Abstract

Law that positively regulates the imposition of civil sanctionx, administrative sanctions and criminal sanctions as regulated in Law Number 26 of 2007 on Spatial Planning and more on the local regulation Malang No. 4 of 2011 on Spatial Planning Malang Year 2010- 2030 (RTRW). Administrative and criminal sanctions as a sanction premium remedium while criminal sanctions as a sanction ultimum remedium. Former Act and regulation are still not meticulous in designing/forming. That is evidenced still weakness in some of the provisions in the legislation are still related to civil sanctions, administrative and ceiminal. The legislator has not been meticulous in making decisions RTRW. Hence it need for harmonization between laws and regulations both at the level of local regulations and at the level of the Act.

Abstract

Abstract

This paper aims to talk about legal politics, talking about legal products produced by the authorities, whether they hear the aspirations of the community in the process of their formation or are more concerned with the interests or goals of the rulers themselves. Political influence in the formation of law determines the values ​​contained in the law are values ​​that live in a society which is to achieve the goal of the law itself, namely justice. The purpose of the research that the author examines is to describe the formation of the Jombang Regency Regional Regulation Number 9 of 2017 concerning Responsive or Repressive Micro Administration. Based on the process of its formation, the Regional Regulation of Jombang Regency Number 9 of 2017 already contains the principles for the formation of laws and regulations

Abstract

The final and binding phrase on the DKPP decision in the provisions of Article 458 paragraph (13) of the Election Law was submitted for judicial review through the Constitutional Court decision Number RI 32/PUU-XIX/2021. In the provisions of Article 458 paragraph (13), the phrase final and binding means that the DKPP's decision can’t be submitted for legal effort. However, from the case of Evi Novida Eka Ginting, the Election Organizer Ethics Council (DKPP) decision can be submitted for legal effort. This has implications for the legal certainty of the final and binding phrase in the provisions of Article 458 paragraph (13). This research aims to analyze the final and binding decisions of the Election Organizer Ethics Council in terms of the Constitutional Court Decision Number.32/PUU-XIX/2021 and Law Number 7 of 2017 concerning Elections and to analyze the Election Organizer Ethics Council decisions. which is final and binding in terms of the aspect of legal certainty. The research method used is normative juridical. Based on the results of the research and discussion, First, viewed from the Constitutional Court decision no. 32/PUU-XIX/2021 the phrase "final and binding" in Article 458 paragraph (13) can be an object in the Administrative Court. What can be submitted is a legal effort, a lawsuit to the Administrative Court (PTUN) to cancel the Presidential Decree. Reviewed according to Law No.7 of 2017 concerning General Elections, Article 458 paragraph (13), the Election Organizer Ethics Council (DKPP) decision is final and binding, this means that the decision cannot be made to legal effort and directly can be held. Second, according to the principle of legal certainty, final and binding phrases cause legal uncertainty. Because the phrase is final and binding on the DKPP decision, it is interpreted that the Election Organizer Ethics Council (DKPP) decision can’t be made due to legal effort and must be held. So the final phrase in Article 458 paragraph (13) should be removed cause the meaning has multiple interpretations.

