosecution.