Abstract

This research examines the position and binding power of Ministerial Regulation (Permen) and Coordinating Ministerial Regulation (Permenko) in Indonesia, after the Job Creation Law (Law No. 6/2023). The formulation of the problem includes (1) how the legal construction of Permen as a form of delegated legislation is, and (2) how is the coordinative nature and normative position of Permenko in the hierarchy of national regulations. The method used doctrinal analysis of positive legal norms combined with legislative delegation theory and public administration theory on coordination. The main findings reveal that the effectiveness of Permen depends on the clarity of delegation clauses and enforcement mechanisms, while the effectiveness of Permenko is determined by (a) clarity of delegation, (b) inclusion of sanction provisions, (c) layering regulation through supporting government regulation/presidential regulation, (d) participatory drafting mechanisms, and (e) accountability mechanisms such as reporting clauses and judicial review. This research contributes by formulating an integrated normative blueprint for the design of Permenko that integrates legal and administrative elements, as well as recommendations for amending Law No. 12/2011 and issuing supporting regulations. The implications of the study include strengthening legal legitimacy, increasing bureaucratic compliance, and improving checks and balances mechanisms in the delegation of executive authority. With the implementation of this blueprint, Permenko are expected to become a strategic instrument to ensure the consistency of national public policies, strengthen the principle of constitutionalism, and realize good governance in Indonesia.Keywords: Binding Power, Delegated Authority, Ministerial Regulations, Normative Hierarchy AbstrakPenelitian ini mengkaji kedudukan dan daya ikat Peraturan Menteri (Permen) dan Peraturan Menteri Koordinator (Permenko) di Indonesia pasca UU Cipta Kerja (UU No. 6/2023). Rumusan masalah meliputi (1) bagaimana konstruksi hukum atas Permen sebagai salah satu bentuk delegasi peraturan perundang-undangan, dan (2) bagaimana sifat koordinatif dan kedudukan normatif Permenko dalam hierarki peraturan perundang-undangan nasional. Metode yang digunakan adalah analisis doktrinal norma hukum positif yang dipadukan dengan teori delegasi peraturan perundang-undangan dan teori administrasi publik tentang koordinasi. Temuan utama penelitian ini adalah, bahwa efektivitas Permen tergantung pada kejelasan klausul delegasi dan mekanisme penegakannya, sedangkan efektivitas Permenko ditentukan oleh (a) kejelasan delegasi, (b) pencantuman ketentuan sanksi, (c) pelapisan peraturan melalui peraturan pemerintah/peraturan presiden pendukung, (d) mekanisme penyusunan partisipatif, dan (e) mekanisme akuntabilitas seperti klausul pelaporan dan uji materiil. Penelitian ini memberikan kontribusi berupa penyusunan cetak biru normatif terpadu untuk perancangan Permenko yang mengintegrasikan unsur hukum dan unsur administratif, serta rekomendasi untuk melakukan amandemen terhadap UU No. 12/2011 dan penerbitan peraturan pendukung. Implikasi dari penelitian ini antara lain penguatan legitimasi hukum, peningkatan kepatuhan birokrasi, dan perbaikan mekanisme checks and balances dalam pendelegasian kewenangan eksekutif. Dengan diimplementasikannya cetak biru ini, Permenko diharapkan dapat menjadi instrumen strategis untuk menjamin konsistensi kebijakan publik nasional, memperkuat asas konstitusionalisme, dan mewujudkan tata pemerintahan yang baik di Indonesia.Kata kunci: Kekuasaan Mengikat, Kewenangan yang Didelegasikan, Peraturan Menteri, Hirarki Normatif

Abstract

Abstract Background: Witnesses are a form of evidence that is valid according to law because it is used to reveal a fact. The witness's statement can be extracted by the investigator, namely at the investigation stage. If the witness is a child, their rights are protected as regulated in Law No. 23 of 2006 concerning Child Protection. Purpose: This research aims to find out how children's rights are protected, the obstacles to providing protection, and efforts to overcome barriers to delivering protection rights for children as witnesses due to the crime of sexual abuse committed by children at the investigation stage in the jurisdiction of the Kepanjen Resort Police. Methods: This research uses a sociological juridical approach, data collection techniques in the form of interviews with investigators, and direct observation at the PPA Unit of the Kepanjen Police and Children who have been witnesses as a place for collecting primary data to carry out document studies in the form of official documents, reports and regulations used. Findings: The results reveal substantial inconsistencies in the age of criminal responsibility, limited compliance with the UN Convention on the Rights of the Child, and inadequate consideration of psychological maturity in determining culpability. Theoretical and Practical Implications: Research results show that in investigations of child abuse cases, children as witnesses have received guaranteed rights under the law . Originality/Novelty: The obstacles faced are classified as internal and external obstacles. So that in the future, PPA will tighten supervision and establish better cooperation with the government .
